Enclosed please find submittal documents for an amendment to an existing "Use by Special
Review" for the 35th Avenue site located at 925 35th Avenue. The intention of this amendment
is to change the proposed location of facilities on site. The amended plan provides the area to
allow for a greater set back distance from 35th Avenue. The final reclamation plan and total area
to be mined are unchanged. The mine phasing has changed, and is still dependent on economic
factors of the area. The original approval for extraction at the site dates back to 1974. An
updated review that added hot mix asphalt production as an approved use was done in 1987. If

Amended Use By Special Review

1. Completed Application Form (See Appendix A)
2. Detailed Description of the Method of Mining Operation.
The property in question has already been permitted for concrete and asphalt plants as
well as aggregate processing plants. The concrete plant that will be on site will probably
be a dry batch plant as our plant at 25th Avenue, although a wet batch plant is a
possibility. The asphalt plant will be either a drum mix or a batch type plant. The plant
will have at least two silo storage capability. The differences in the types of concrete and
asphalt plants are mostly operational in nature. The visual characteristics are relatively
equal. The aggregate processing plants to be used on the site will be of the portable type.
The crusher will be on site most of the year, while a wash plant will spend 3-6 months per
year at the site. The wash plant will remain at a fixed location near the stockpile area.
The portable crusher may move with each phase or stay in fixed position near the wash
plant. If the crusher is in a fixed position, a conveyor system will be used to move raw
material from the mining area to the processing area. The processing of material may
involve temporary stockpiles in the dewatered mining area. A rail car off loading facility
with rail siding at the south portion of the property is also shown on the Extraction Plan
Map. A definite date for this improvement has not been established.
The site is anticipated to employ the same number of employees as our 25th Avenue
operation. At peak labor periods, 40 employees will be assigned to the location, working
one shift. A large portion of these employees are truck drivers and asphalt personnel that
are sporadically on site.
The mining operation will be a wet pit type.
There will be no use of county roads in the processing of aggregates. The finished
products will be distributed with in the site where they will be used a concrete or asphalt
aggregate or sold as other construction or landscaping materials. The only truck access to
the site will be from 35th Avenue approximately 1,800 feet north of F street.
The site is separated into eleven phases. Each phase is estimated to take one year to
complete. The phasing is approximate and changing economic conditions of the area may
cause the expected mining period to change.

The depth of the sand and gravel deposit varies. An average depth of overburden was
estimated at four feet and the average depth of sand and gravel was estimated at fifteen
feet.
The proposed use of the reclaimed land will be for a wildlife and nature area. The
reclamation process is concurrent with the mining at Western Mobile locations. New
reserves are exposed through stripping of topsoil and overburden. Mined areas are sloped
and topsoiled. Ponds are created in the mining process. The washing of aggregate also
generates silt. The silt is contained ether in holding ponds or discharged in a large pond.
The result is a wetland peninsula that is and attractive wildlife habitat. After the slopes of
the ponds are properly graded and the topsoil placed, the area is seeded with a blend of
native grasses. Our existing plans for reclamation, erosion control and landscaping, as
currently approved by a permit of the Mined Land Reclamation Division, will be adhered
to during and after the operations at this location.
The technical features of reclamation for this site come from various sources. The basic
reclamation plan is on file with the Colorado Mined Land Reclamation Division.
Through the mining process, topsoil is salvaged to assure adequate quantities for
reclamation. The slopes of ponds are graded to at least a 3:I for safety. The water
discharge from the site is monitored on a monthly basis. In the Fort Collins area Western
Mobile has worked with the National Biological Survey and Colorado State University in
reclamation to enhance wildlife habitat. Western Mobile has striven to apply the best
practices through experience and to try new ideas to enhance the quality of reclaimed
lands.

6. Consistency with the Weld County Comprehensive Plan

The proposed use is consistent with several aspects of the Weld County Comprehensive
Plan. Goal 1 of the commercial/mineral (CM) deposits section states "Conserve lands
which provide valuable natural mineral deposits for potential future use in accordance
with Colorado State Law." Goal 3 of the Natural resources CM section; "Minimize the
impacts of surface mining activities on surrounding land uses, roads and highways." The
proposed use is consistent with Goal 3 of the Natural Resources section of Wildlife Goals
and Policies that states "Traditional wildlife used such as hunting, trapping, and
fishing in agricultural and non-developed portions of Weld County are beneficial. Weld
County supports the maintenance of the wildlife uses." While the proposed use is
consistent with the goals of the Weld County Comprehensive plan, the most relative
statement to the move to amend our current Use by Special Review is policy statement
4.5. It states "where possible, that batch plants and processing equipment be buffered
from adjacent uses." This policy statement is on target with our amendment to change the
initial site plant for the parcel. By moving our processing plants back from the frontage
of the property it allows the opportunity to buffer the processing facilities and to create
and overall more attractive site.
7. Consistency with the intent of the district with which the use is located.
The existing uses and proposed uses are all consistent with the agricultural district in
which this site is located. It is the intent of the county to provide for these uses, by right
and by special review, to encourage the development of mineral resources within these
agricultural districts.
8. Efforts made to conserve productive agricultural land.
As stated in the previous special review for this parcel, our desire to operate at a site of
existing mining and processing helps to conserve productive agricultural land within the
agricultural zone district. Consideration was obviously given, during the approval
process, to our existing permit as to the then existing use and difficulty of farming rocky
pit area soils. Clearly, the cultivation, planting, maintenance and harvesting on these
thinly overburdened mineral deposits are not as productive as prime farm land. Our state
agencies have also addressed the importance of developing these land for these resources
when approving 34-1-304 CRS 1973 calling for the "Maximization of Extraction of
Commercial Deposits" in plans for extraction.
9. Adequate provision for the protection of the health, safety and welfare of
the inhabitants of the neighborhood and the County.
Western Mobile will continue to meet all current requirements of the appropriate health
and regulatory agencies. The processing facilities will be equipped with the appropriate
controls, accessories, and pollution equipment that will protect not only the safety, health
and welfare of our employees, customers and neighbors, but also the general public. The
incentive for amending our current Use by Special Review is to change the location of
proposed facilities to allow room for interior landscaping, lessen congestion along the
frontage of the property and to ultimately create a more visually pleasing location.

10. Compatibility with the existing surrounding land uses.
The existing mining and processing uses and the proposed type of use is compatible with
existing, surrounding uses and has been well established. There are two sites with
existing hot plants within a one mile radius of the site, due south on 35th Avenue and due
east on 25th Avenue. There are numerous sand and gravel operations in the area. The
site is bordered to the north, south and east by mining operations. The permitted use is
clearly consistent with established uses in the surrounding area.
11. Compatibility with future development of the surrounding area as
permitted by the existing zone and with future development as projected by
the comprehensive plan of the county or the adopted master plans of affected
municipalities.
The existing and proposed uses are compatible with the future development of the
surrounding area as permitted by the existing zoning and with future development as
projected by the Weld County Comprehensive Plan and the City of Greeley Master Plan
as they acknowledge the importance of mining and processing sand and gravel reserves
along the Cache La Poudre River.
12. Explanation of Use by Special Review area's location relative to flood
plain, geologic hazard, and Weld County Airport overlay district area: or
that the area complies with Section 50. Overlay District Regulations as
outlined in the Weld County Zoning Ordinance, as amended.
The site is adjacent to the Cache La Poudre River. It is with in the 100 and 500 year
flood plain designations. Western Mobile will comply with Section 50 or the appropriate
regulation as outlined in the Weld County Zoning Ordinance. The Change in the site plan
for which we are applying for the amended Use by Special Review will take the asphalt
and concrete plants out of the 100 year flood plain designation and place them in the 500
year area. The site is not in an airport overlay or geologic hazard district.
13. Proof that a water supply will be available that is adequate in terms of
quantity, quality, and dependability. (See Appendix E)
14. Copy of the deed or legal instrument identifying the applicant(s) interest
in the property under consideration. (See Appendix G)

15. A noise report documenting the methods to be utilized to meet the
applicable noise standards.
The noise levels at the site will be kept within applicable standards. Pending approval of
this amendment to our existing Use by Special Review, the plants and processing
facilities on site will be well within the interior of the property. The use of interior berms
will assist in noise reduction and visual screening of the equipment. The site will be a
one shift operation. Our processing equipment is subject to a preventative maintenance
program. This assists us in keeping equipment in good working condition.

supply plan for this pit is currently valid through January 1, 1993 and if it is not extended or if a court decree is not

immediately.
4) The average annual amount of ground water to be appropriated shall not exceed 99.01 acre-feet with the total
surface area of the proposed ground water pond limited to 90.6 acres of which 38.6 acres are limited to this plan
since they were exposed after December 31, 1980.
5) The owner shall mark the well (pond) in a conspicuous place with well permit number(s) and court case number(s)
as appropriate. The owner shall take necessary means and precautions to preserve these markings.
6) The use of ground water is limited to evaporation losses. No other use of water is allowed unless a permit therefor

Enclosed please find submittal documents for an amendment to an existing "Use by Special
Review" for the 35th Avenue site located at 925 35th Avenue. The intention of this amendment
is to change the proposed location of facilities on site. The amended plan provides the area to
allow for a greater set back distance from 35th Avenue. The final reclamation plan and total area
to be mined are unchanged. The mine phasing has changed, and is still dependent on economic
factors of the area. The original approval for extraction at the site dates back to 1974. An
updated review that added hot mix asphalt production as an approved use was done in 1987. If
