The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations.
2. Prior to recording the plat,the applicant shall:
A. The following note shall be placed on the plat: All proposed or existing structures will or do meet the
minimum setback and offset requirements for the zone district in which the property is lncat

B. All accesses shall be clearly shown on the plat.
C. The following note shall be placed on the plat: Both Lots A and B are subject to the time change for
applying for a new recorded exemption as described in Section 11.12 of the Weld County Subdivision
Ordinance.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office
of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

Dear Monica:
Enclosed are the Applications of Donald M. Schoenleber and Norma L. Schoenleber for
Amendments of Subdivision Exemption No. 100 and Recorded Exemption No. 866.
I am enclosing two colored maps which show the present ownership of the E1/2SEV4 of
Section 3, Township 5 North, Range 64 West, and the proposed ownership which would result
from the Amendments.
The SE shown in yellow on the maps, is presently owned by Michael W. Ryan. Lot A of
RE 866, shown in pink on the maps, is owned by Donald M. Schoenleber, Jr. and Kelly S.
Schoenleber. Lot B of Recorded Exemption 866, shown in green stripe on the maps, is owned
by Donald M. Schoenleber, Sr. and Norma L. Schoenleber. All three of the parcels have
dwellings on them, and no new lots or building sites will be created. All residences are presently
served by functioning and adequate septic tank disposal systems, and by North Weld County
Water District.
The purpose of the Subdivision Exemption Amendment is to correct an existing problem.
The 2.5 acre parcel shown on the present ownership map with orange diagonal lines was surveyed
by Jasper Freese, and a plat of the survey was recorded on November 10, 1992 in Book 1356 as
Reception No. 2310444 of the Weld County Records. The intent of the parties at that time was
for the Shoenlebers to convey that parcel to Mr. Ryan, although no application for amendment
of the subdivision exemption or any other kind of application was submitted to the County for

approval of the change. No conveyance of the parcel has been made by the Schoenlebers to Ryan,
although a deed of trust from Ryan to the Schoenlebers was recorded in December 1992 , and
released in 1994. Ryan has paid the Schoenlebers for the land, and Ryan has fenced in the land
to include it as a part of the SE. The Amendment would expand SE 100 to include the parcel so
that it can be conveyed to Ryan.
The purpose of the Recorded Exemption is to take 23 acres from Lot B and add it to Lot
A, creating a Lot A consisting of 25 acres, and a Lot B containing 50 acres. The 23 acres to be
added to Lot A is rough, unproductive alkali seep ground that contains a low area and numerous
pot holes. It cannot be irrigated, and can be used only to allow livestock to graze on whatever
grass and weeds may grow. The land remaining with Lot B is good (but not prime) agricultural
land containing approximately 25 acres of irrigated pasture and 20 acres of irrigated alfalfa. All
of the irrigation water (35 shares of Briscoe Irrigation Company) will be allocated to Lot B.
Lots A & B make up most of the E'/zSEVI of Section 3, Township 5 North, Range 64
West. The El and the W' of this EV2SE1/4 were obtained by Donald and Norma Schoenleber
as separate parcels at different times. They were combined for the purpose of creating Recorded
Exemption 866, but continue to be assessed and taxed separately.
Lot A is presently a 2 acre parcel of land owned by Donald M. Schoenleber, Jr. and Kelly
Schoenleber, the son and daughter-in-law of Donald M. Schoenleber and Norma L. Schoenleber.
The addition of the 23 acres of marginal land to Lot A will allow the owners of Lot A to keep a
few head of livestock. All of the productive land is being kept as part of Lot B. Lot A is
presently a rural residence, and that use will remain. Lot B is presently a rural residence with
irrigated pasture and approximately 20 acres of irrigated crop land which is used to grow alfalfa.
These uses will also continue unchanged.
The proposed Amendments are consistent with existing surrounding land uses, which are
all rural residences and farming. The proposed Amendments are consistent with orderly and
efficient development because they do not create a new lots or building sites, and impose no
additional burdens on any county services. They preserve the farmable land intact with all of the
irrigation water, and merely transfer parcels of marginal land from one lot to another.
Our check in the amount of$360.00 in payment of the filing fees for these Amendments
is enclosed.
