A regular meeting of the Weld County Planning Commission was held Tuesday, FebruarytabW999, in the
County Commissioners' Hearing Room (Room #101), Weld County Centennial Buildifl $,'t5.�.10th'Street,
Greeley, Colorado. The meeting was called to order by Chair, Marie Koolstra, at 1:30 p.m.

The summary of the last regular meeting of the Weld County Planning Commission held on February 2, 1999,
was changed to read Stephan Mokray was present.
Case Number: USR-1212
Applicant: Wiliam WillcuttsNVilliam Condon
Planner: Scott Ballstadt
Legal Description: Part of the E1/2 E1/2 of Section 19, T6N, R66W of the 6th PM
Request: A Site Specific Development Plan and a Special Review Permit for a private airstrip in the
Agricultural zone district
Location: North of and adjacent to WCR 66 &east of and adjacent to WCR 27
Scott Ballstadt, Department of Planning Services, presented Case USR-1212. Scott stated that staff is
recommending approval of the application along with the conditions of approval and development standards.
Scott then read the recommendation into the record.
William Willcutts, applicant, explained he is a pilot, and is away from home 15 days out of the month. He
stated his only intent for this airstrip is for private use only, and would prefer not to have any limitations on the
number of takeoffs and landings. Mr. Willcutts addressed the Division of Wildlife's concerns with the
wetlands. He explained only the safety areas are considered wetlands. The safety areas are only intended
to be used under rare circumstances, therefore the essential use of the ground will not change.
Michael Miller asked Mr. Willcutts if any grading will take place? Mr. Willcutts replied that the ground is flat,
although they will do some work in the middle of the runway. Mike then asked Mr. Willcutts if he is
comfortable with the proximity of the power lines? Mr.Willcutts answered that with the lines being parallel with
the airstrip, it won't be a problem at all. Mike also asked Mr. Willcutts if there will be any other structures he
will be putting up, such as a windsock? Mr.Willcutts said eventually a windsock will have to be installed, but
that would only entail an eight-foot pole. Mike then questioned if Mr. Willcutts will be storing any fuel for the
plane on the site? Mr. Willcutts stated the only fuel that will be stored on site will be for his tractors.
Fred Walker addressed his concerns with Development Standard#7, and staying within the 55 db range,with
the number being so low, if Mr. Willcutts were to buy a new plane, would he still meet this standard?
Mr.Willcutts explained that this airstrip was designed just perfect for single flight engineered planes, and that

is the only use it is intended for.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
The Chair Asked the applicant if he was in agreement with the changes to the Conditions of Approval and
Development Standards. Mr. Willcutts stated he was.
Stephen Mokray moved that Case USR-1212, be forwarded to the Board of County Commissioners along with
the Conditions of Approval and Development Standards with the Planning Commissions recommendation of
approval. Bryant Gimlin seconded the motion.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. Marie
Koolstra, yes; Arlan Marrs, yes; Cristie Nicklas, yes; Stephan Mokray, yes; Michael Miller, yes; Bryant
Gimlin, yes; Bruce Fitzgerald, yes; Fred Walker, yes. Motion carried unanimously.
Case Number: USR-1213
Applicant: Gary and Penny Naill
Planner: Ben Patton
Request: A Site Specific Development Plan and a Special Review Permit for a Bed and Breakfast
Facility in the Agricultural Zone
Legal Description: Sections 21 and 22, Township 11 North, Range 57 West
Location: Approximately two miles south of WCR 132; Approx. three miles west of SH 71
Ben Patton, Department of Planning Services, presented Case USR-1213. Ben stated that staff was
recommending approval of the application along with the conditions of approval and development standards.
Ben then read the recommendation into the record. Ben noted one change on the Conditions of Approval,
base information, which should reflect a USR area of 5.5 acres, rather than 1280.
Fred Walker asked regarding (Development Standard #10), if there will be separate septic systems for each
of the cabins or one septic for all three. Sheble McConnellogue, Health Department, answered that the
existing septic system out there now is failing. They have an engineered septic system that has been
approved by, and which will be attached to the bunk house. When the future bunk houses are built, they also
must be issued ISDS permits, perferably combining all three houses under one septic system.
Michael Miller asked Ben about the requirement for 25 parking spaces. Ben said that after a discussion with
Public Works, it was determined that the applicant can propose fewer numbers than that.
Cristie Nicklas asked what kind of landscaping the Department of Planning Services had asked the applicant
to provide. Ben replied that the Department of Planning Services is not asking the applicant to provide any
other kind of landscaping then what is already out there
Michael Miller asked Mrs. Naill, applicant, if she felt comfortable with the 25 parking spaces. Mrs. Neill
answered that they have plenty of room for 25 parking spaces.
The Chair asked if there was anyone in the audience who wished to speak for or against this application. No
one wished to speak.
The Chair Asked the applicant if she was in agreement with the changes to the Conditions of Approval and
Development Standards. Mrs. Neill stated she was.
Michael Miller moved that Case USR-1213, be forwarded to the Board of County Commissioners along with
the Conditions of Approval and Development Standards with the Planning Commissions recommendation of
approval. Stephan Mokray seconded the motion.

Case Number: Building Ordinance
Planner: Dave Sprague
Request: For the repealing and reenacting of the Weld County Building Code Ordinance 119. Many
changes relate to technical and terminology changes contained in recent code editions. The
intention is to adopt the 1997 Uniform Building Code, 1997 International Plumbing Code,
1997 Uniform Code for the Abatement of Dangerous Buildings, 1998 International
Mechanical Code and 1999 National Electric Code.
Dave Sprague, Building Official, presented the Weld County Building Code Ordinance 119. Dave explained
the purpose of changing the Weld County Building Ordinance 119, is to clean up grammatical errors,
duplicated paragraphs, and references to ordinances that no longer exist.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Steve Pierce, plumber, stated that the State of Colorado has adopted the 1997 Uniform Plumbing Code.
Therefore, he feels that the 1997 Uniform Plumbing Code Book is a better plumbing code book than the
International Plumbing Code Book. Mr. Pierce believed that the 1997 Uniform Plumbing Code is the best code
to protect the citizens, the instructors, the engineers, the contractors, and the mechanical people, because
it has been the code for numerous years. He talked about the confusion that will take place if every county
had their own plumbing code book and emphasized the importance of being uniform. Mr. Pierce explained
that the International code was written by building officials, and would cost the average plumber$600.00. Mr.
Pierce then asked if it is possible to adopt a lesser code book?
Bruce Barker, County Attorney, stated he would need to know what the Colorado Plumbing Code includes,
he believes it would be based on the Uniform Plumbing code, and then he would need to determine if the
International Plumbing Code is a lesser code. He explains that he will need to find out what the minimum
Colorado State Code is, and then compare the International Plumbing Code to make sure it meets the
minimum State Code. Current Clolrado law requires that adopted codes and ammendment to the codes not
be any less restrictive than what the State of Colorado has already adopted.
Michael Miller asked Mr. Pierce if there is any specific area of this code that can be related to endangering
the safety of the public? Mr. Pierce replied that the International Plumbing Code allows products that the State
Board feels•can jeopardize safety and health. The International Plumbing Code lets the public find out if a
product is a good or bad, and if the product proves to be bad, then they'll remove it. Whereas the Uniform
Building Code makes products meet specific standards.
Larry Frank, Licensed Plumber, stated that by adopting the International codes, the difference will cause
confusion and lack of productivity.
Marie Koolstra asked Dave if the International Code Book is equal to the minimal requirements set by the
Colorado State Plumbing Code? Dave explained that the methods used in the International Plumbing Code,
are methods used for many years. The International Plumbing Code Book just offers many alternative choices
which have been tested by different approved agencies. The two books actually cost about the same, there's
only $1.75 difference. Although there is a possibility of confusion.
Stephen Mokray asked Dave why he would chose to be different than the state code? Dave replied that the
main intention of adopting the International Plumbing Code Book is to try to provide uniformity. Stephan asked
Dave if both books can be interpreted the same way. Dave answered even though there are some
differences, both books are based on the same standards. Stephan questioned the possibility of confusion
when all the counties are adopting different codes? Dave said there could be some confusion, but the
differences are not major.
Marie Koolstra asked Dave what the main difference is between the two books? Dave explained that the
Uniform Plumbing code book has been around for a while, and he believed it is the book the plumbers use
when they test for their journeymen master test. Stephan then asked Dave why he chose the International
Plumbing code book when the plumbers are tested on the uniform plumbing code? Dave answered that the
International Plumbing Code book was written to be used by everyone. It will make it less complex if everyone
from every state used the same code book, that is the intent of the International code book. Marie Koolstra
asked Dave if we were one of the few state that haven't adopted the code book yet? Dave said no, many
jurisdictions are beginning to make the move to adopt it. Stephan then asked how often does the state
approves of a new plumbing Code? Mr. Pierce answered every three years. Fred Walker asked which book
the surrounding counties are using? Dave implied he wasn't sure, but he was aware of 24 jurisdictions
around Weld County that have adopted the code and many other counties are in the process of changing to
the International code.
Fred Walker moved that Building Ordinance 119, be forwarded to the Board of County Commissioners with
no recommendation. Arlan Marrs seconded the motion.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. Marie
Koolstra, no; Arlan Marrs, yes; Cristie Nicklas, no; Stephan Mokray, no; Michael Miller, no; Bryant Gimlin,
no; Bruce Fitzgerald, yes; Fred Walker, yes. Motion carried.
Bryant Gimlin moved that Building Ordinance 119, be forwarded to the Board of County Commissioners along
with the Conditions of Approval and Development Standards with the Planning Commissions recommendation
of approval with the recommendation to bring in expert testimony with respect to the International Plumbing
Code vs Uniform Plumbing Code. Stephan Mokray seconded the motion.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. Marie
Koolstra, yes; Arlan Marrs, yes; Cristie Nicklas, yes; Stephan Mokray, yes; Michael Miller, yes; Bryant
