Lyco is the current lessee of certain oil and gas leases and operates certain facilities located on a portion of the lands covered by the • USR-1069 Application. While Lyco does not object to the granting of this USR, it formally requests that its pre-existing uses and access be specifically recognized by the Board of County Commissioners in its resolution respecting the USR. 'Lyco currently owns and operates the Sitzman *1 well located in the SW/4SW/4 of Section 4. The maps and plats provided to the Planning Department do not reflect Lyco's wells, gathering facilities or tank battery facilities. Lyco requests that applicant's proposed facilities not encroach any nearer than. 200 feet of its wellsite. Furthermore, Lyco owns a proposed location for a future well in the NW/4SW/4 of Section 4 . Flowlines from such well will likely connect to the existing tank battery facilities in the SW/4SW/4. A provision recognizing Lyco' s pre-existing rights, unrestricted access, and future rights to continue its activities should be included in the final approval of the USR. Lyco suggests that the _ applicant be required to fence off the existing wellsite and tank batteries and be responsible to segregate livestock away from lands over Lyco' s flowlines in the event of maintenance or required access to said lines. We. apologize for not submitting these comments previously to the Planning Commission but the original planning notice was not received or was inadvertently misplaced.
