Tuesday, March 5, 1996
A regular meeting of the Weld County Planning Commission was held March 5, 1996, in the County
Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by Chairman, Richard Kimmel.

The summary of the January 16, 1996, minutes were addressed due to verbiage change. Zachary Allely
motioned that the January 16, 1996, minutes be approved. Jack Epple seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Marie
Koolstra - yes; Jack Epple -yes; Zachary Allely -yes; Arlan Marrs -yes; Shirley Camenisch -yes; Richard
Kimmel -yes. Motion carried unanimously.
The summary of the last regular meeting of the Weld County Planning Commission held on February 20,
1996, was approved as read.
1. CASE NUMBER: USR-1110
PLANNER: Chris Goranson
APPLICANT: Walker Commercial
REQUEST: A Site Specific Development Plan and a Special Review permit for a Major Facility
of a Public Utility (50 foot cellular telephone antenna) in the A (Agricultural) zone
district.
LEGAL DESCRIPTION: Part of the SE4 of the SE4 of Section 18, T3N R66W of the 6th P.M.,
Weld County, Colorado.
LOCATION: Approximately 405 feet north of Weld County Road 32; approximately 1/2 mile east
of Highway 85.
Shani L. Eastin explained that staff is recommending continuance on Case USR-1110, Walker Commercial
to March 19, 1996, due to an error in the public notification.
Zachary Allely motioned that Case USR-1110,Walker Commercial be moved to March 19, 1996. Arlan Marrs
seconded the motion.

APPLICANT: Richard Green (Green Acres Retirement Community).
REQUEST: A Planned Unit Development Change of Zone from A (Agricultural) to R-1 (Low
Density Residential).
LEGAL DESCRIPTION: The NW4 of Section 19, T4N, R6BW of the 6th P.M., Weld County,
Colorado.
LOCATION: South of and adjacent to State Highway 56; east of and adjacent to Weld County
Road 1.
Gloria Dunn explained staff is waiting on referral agencies to respond and asked that Case Z-497, Richard
Green (Green Acres Retirement Community) be continued to April 2, 1996.

3. CASE NUMBER: USR-1107
PLANNER: Gloria Dunn
APPLICANT: Hubert and Margaret Collins
REQUEST: A Site Specific Development Plan and a Special Review permit for wholesale used
vehicle sales in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Part of the NW4 of Section 6, T4N, R67W of the 6th P.M., Weld County,
Colorado.
LOCATION: East of and adjacent to Weld County Road 13;south of and adjacent to Weld County
Road 50.
Gloria Dunn explained this parcel has 20.4 acres and the Special Review permit is for one acre. Gloria stated
that the use is existing and the applicants wish to comply with the Weld County Zoning Ordinance. Staff is
recommending approval for the following reasons: The application complies with the Weld County
Comprehensive Plan in the A(Agricultural)zone district. Approximately one-half of this parcel is farmed and
remains in agricultural production.
The Town of Johnstown has no conflicts with this application and all other referral comments have been
incorporated into the staff recommendation. Gloria explained this business is compatible with the surrounding
area and that staff has not received any negative responses from surrounding property owners.
Marie Koolstra expressed concerns about the compatibility with farming in the area. Gloria Dunn explained
this site did not have any nearby neighboring residences and the site had proper screening. It is staffs opinion
that the location of this Special Review permit area is not useful for agricultural production.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
The applicant, Hubert Collins explained they prepare cars for wholesale to dealers in the area. This business
is not open to the public. The applicants are applying for this permit to continue their business, which is 90
percent of their income.
Shirley Camenisch asked where the cars were purchased. Mr. Collins explained they buy the cars from
wholesale dealers and replace parts. Marie Koolstra asked how many vehicles are on the site at one time.
Mr. Collins stated they are limited to 20 vehicles and are behind screening or in buildings. The applicant is

in agreement with the Staff Recommendations and Development Standards.
Zachary Allely moved that Case 1107, be forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval. Arlan Marrs seconded the motion.

4. CASE NUMBER: USR-1108
PLANNER: Todd Hodges
APPLICANT: Sonja Martin Young and Tom Young
REQUEST: A Site Specific Development Plan and a Special Review permit for a horse boarding,
breeding, and training facility in the A(Agricultural)zone district.
LEGAL DESCRIPTION: The N2 SE4 of Section 18, T2N, R67W of the 6th P.M., Weld County,
Colorado.
LOCATION: Approximately 1/4 mile west of Weld County Road 15; approximately 1/4 mile north
of Weld County Road 20.
Gloria Dunn explained this property is located on 40 acres. The access to this property is a one quarter mile
long recorded easement to Weld County Road 15. The applicants are applying for this Special Review permit
in order to use the horse facility publicly and to train horses on site.
Referral response from the Weld County Public Works Department requested additional information be put
on the plat, the access road be graded and drained and the driveway on site be no less than 18 feet wide.
The Weld County Health Department requested that public restrooms be provided for employees and patrons.
The Weld County Building Inspection Department requested that all construction meet code requirements for
commercial use, where applicable.
The Longmont Soil Conservation District had concerns on the concentration of animals and stated it may
lead to devegetation and soil erosion. The Special Review permit limits the number of horses to 110, although
160 horses are allowed as a use by right on 40 acres.
No objections were received from surrounding property owners and staff is recommending approval of the
application with the Conditions of Approval and Development Standards.
Sonja Martin Young applicant stated they will have facilities for 90 horses, an indoor riding arena and outdoor
rings.
Shirley Camenisch questioned how they will confine the horses and how may employees they will have. The
applicant explained they have stall barns and sheds with runs and communal pens planned. Mrs. Young also
stated they would employ one to two people.
Arlan Marrs asked about the manure disposal. The applicant explained that it is used on their property and
area farmers were interested to disburse on their fields or it would be hauled to the manure management
facility.
The applicants requested the use of port-a-lets temporarily for financial reasons. Trevor Jiricek, Supervisor,
Weld County Health Department, explained the department has allowed temporary use on port-a-lets. Trevor
stated temporary use needed to be defined. The applicants felt that in six months they could commit to
installing the septic system.

Discussion followed between Weld County Planning Commission members, Lee Morrison, Weld County
Assistant Attorney, Gloria Dunn, Current Planner and the applicants.
Zachary Allely motioned to add Condition of Approval #7: Not withstanding Condition of Approval 4b, the
applicant may use portable toilet facilities for a period of time not to exceed 180 days after final approval by
the Board of County Commissioners. Arlan Marrs seconded the motion.

5. CASE NUMBER: USR-1111
PLANNER: Shani Eastin
APPLICANT: Jody Meyer
REQUEST: A Site Specific Development Plan and a Special Review permit for a boarding kennel
for small animals(16 dogs and 6 cats) in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Lot A of RE-1853, located in the SE4 of Section 8, T6N, R66W of the 6th
P.M., Weld County, Colorado.
LOCATION: North of and adjacent to Weld County Road 70; approximately 1/4 mile west of Weld
County Road 29.
Shani L. Eastin explained there were corrections in the packet. The legal notification stated this application
was for 16 cats and 16 dogs and should have read 16 dogs and 6 cats. Additionally the agenda stated 16
does and should state 16 dogs.
The Department of Planning Services staff is requesting that this application be continued to March 19, 1996.
The continuance would allow the applicant, Ms. Meyer, the opportunity to discuss potential problems and
concerns with surrounding property owners. The continuance would also provide the opportunity for Ms.
Meyers to evaluate her proposal to see if it is even feasible to continue. The applicant purchased this
property with the intent of establishing a boarding kennel. Ms. Meyers has recently learned that uses around
this property include hunting. Shani Eastin stated Ms. Meyer runs a first class operation and that Ms. Meyer's
realizes that any hunting within 100 feet of a kennel will affect the nervousness or anxiety of animals.
Shani Eastin stated that she has received one call from a secretary or representative for a surrounding
property owner and concerns from additional surrounding property owners have recently surfaced. The staff
and Ms.Meyers would like the opportunity to work with and discuss any concerns with surrounding property
owners.
Arlan Marrs expressed concerns about continuing this case. Shani Eastin explained that the applicant is
requesting the continuance and that staff did not have any concerns with continuing this case. Staff feels it
is good planning perspective to work with surrounding property owners and the applicant to present a well
rounded project.

The Chairman asked if there was anyone in the audience who wished to speak for or against this application
for continuance.
Surrounding property owners expressed concerns with the case, and agreed with staff that the case be
continued to March 19, 1996.
Lee Morrison, Assistant Weld County Attorney stated there would not be another mailing or legal notification
and that being here today would be the notice for the next Planning Commission meeting. Shani Eastin
explained that public notification would be sent for the Board of County Commissioners hearing which is the
next step beyond Planning Commission.
Jack Epple motioned that Case USR-1111, be continued to March 19, 1996. Marie Koolstra seconded the
motion.
