The Weld County Department of Planning Services has determined that the temporary uses which you have proposed would not justify a mobile home for Accessory to Farm use in accordance with Section 43 of the Weld County Zoning Ordinance. The pertinent Sections of the Zoning Ordinance are as follows: Section 43.2.3.1.1 -"The MOBILE HOME will be occupied by persons principally employed at or engaged in the operation of the USE where the MOBILE HOME is located. ACCESSORY farm USE of the mobile home shall be established and revalidated on an annual basis as follows: Evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant(s) is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the MOBILE HOME for TEMPORARY ACCESSORY Farm USE." Section 43.2.3.4 - "All MOBILE HOMES as ACCESSORY farm USES are TEMPORARY. Allowance of the MOBILE HOME shall be extended only if the USE continues to be in conformance with the criteria set out in Section 43.2.3.1.1. The MOBILE HOME shall be removed from the property upon the cessation of the USE of the MOBILE HOME as an ACCESSORY farm USE or at any such time as the MOBILE HOME is used for other than the allowed USE." d oU t 990789 Letter - Plonka Page 2 The Weld County Board of Adjustment is the appropriate board to review a staff decision. Kirkmeyer, I am writing in regard to a request I have made to the Weld County Planning Department to place a mobile home on my property to have someone livein to work on my property this spring and summer. The planner I have been communicating with, Scott Ballstadt, has rejected my initial request and has left a message on my answering machine that he needs more documentation. and will then present it to the board for a decision. I wrote him a letter on March 2 , 1999 , and the reasons I gave are the following: I am a 63 year old single female who works full time as a registered nurse at the V A Medical Center in Denver. I live in my own home on 35 acres with a Warn, corral , arena, round pen, 5 horses, and a field of rye. I need someone here, at least temporarily during the year, to cut the rye, bale it, stack it in the barn, disc the soil ( sand) , plant additional seed, repair the stalls in the barn, put up fencing around the property, repair the round pen and the arena, and other work that comes up. I hope that you can see that I cannot keep up with all this work on my own. If you can be of some help to my getting this approved, I would appreciate it. The information you have provided is a great help. The fencing, barn and arena repair, as well as harvest of rye and planting of grass all are valid farm uses which may justify an Accessory to Farm mobile home. Staffs concerns are based upon continued justification in the future. Staff has concerns that once the repair and fencing is completed and the grass is planted, the mobile home will cease to be justified as Accessory to Farm Section 43.2.3.1.1 of the Weld County Zoning Ordinance states: "The MOBILE HOME will be occupied by persons principally employed at or engaged in the operation of the USE where the MOBILE HOME is located. ACCESSORY farm USE of the mobile home shall be established and revalidated on an annual basis as follows. Evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant(s) is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Department of Planning Services Failure to submit the required documentation may result in cessation of the allowance of the MOBILE HOME for TEMPORARY ACCESSORY Farm USE Your letter indicates that you can offer a "small salary", which indicates that the occupant of the mobile home will need to be principally employed off the farm. In accordance with Section 43.2.3 1 1 requires you to resubmit evidence every year to verify that the occupant of the mobile home is principally employed on the farm. Section 43.2.3.4 also states: "All MOBILE HOMES as ACCESSORY farm USES are TEMPORARY. Allowance of the MOBILE HOME shall be extender, the USE continues to be in conformance wiu i r,It. criteria set out in Section 432.3.1 1 The MOBILE HOME shall be removed from the property upon the cessation of the USE of the MOBILE HOME as an ACCESSORY farm USE or at any such time as the MOBILE HOME is used for other than the allowed USE." Letter to Mary Ann Plonka Page 2 Unfortunately, based upon the information provided, staff has determined that an Accessory to Farm mobile home is not justified. You will need to remove the mobile home from the property within sixty (60) days. If you wish to have the Weld County Board of Adjustment review this staff determination, I have enclosed a copy of the appropriate procedural guide and application. This application requires a $200.00 application fee. Should you accept the staff determination and remove the mobile home from the property, please call me or submit a letter requesting a refund of your$50.00 Certificate of Compliance fee.
