RE: APPROVE LAND RELEASE AGREEMENT AND AUTHORIZE CHAIR TO SIGN - CITY
OF GREELEY, AND GREELEY-WELD AIRPORT AUTHORITY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Land Release Agreement among the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, the Greeley-Weld County Airport Authority and the City of Greeley, with terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Land Release Agreement among the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, the Greeley-
Weld County Airport Authority, and the City of Greeley, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of December, A.D., 1998.

Please find attached three copies of an Land Release Agreement between the City,
County,Airport, and Federal Aviation Administration. This agreement is necessary in order
to release certain lands on the Greeley-Weld County Airport from their federal obligation
with the FAA. The land in question is that being leased back to the City of Greeley for use
as a Police Department firing range.
Your assistance in having acceptance of this document placed on the Commissioners
agenda at the earliest convenience is appreciated. I will need all three copies returned to
me after execution. I will return one copy to you after execution by the City and Airport
Authority.

Dear Mayor Nelson, Ms. Harberg, and Mr. Hall:
This is in response to Michael Reisman's request of April 21, 1998, on behalf of the City
of Greeley, Colorado, County of Weld, Colorado, and the Greeley-Weld County Airport
Authority, for release of certain land at the Greeley-Weld County Airport, from all the
restrictions and conditions of agreements with the U.S. Government.
Whereas, the City of Greeley and the County of Weld, Colorado, and the Greeley-Weld
County Airport Authority are recognized as co-sponsors of the Greeley-Weld County
Airport, and
Whereas, the City of Greeley, Colorado, presently, and in the foreseeable future, enjoys
the use of a particular parcel of land described as Parcel 1A on the enclosed Exhibit A,
said use being the City of Greeley, Colorado Police Firing Range, and
Whereas, said parcel also represents the outer portion of the runway protection zone for
Runway 34 at the Greeley-Weld County Airport,
Whereas, the City of Greeley, Colorado will retain control over the particular parcel in its
intended use,

We therefore, have determined that the particular parcel described as Parcel 1A on the
enclosed Exhibit "A" may be released from the terms and conditions of Grant
Agreements FAAP 9-05-011-801 thru 9-05-011-C805, ADAP 7-08-0028-01 thru 5-08-
0028-04, AIP 3-08-0028-01 thru 3-08-0028-08, which affects this land.
Except, the following provisions shall remain in effect in perpetuity for the parcel
described in the enclosed Exhibit "A":
a. That the Greeley-Weld County Airport Authority reserves unto
itself, its successors and assigns, for the use and benefit of the
public a right of flight for the passage of aircraft in the airspace
above the surface of the real property hereinafter described,
together with the right to cause in said airspace such noise as
may be inherent in the operation of aircraft, now known or
hereafter used, for navigation of or flight in said airspace, and
for use of said airspace for landing on, taking off from or
operating on Greeley-Weld County Airport.
b. The Greeley-Weld County Airport Authority expressly agrees
for itself, its successors and assigns to restrict the height of
structures, objects of natural growth arid other obstructions on
the hereinafter described real property to a height of not more
than 4665 feet above sea level.
c. That the Greeley-Weld County Airport Authority expressly
agrees for itself, its successors and assigns to prevent any use of
the hereinafter described real property which would interfere
with landing or taking off of aircraft at. the Greeley-Weld
County Airport, or otherwise constitute an airport hazard.
The Airport Layout Plan and the Exhibit "A" must be revised to reflect the new airport
boundaries.
This letter is being transmitted in duplicate. In the space below, please indicate your
acceptance of this Letter of Release by affixing your signature(s) thereto and returning
the original to our office.
