RE: ACCEPT PORTION OF WELD COUNTY ROAD 102 FOR FULL MAINTENANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, LeRoy and Peggy Bellmore, 13480 Weld County Road 100, Nunn, Colorado
80648, have submitted a petition requesting Weld County accept a portion of Weld County 102
for full maintenance, and
WHEREAS, the Director of Public Works has informed the Board that a portion of Weld
County Road102, west of Weld County Road 17 for a distance of 3,960 feet, has been
completed and, upon inspection by his department, is found to satisfy Weld County standards
and is recommended for acceptance by Weld County for full maintenance, and
WHEREAS, acceptance of said road for full maintenance includes snow removal and
any necessary repairs, including the roadways, shoulders, or drainage ditches, and
WHEREAS, after review, the Board deems it advisable to accept said portion of Weld
County Road 102 for full maintenance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the portion of Weld County Road 102, west of Weld County Road 17 for
a distance of approximately 3,960 feet, be, and hereby is, accepted onto the Weld County Road
system for full maintenance by Weld County.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of December, A.D., 1998.

COLORADO
The construction has been completed on WCR 102 west of WCR 17 for a distance of 3,960
feet. I have personally inspected this portion of road per Section 20 of Ordinance 180,
and construction was completed as required.
I recommend that the Board of County Commissioners approve this portion of road for full
maintenance.

RE: Road Improvement
After visiting with Donald Carroll, Engineering Administrator, and receiving a copy of
Ordinance#180 from him, LeRoy and Peggy Bellmore have improved the road on the
south side of Section 20 as per road acceptance policy. The improvements begin at Road
17 and Road 102 continuing west on Road 102 a distance of approximately 3,960 feet.
The road is 24 feet wide with 2 inches of gravel that has been placed on the road during
the months of late June and early July. Also culverts were installed as needed.
We are asking that Jim Brewer, the Weld County Maintenance Construction Inspector,
inspect and verify that the proper material has been used. If all is acceptable, we are
requesting that Weld County accept and maintain the road.
This road has several exemptions located on the road and there are, as of now, two houses
utilizing the road, with one more to be built shortly.

The Board of County Commissioners of Weld County resolve that general weed control will be carried
out only along designated roadsides to increase motorist visibility at intersections and traffic control
signs, and prevent snow drifts along County roads.
The methods of weed control used by Weld County shall be by mowing or spraying herbicides.
Equipment in the Weed& Pest Division of Public Works will be used.
SECTION 18.0: TREES IN COUNTY RIGHTS-OF-WAY
Weld County has a duty to protect motorists by ensuring that tree overgrowth from overhanging
branches and dead trees do not create road hazards by obstructing visibility.
It shall be the policy of Weld County that when trees on private property begin to obstruct visibility on
County roads, the property owner shall be given notice to trim the trees within a reasonable time or the
County will do so and bill the property owner.
If a tree or branches from a tree on private property fall onto the County rights-of-way, the tree or tree
branches will be pushed back onto the private property by the County work force.
The County shall trim or remove all trees growing in the County-owned rights-of-way that obstruct
visibility for the safety of motorists at the County's expense.
SECTION 19.0: STRIPING OF COUNTY ROADS
Weld County's roads require certain striping, per the Manual on Uniform Traffic Control Devices.
Weld County has limited resources for Public Works operations and can only provide minimum
services.
Weld County may provide center or edge striping on arterial or collector roads when required to
enhance safety.
SECTION 20.0: ROAD ACCEPTANCE POLICY
—r Weld County does not maintain private roads,lanes or driveways. Before a public road can be accepted
by the Board of Weld County Commissioners for maintenance, the road must meet the following
minimum conditions:

20.I ' The road shall be surveyed to determine right-of-way lines.
20.2 The width of the right-of-way cannot be less than thirty (30) feet wide. The road shall serve a
minimum of three legal lots,two of which must have taxable improvements. Properties abutting
the intersection of the road under consideration for acceptance and an existing publicly-
maintained road do not count toward the required three lots.
20.3 The minimum road width shall be 18 feet or meet the minimum residential design for the
anticipated traffic. (See Appendix "E")
20.4 The road must be adequately graded and drained.
20.5 A minimum of two inches of crushed rock must tie provided on the traveled surface, or if
necessary, additional material may be required to support anticipated traffic loads.
20.6 The road cannot be fenced or gated, but if there are cattle in the area, a cattle guard can be
installed in accordance with the County cattle guard policy.
20.7 The benefitting parties will be responsible for the costs of all aspects of the project.
SECTION 21.0: VACATION OF COUNTY ROAD RIGHTS-OF-WAY
21.1 Owners of land adjacent to a County road,street,or alley rights-of-way which are shown as part
of an approved or recorded subdivision plat, map, or unincorporated community legally filed
prior to any regulations controlling subdivisions, may seek vacation only by means of an
application to re-subdivide pursuant to the Weld County Subdivision Ordinance which is
administered by the Department of Planning Services.
21.2 Owners of land adjacent to County road rights-of-way,other than those described in Section 20.1,
may seek vacation by petition to the Board of County Commissioners through the Clerk to the
Board, pursuant to C.R.S. 43-2-303.
SECTION 22: OBSTRUCTIONS LOCATED WITHIN
WELD COUNTY ROAD RIGHTS-OF-WAY
Weld County reserves the right to maintain its road rights-of-way without obstructions located thereon.
"Obstructions" include, but are not limited to, fences, trash cans, gates, and irrigation structures,
regardless of whether or not they are physically located on the travelled portion. Obstructions shall be
removed from the County road rights-of-way upon request by the Weld County Public Works
Department. The total expense of the removal of any obstruction from a County road right-of-way will
be paid by the person(s) who installed the obstruction, or by the person(s) exercising ownership or
control over the obstruction. In the event such person(s) do not remove the obstruction as requested,
