The Weld County Health Department has reviewed this proposal. Our staff have also observed the
proposed site.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water
will be provided by the North Weld County Water District and sewer will be provided by septic
systems. 'The preliminary plat map provided in the application designates two primary leachfield sites
on each lot, as well as a secondary leachfield site that can accommodate a replacement system. The
"draft" covenants also appear to adequately address our comments concerning preservation of the
secondary leachfield sites.
As you are aware, our Department has also reviewed the Sketch Plan and the Change of Zone for this
development. This application appears to be very similar to the Change of Zone application. Our
recommended conditions for this PUD final plan are as follows:
1) The east branch of the Challgren Lateral ditch shall be enclosed in pipe and relocated as shown in
the preliminary overall utility plan submitted as a part of the Change of Zone materials (approx.
200' to the east of its present location).
2) The development shall obtain water service from the North Weld County Water District.
3) A Weld County Septic Permit is required for each proposed septic system. Each system shall be
installed according to the Weld County Individual Sewage Disposal Regulations.
4) The "Right to Farm" covenant shall be placed on the plat.
5) In the event that 5 or more acres are disturbed during the construction and development of this
site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control
Division of the Colorado Department of Public Health and the Environment.
6) During development of the site, all land disturbance shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of the
Weld County Department of Public Health and Environment, a fugitive dust control plan must be
submitted.

development that disturbs more than 5 acres of land must incorporate all available and practical
methods which are technologically feasible and economically reasonable in order to minimize
dust emissions.
a) If]land development creates more than a 25 acre contiguous disturbance, or exceeds 6 months
in duration, the responsible party shall prepare a fugitive dust control plan, submit an air
pollution emissions notice, and apply for a permit from the Colorado Department of Public
Health and Environment.

Dear Mr. Patton:
The Town of Windsor Planning Commission has reviewed this request and recommends
approval of this PUD Final Plan subject to the following requirements:
1. The recreational trail shall be constructed to the Town's standards and shall provide
opportunities for future connection to the Town's trail system.
2. A street light shall be installed at the intersection of WCR 72 and Morning Star
Lane.
3. Additional right-of-way shall be dedicated along the entire length of the south
property boundary to bring the north half of WCR 72 up to the County arterial
standard of fifty feet(50')from centerline (one hundred feet (100') total ).
4. A water main shall be constructed between Lots 18 and 19 in Moriah Estates and
• shall be connected to the existing water main in Shiloh Estates for reinforcement of
the water supply for the two subdivisions.

RECOMMENDATION: Recommend approval of the PUD Final Plan to the Weld
County Department of Planning Services subject to all of the
conditions outlined below
DISCUSSION:
The applicant, James Scott, is requesting approval of a Planned Unit Development (PUD)
Final Plan in order to subdivide approximately 64.88 acres into twenty-four (24) estate
zoned lots to be served by individual septic systems.
The subject property is located within the Town's Growth Management Area and is
depicted as Very Low Density Single Family Residential on the Town's Land Use Plan
map. The Very Low Density Single Family Residential land use depiction provides for
single-family residential detached homes at very low densities, which, in the Estate
Residential (E) zone district, requires a minimum lot size of two and one-half (21/2) acres
when individual sewage disposal (septic)systems are authorized and approved by the Town.
Therefore, the proposed PUD Final Plan is not consistent with the Town's Estate Residential
zone district requirements. Based upon this inconsistency, the Town of Windsor Planning
Commission recommended denial of the Change of Zone application on January 15, 1999.
The Windsor Comprehensive Plan recognizes the one-mile grid system of County section
line roads as an arterial-type system for local circulation throughout the Town's planning
area and beyond. The Town's Circulation and Transportation Plan Map depicts Weld
County Road 72 as a Rural Major Collector which requires 120 minimum right-of-way. It is
staffs understanding that the Weld County Public Works Department recently conducted a
new traffic study on Weld County Road 72 and, due to increases in existing traffic counts, is
to be upgraded to Collector status.
As developments continue to occur in outlying areas surrounding the Town, it becomes
increasingly important for the Town and County to acquire the necessary right-of-way for
these arterial roads, particularly while there is only one property owner group. The Town
regularly requires dedication of additional right-of-way from developments which add to the
volume of traffic on adjacent roads, such as the creation of 24 new lots.

With the County's approval of the change of zone, it is apparent that the development will
probably occur, therefore, staff recommends that the Planning Commission recommend
approval of the PUD Final Plan proposal, subject to all of the following requirements:

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Planned Unit Development Standards. Our comments and requirements are as
follows:
COMMENTS:
As per my memo of January 14, 1999, all items have been addressed and completed to my satisfaction.
The applicant has provided an Improvements Agreement According Policy Regarding Collateral for Improvements
(Private Road Maintenance). The transportation portion includes street grading, street base, and street paving
as well as street signs and road culverts. All items have been checked and verified for unit costs. Weld County
Public Works has no conflict with the constructions costs.
REQUIREMENTS:
Improvements Agreement: The applicant shall provide the original signed document prior to scheduling time with
the Board of County Commissioners.
