A regular meeting of the Weld County Planning Commission was held March 19, 1996, in the County
Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by the Chairman, Richard Kimmel, at 1:30 p.m.

The summary of the last regular meeting of the Weld County Planning Commission held on March 5, 1996,
was approved as read.

REQUEST: A Site Specific Development Plan and a Special Review Permit for a boarding kennel
for small animals (16 dogs and 6 cats) in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Lot A of RE-1853, located in the SE4 of Section 8, T6N, R66W of
the 6th P.M., Weld County, Colorado.
LOCATION: North of and adjacent to Weld County Road 70; approximately 1/4 mile west of
Weld County 29.
Monica Daniels-Mika, explained a letter from the applicant, Jody Meyer has been received. Monica Daniels-
Mika stated the applicant is requesting this application be withdrawn.

Chris Goranson explained the Department of Planning Services is recommending approval of this application
for the following reasons: This application is consistent with the Weld County Comprehensive Plan and with
the intensity of the zone district. Chris Goranson felt it would be compatible with future development and does
not lie in any of the overlay districts. Chris Goranson stated one of the conditions of approval prior to recording
the plat is the applicant shall submit on the plat a recorded easement agreement.
Rob Walker, applicant, explained this application is for U.S. West. The applicants want to improve the cellular
antenna coverage between Greeley and Denver. The proposed area for this is by the water tower in
Platteville. Mr Walker stated they will be placing a wood pole the same height as a light pole. At the top of
the pole they will place ten foot whip antenna's. The ground equipment cabinets will be six feet by two feet
in size.
Richard Kimmel asked if the applicant was in agreement with the condition of approvals and development
standards. Mr. Walker stated they were in agreement.
Ann Garrison motioned that Case USR-1110 be approved with the condition of approvals and development
Standards. Shirley Camenisch seconded the motion.

Amendments to the Weld County Zoning Ordinance.
Monica Daniels-Mika gave an overview of the proposed amendments to the Weld County Zoning Ordinance,
as follows:
Section 10 - Farmland definitions were added; update of auxiliary quarters definition; commercial, Major
Facility of a Public Utility, and setback definitions.
Section 20- Updating the phrase''Weld County Engineering"with 'Weld County Public Works"; updating the
phrase "Department of Highways"with "Colorado Department of Transportation"; extended 14 day referral
response time to 21 days,and updating the word"productive"with the word"prime",'Weld County Subdivision
Regulations"with "Weld County Subdivision Ordinance"and temporary structures in the C-3 (Commercial)
zone district.
Section 40 - Minimum spacing between signs and outdoor shooting ranges.
Amend the cost of Zoning Permits for Mobile Homes from $200. to $230.
Discussion followed by Planning Commission members. Ron Sommer motioned to change Amendment 10A
#3,#5 from 2,000 square feet to 1,600 square feet and 20% in size to 50% in size. Ann Garrison seconded
the motion.

regular planning commission meeting on April 16, 1996. Ron Sommer seconded motion.

APPLICANT: City of Greeley do Joe Lohnes
REQUEST: A Site Specific Development Plan and Special Use Permit for an archery range and concrete
and asphalt storage and crushing facility in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Located in the SW4 of Section 30, T5N, R65W of the 6th P.M., Weld
County, Colorado.
LOCATION: North and adjacent to 49th Street; approximately 1/2 mile west of US Highway 85.
Todd Hodges explained that conditions of approval were added to the Department of Planning Service's
recommendation to cover concerns from referral entities. The lower portion of the property is in the floodplain
and no stockpiling would take place in this area. The rest of the property is in agricultural use with existing
vegetation to maintain erosion. The Department of Planning Services is recommending approval of this
application.
John Lohnes, City of Greeley Parks and Recreation, stated they agree with Weld County Planning's
recommendation but ask for leniency with Condition of Approval #4, regarding a septic system or a vault.
They would prefer port-a-lets. Todd Hodges explained the condition of approval requiring a vault system was
a Health Department requirement. Operation hours would be summer months with tournaments scheduled
twice a year.
Marie Koolstra had concerns regarding safety issues. Todd Hodges explained the layout of the proposal is
consistent with the Weld County Zoning Ordinance and discussion followed comparing traveling distances
of bullets vs. arrows. Ron Sommer had concerns that a future property owner would not take as much care
of the property as the existing applicants. Condition of Approval#10 and Development Standard#16 were
added, as follows:
The Site Specific Development Plan and Special Review permit shall be nontransferable.
Upon transfer, sale or rental of the property the Site Specific Development Plan and Special
Review permit shall be vacated.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
Fred Stencel, surrounding property owner, addressed concerns about flooding in the area, improper drainage,
wildlife, increased traffic, and noise in-the area.

APPLICANT: Robert Wardlaw, Loving Trust
REQUEST: A Site Specific Development Plan and Special Review Permit for a feedlot (4,000 head of
cattle) in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Pt of the NE4 of Section 3, T5N, R64W of the 6th P.M., Weld County,
Colorado.
LOCATION: North of and adjacent to Weld County Road 60 1/2; west of and adjacent to Weld County
Road 57.
Chris Goranson explained the changes and additions to the conditions of approval. Conditions for fugitive
dust control have been added. The development standards remain the same as the original Special Review
permit.
Tom Collins, representative, Robert Wardlaw, Loving Trust, explained the 4,000 head feedlot remains in
operation but a recorded exemption had been approved by the Board of County Commissioners to divide a
portion of the property, now known as Lot A. Access will be off of Weld County Road 57. A screening plan
required in the original Special Review permit would now be implemented. The property owner had applied
a herbicide spray to the area which made the planting of trees impossible. Soil conditions are now okay and
trees have been ordered. They will plant Russian Olives at 10 foot intervals.

Don Schoenriber, surrounding property owner, stated they are in agreement with this proposal. They would
rather have a nice residence on the property and would like to see the access off of Weld County Road 57,
due to traffic concerns in the area. Don Walters, prospective buyer of Lot A, stated it didn't matter to him
where the access was located.
Marie Koolstra moved Case Number AM-USR-1057, Robert Wardlaw, Loving Trust, be forwarded to the Board
of County Commissioners with the Planning Commission's recommendation for approval. Shirley Camenisch

APPLICANT: Central Weld County Water District
REQUEST: A Site Specific Development Plan and Special Review Permit for a Major Facility of a Public
Utility (3,000,000 gallon water storage tank) in the A(Agricultural) zone district.
LEGAL DESCRIPTION: Part of the SW4 of Section 32, T4N, R65W of the 6th P.M., Weld County,
Colorado.
LOCATION: North of and adjacent to Weld County Road 38; approximately 300 feet east of Weld County
Road 39.
Chris Goranson stated this application is for a 3,000,000 gallon water storage tank with a gravel encasement.
John Zadel, Central Weld County Water District, explained the proposed tank is in line with the Districts
Master Plan and will service approximately 30,000 people in the eastern portion of the District. They need
to ensure they have adequate water storage/fire flow for the towns and rural areas they serve.
Tom Allman, Engineer, Central Weld County Water District, also explained their Master Plan showed the need
for additional storage primarily for emergencies(the last spring melt washed out the main line to the Tri-Town
area).
John Zadel asked why they were required to go through this particular process when the first application they
applied for in 1965, included two tanks. Chris Goranson explained that the tanks shown on the application
in 1965, showed two 750 gallon tanks. If the District had stayed with the 750 gallon tank this process would
not have been necessary. John Zadel commended Chris on his work ethic and professionalism.

APPLICANT: Greg Baker
REQUEST: A Site Specific Development Plan and a Special Review Permit for an outdoor recreational
facility (hunting, fishing, bird raising and dog trialing in the A(Agricultural) zone district.
LEGAL DESCRIPTION: Lot A of RE-134, located in part of the NW4 of Section 30, TSN, R67W of
the 6th P.M., Weld County, Colorado.
LOCATION: South of and adjacent to Weld County Road 54; east of and adjacent to Weld County Road
13.
Gloria Dunn stated the applicant wished to withdraw the trap/skeet portion from the application and expand
the hunting/fishing portion. The options given to the Planning Commission were to re-notify surrounding
property owners and re-post the legal notice or to go ahead and hear the application. She explained this use
would be a lesser impact and intensity and the Board of County Commissioners' notification would reflect
these changes. The Planning Commission decided to proceed. Gloria stated the application consisted of 149

acres, more or less. Little Thompson Water District supplies water, a vault system has been approved by the
Weld County Health Department until the clubhouse is built and supported by a septic system. The applicant
has the required licensing and there are no objections from surrounding property owners. The Department
of Planning Services is recommending approval of this application.
Tom Hellerich, Attorney, explained the applicant plans to continue to use this property in an agricultural
manner and expand the use to include recreational activities such as hunting and fishing. He stated there
is a definite need for this type of activity. They will have approximately 6,000 birds total during a 9 month
period and fishing available in the existing ponds. The use is compatible with surrounding areas. Mr. Baker
is working with the Federal Government on an easement program so the property cannot be used for any
other purposes. Waste generated on site will be used on existing pastureland. Verbal agreements have been
entered into with surrounding property owners for the retrieval of downed birds. Tom had concerns about
certain conditions of approval and development standards as follows: tree seeding program, hours of
operation, confined animal feeding regulations, screening processes, and noise level requirements.

Ann Garrison moved Case Number USR-1112, Greg Baker, be forwarded to the Board of County
Commissioners with changes to Condition of Approval#6a to#6, #6b&c renumbered to#7a&b, the deletion
of Development Standards#5 and 17, and changes to Development Standards#10 and 12.
6. A copy of an executed Warranty Easement Deed between the United States Department of
Agriculture Natural Resources Conservation Service and property owner or applicant shall be
provided to the Department of Planning Services when and if completed.
7. Prior to commencement of the Special Review activity:
a. A copy of the Colorado State Forestry Department tree planting plan for the site shall be
provided to the Department of Planning Services.
b. The applicant shall obtain the appropriate permits, as required by the Army Corps of
Engineers.
10. Hours of operation for hunting,fishing and field dog Waling associated with the Special Review permit
shall be restricted to daylight hours.
12. The facility shall comply with the Confined Animal Feeding Operations in Section 47 of the Weld
County Zoning Ordinance, as amended.
