Re: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND FINAL PLAT SUBDIVISION, S#381-WEST
HILL-N-PARK FOURTH FILING
Specifically: NOW, THEREFORE, BE IT RESOLVED...FI.nal Plat...is, granted subject to
the following conditions:
5. The parks located in the Third and Fourth Fillings... shall be constructed.
As you may know Baessler Construction Company, Inc. is the exclusive builder of homes
in the 3rd. filing of West Hill-n-Park known as Arrowhead South. As the sales agents
for and representatives of Baessler Construction Company, Inc. we have a substantial
interest in seeing that the parks in said subdivision are constricted to meet public
park standards. In addition, the third filing covenants dictate that, at the
completion of park construction, the Arrowhead South home owners association will
maintain said parks. The home owners association will, therefore, also be assuming
the liability of said parks. Thus, the parks must meet certain quality, safety an
ADA standards.
In an effort to become better informed as to the afore mentioned standards we have
had several conversations with-Ron Williams parks superintendent and Steve Agerot
parks supervisor city of Greeley, Tom Hamblen city of Evans, Bob Churchich Churchich
Recreation playground consultant, EDAW park architect, several landscape companies,
and insurance carriers. In short, our findings indicate that building an insurable
park is a process that calls for a professional design and the professional
installation of approved park fixtures and landscaping.
WE also found _cut that the Arrowhead South homeowners association must show that the parks are of sufficient size as to prevent overcrowding which could _cause accidents.
Since the county has never insisted that West Hill-n-Park Inc. construct the parks in
earlier subdivision filings we are concerned the children now living in those areas
may create an overcrowding condition in the third filing parks.
Mr. Roy Lundvall has apparently-represented to the homeowners that the parks will not
have a sprinkler system and that watering will be done via a water truck. Again,
this creates not only an unmanageable park surface but according to park
professionals and insurance carriers such a surface is uninsurable.

We are bringing these matters to the attention of the county so that the required
park construction will be given due consideration. Issues including, but not limited
to, the planning, cost, insurability and maintainability of said parks as well as the
construction of parks in prior filings should not be understated. We do not think
that the county should take cash in leu of development from West Hill-n-Park Inc.
Nor should the county allow these parks to be developed to a standard less then that
of the cities of Greeley and Evans. Acceptance of the fourth filing should be
granted only after inspection of required parks by a person or persons who are
knowledgeable in this field.
