HomeMy WebLinkAbout992823.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 24, 1999 TAPE #99-38 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, November 24, 1999, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile - EXCUSED Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Comptroller, Claud Hanes MINUTES: Commissioner Baxter moved to approve the minutes of the Board of County Commissioners meeting of November 22, 1999, as printed. Commissioner Vaad seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Baxter seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. PUBLIC INPUT: There was no public input. WARRANTS: Claud Hanes, Comptroller, presented the following warrants for approval by the Board: All Funds $814,958.12 Electronic Transfers - All Funds $1,944,941.86 Commissioner Kirkmeyer moved to approve the warrants as presented by Mr. Hanes. Commissioner Vaad seconded the motion, which carried unanimously. n 1 ti. . B992823 -/new-v � ��w-�� C0016 BIDS: PRESENT BIDS: Mr. Hanes stated there are no bids to present. NEW BUSINESS: CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON BOULEVARD B, MAIN STREET, AND BOULEVARD D OF CAMFIELD SITE AT WELD COUNTY ROAD 51: Frank Hempen, Jr., Director of Public Works, recommended approval of the installation of"Stop"signs on Boulevard B, Main Street, and Boulevard D of Camfield Site, which is an old town site along Weld County Road 51, between Weld County Roads 80 and 82. Mr. Hempen stated these streets are privately maintained; however, these signs will allow the County to control traffic entering Weld County Road 51. Commissioner Vaad moved to approve said installation of traffic control devices. Commissioner Baxter seconded the motion. In response to Commissioner Baxter, Mr. Hempen stated the site was reviewed based on complaints from people in the community and this will help control movement from the Camfield Site into heavy traffic. CONSIDER REMOVAL OF WEIGHT LIMIT POSTING AT BRIDGE 6/23A: Mr. Hempen stated upon review of the inspections and the structure of the bridge, the weight limit is not necessary. Commissioner Vaad moved to approve the removal of the weight limit posting. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER LICENSE AGREEMENT FOR USE OF ENVIRONMENTAL, HEALTH AND SAFETY HOMEPAGE AND AUTHORIZE CHAIR TO SIGN - WEBSITE SAFETY SYSTEMS, INC.: Mr. Barker stated Larry Peterson, Weld County Sheriffs Office, has requested use of the Environmental, Health and Safety Homepage; Mr. Warden has reviewed the agreement and recommends approval as it does not conflict with the Weld County web page. Commissioner Vaad moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Baxter, the motion carried unanimously. PLANNING: CONSIDER CONDITION OF APPROVAL#4 FOR A MINOR RESUBDIVISION FOR THE VACATION OF RIGHT-OF-WAY IN UNINCORPORATED TOWN OF BARNESVILLE - LINDSEY AND RUTH WILSON: Julie Chester, Department of Planning Services, stated Lindsey and Ruth Wilson applied for a Minor Resubdivision for the vacation of Ahlstrand Avenue, Weldon Avenue, as well as dedicated alleys east of Weld County Road 61.5 and north of State Highway 392,all within the unincorporated Town of Barnesville. Ms. Chester stated the request was approved on September 1, 1999; however, the applicants were not adequately notified, and they do not agree with Condition of Approval#4. Ms. Chester stated this vacation affects Lots 57, 58, and 59, all owned by members of the Wilson family, who signed the petition for vacation. Ms. Chester stated to ensure traveling safety, the Department of Public Works recommends removal of the second access to Lot 58 from State Highway 392, and use of the existing access, which is located where Weld County Road 61.75 would be. In response to Commissioner Vaad, Ms. Chester indicated the location of Lot 59. Mr. Barker explained Lot 58 is owned by Robert Wilson, son of the applicants, who signed petition but is not an applicant. Robert Kreps represented the applicant and stated Robert Wilson signed petition; however, he does not want to remove his driveway, because he is a separate property owner. Mr. Kreps stated the Department of Public Works previously granted the access in May 1996, therefore, it should not be a problem now because the vacation of the streets and alleys does not create any additional accesses to State Highway 392. Commissioner Baxter commented there are two drive ways within a very short distance,and the Department of Public Works would prefer there only be one access for the two adjoining properties to reduce the number of accesses onto an arterial. Mr. Kreps reiterated the access was previously granted and he does not agree that because Robert Wilson is a family member, he should have to forfeit his driveway, since he was not an applicant for the initial vacation. In response to Commissioner Kirkmeyer, Don Carroll, Department of Public Works, reviewed the existing and proposed accesses for Lot 58, as Minutes, November 24, 1999 992823 Page 2 BC0016 shown on an aerial photograph, marked Exhibit A, and reiterated they are proposing one of the accesses be removed to remain consistent with Ordinance#180. Chair Hall commented its does not seem fair to place restrictions on a person who was not a party to the application, and added he may have signed the petition stating he was not opposed; however, he does not request the vacation. In response to Commissioner Baxter, Mr. Kreps stated if Robert Wilson exits through the eastern access, he must cross another person's property. In response to Commissioner Kirkmeyer, Mr. Barker stated pursuant to State statute, when a right-of-way is vacated it is split between the adjacent properties. He further stated he believes because Robert Wilson's property is involved in the Minor Resubdivision, his property should be subject to the Conditions regardless of whether he is an applicant because he signed the petition indicating he was not opposed. Mr. Barker recommended revising the Condition to state the access to Lot 58 will be eliminated when Lots 54 and 56 are developed. Mr. Kreps stated if property will be added to Lot 58 as a result of the vacation, the area will need to be surveyed to show the exact property boundary and determine whether the eastern access is on Robert Wilson's property or if it is part of the property to the east. He stated the drawing the Board is reviewing is a sketch and not an official plat. Commissioner Kirkmeyer expressed concern with having two accesses onto a major arterial, and stated at some point one of the accesses needs to be eliminated to address the safety issue. She stated the access was granted in 1996 because it appeared there was no access to Robert Wilson's house; however, the property owners need to be aware of the fact that at some time Lots 54, 56, and 58 will likely have a shared access. Lindsey Wilson, applicant, stated the eastern access was granted by the Colorado Department of Transportation to access his house and farm. Later Weld County granted an access to Robert Wilson to access Lot 58. Commissioner Baxter stated regardless of how the accesses were established, the Board needs to consider traveling safety on State Highway 392. After speaking with Ruth Wilson, co-applicant, Mr. Kreps stated according to survey markers, the accesses are on two separate parcels. In response to Commissioner Kirkmeyer, Mr. Barker stated the entire width of Ahlstrand Avenue adjacent to both Lots 58 and 59 will be added to those lots, and Weldon Avenue will be split in half between the lots that are adjacent to both sides of the right-of-way. Commissioner Baxter stated this issue can only be resolved by determining whether the accesses are to one property or two. Chair Hall expressed concern with approving this issue without the applicant being present to agree to the Conditions. Commissioner Vaad agreed; however,the safety issue on State Highway 392 needs to be addressed once the other lots are developed. Commissioner Vaad moved to delete Condition of Approval#4 of the Minor Resubdivision for the Vacation of right-of-way in the unincorporated Town of Barnesville, as approved on September 1, 1999. Commissioner Baxter seconded the motion. Commissioner Kirkmeyer stated she will vote in favor of the motion; however, she directed staff that the accesses need to be combined when Lots 54 and 56 are developed. The motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
