APPLICANT: Clifford Morgan and Patricia Mahoney
REQUEST: A Site Specific Development Plan and a Special Review permit for a boarding kennel
dogs/cats) in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Lot A of RE-435, part of the SW4 of Section 23, TSN, R66W of the 6th P.M.,
Weld County, Colorado.
LOCATION: East of and adjacent to 47th Avenue; approximately 1/2 mile south of Highway 34.
Keith Schuett, Department of Planning Services, asked that the case be continued to the May 16, 1995,
meeting due to lack of publication.
Judy Yamaguchi moved for the case to be continued. Curt Moore seconded the motion.

CASE NUMBER: USR-1078 -Continued from April 4, 1995
APPLICANT: Robert and Donna Connell
REQUEST: A Site Specific Development Plan and Special Review permit for a farm implement business
in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Lot B of RE-1666, located in the SE4 of Section 12, T7N, R66W of the 6th
P.M., Weld County, Colorado.
LOCATION: North and adjacent to State Highway 14 and approximately 1/4 mile west of Weld County
Road 37.
The applicant, Robert Connell, spoke in favor of the application. The applicant was in agreement with staff
recommendations.
The Acting Chairman asked if there was anyone in the audience who would like to speak for or against the
application.
10J- Melvin Diner,spoke against the application for surrounding property owner J.W. Hutchenson. He stated that

Mr. Hutchenson owns approximately 160 acres of irrigated land surrounding the Connell residence. Concerns
of the applicant included water rights, the stripping of the land, the danger of traffic coming on and off of
Highway 14 and other entry uses. Mr. Hutchenson also was concerned with how he has cleaned up around
his property, and feels this could be detrimental to his property.
Dale Hutzinger, spoke in favor of the application saying that Mr. Connell's property was kept up and felt that
there was not alot of traffic coming in and out.
Question from the board included concerns such as the size of equipment being sold and how long it was
stored if not sold,the turnover in equipment, and also felt that one access onto Highway 14 would be sufficient
and to close the east access to eliminate the traffic concerns.
Curt Moore moved that Case USR-1078 be forwarded to the Board of County Commissioners with the Planning
Commissions recommendation for approval. Marie Koolstra seconded the motion.
The Acting Chairman asked the secretary to poll the members of the Planning Commission for their decision.

CASE NUMBER: USR-1079- Continued from April 18, 1995
APPLICANT: Dwayne and Carol Bowen
REQUEST: A Site Specific Development Plan and a Special Review permit for a single family dwelling
located on a parcel of land less than the minimum lot size in the A (Agricultural) zone district.
LEGAL DESCRIPTION: SW4 of the SW4 of Section 2, TIN, R66W of the 6th P.M., Weld County, Colorado.
LOCATION: North of and adjacent to Weld County Road 12 and approximately 1/2 mile west of Weld
County Road 35.
Carol Bowen, applicant,spoke in favor of the application. Mrs. Bowen stated that they wanted to maintain the
agricultural land. They plan on placing some out buildings to be used for storage, horses, and equipment along
with a house.
The Acting Chairman asked if anyone in the audience wished to speak for or against the application. No one
wished to speak.
Curt Moore moved for Case USR-1079 be forwarded to the Board of County Commissioners with the Planning
Commissions recommendation for approval. Judy Yamaguchi seconded the motion.

CASE NUMBER: USR-1084
APPLICANT: High Plains Housing
REQUEST: A Site Specific Development Plan and a Special Review permit for migrant/farm labor housing
in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Part of the SE4 of the SW4 of Section 14, T4N, R66W of the 6th P.M., Weld County,
Colorado.
LOCATION: Approximately 1/4 mile east of Highway 85; north of and adjacent to Weld County Road
44.
Dewy Zabka, applicant,spoke in favor of the application. Mr.Zabka explained the problems of Migrant housing
and the need for the housing. He stated that there will be two 154 x 24 units with six two bedroom apartments
in each unit for a total of twelve apartments. They will be occupied in the months of March through October.

The Vice-Chairman asked if anyone in the audience wished to speak for or against the application.
Melvin Diner, representing surrounding property owners, spoke regarding concerns only.
They asked that at least a 6 foot fencing be placed around the property for safety purposes due to a railroad,
oil and gas production equipment, and an irrigation ditch. They also asked that the open ditch be either
covered or enclosed by a culvert. Mr. Diner asked that these issues be placed into the development
standards.
Bud Clemons moved that a Condition of Approval #5 be added as follows: Prior to recording, the Special
review permit plat shall be amended to show: (1) The facility perimeter shall be fenced with a minimum of a
five foot chain link fence, and (2) A minimum of forty feet of the concrete irrigation ditch at the entrance to the
facility shall be replaced with an enclosed culvert or an enclosed ditch.
Also for additions Developmental Standards #6 be added as follows: All structures and fencing shall be
maintained in good repair at all times and#7 to say a non-commercial junkyard as defined in the Weld County
Zoning Ordinance shall not be located on the property.

Bud Clemons moved for Developmental Standard#8 be added and subsequet renumbering, to say all existing
septic systems not currently permitted through Weld County will require an I.S.D.S. evaluation and all proposed
septic systems shall be designed by a Colorado Registered Professional Engineer according the Weld County
Zoning Ordinance.
