RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ARTHUR AND JUANITA LARSON AND HAROLD AND LINDA
ENDSTROM FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Arthur and Juanita Larson and Harold and Linda Endstrom, VI #9600315, are
allegedly in violation of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of September, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Linda Endstrom, tenant, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until December 9, 1997, to allow adequate time for the property owners
and tenants to remove or screen the noncommercial junkyard on the subject property and secure
appropriate permits to bring the subject property into compliance and for an inspection of the
property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Arthur and Juanita Larson and Harold and Linda Endstrom to
remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties, with an instruction for delay of action upon such referral until
December 9, 1997, to allow adequate time for the property owners and tenants to bring the
subject property into compliance.

The noncommercial junkyard is still located on the property and it does appear that someone is
living in a camper on the property, therefore is a violation of Sections 31.2, 31.2.16, 31.3.9 and 43
of the Weld County Zoning Ordinance. To bring the property into compliance the noncommercial
junkyard must be removed from the property or screened from all adjacent properties and public
rights of way and the camper cannot be used for any overnight or temporary housing or the
appropriate permits must be obtained.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have
scheduled a meeting with the Board of County Commissioners on September 9, 1997 at 10:00 a.m.
to consider the violations occurring on the property. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street,
Greeley,Colorado. It is recommended that you or a representative be in attendance to answer any
questions the Board of County Commissioners might have about the violations.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation.

The uses on the above described property are being considered as a zoning violation of Section 31.2 and
31.3.9 of the Weld County Zoning Ordinance. This is not a use allowed by right in the Agricultural zone
district.
There is a noncommercial junkyard located on the property consisting of derelict vehicles,appliances,
used building materials and lots of debris and miscellaneous junk. The violation can be corrected by
removing the noncommercial junkyard from the property or screening it from all adjacent properties and
public rights of way. If screening is to be used to conceal the noncommercial junkyard,a detailed
screening plan must be submitted to and approved by the Department of Planning Services prior to
installation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have six(6)
months from January 30, 1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
of any assistance in clarifying or answering questions concerning this matter.Please call or write the
Department of Planning Services' office.

2. Recitals.Assignor desires to further secure,and the bank bus required as additional and further
security for the payment of the Obligations.an assignment of the leases of all or any portion of the
Property and the rents.profits and income from the Properly in the event of default in the payment of the
Obligations or default in the performance of the terms.conditions and obligations to be performed by
Assignor contained in the Note or the Deed of Trust.
3. Assignment.As further consideration for the sums advanced and to be advanced to it under the
Note,and for other good and valuable consideration(the receipt and sufficiency of which are hereby
acknowledged),Assignor hereby assigns,transfers and sets over to the Bank all of its right,title and
interest in any leases now existing or hereafter entered into on the Froperty or any part thereof and the
rents,profits and income derived from the Properly,with full and complete authority and right in the
Bank in case of default in the payment of Obligations,or the failure to comply with any of the terms and
conditions contained in the Note or the Deed of Trust,to:(a)demand,collect,receive and receipt for
such rents,profits and income;(b)take possession of the Property,the buildings and improvements
thereon and any personal property belonging to Assignor situated therein without having a receiver
appointed therefor;(c)rent and manage the Property and make alterations,renovations and repairs to
the Property:(d)aoply the proceeds of such rents,income and profits from the Property to pay the
expense of managing,renting,altering,renovating and repairing the Property,including reasonable
compensation for the agents or representatives of the Bank;(e)pay all taxes,assessments and
insurance premiums with respect to the Property as they become due:(f)apply for and obtain,exparte
and without notice,the appointment of a temporary receiver and after notice,the appointment of the

permanent receiver for the Property or of the rents,issues and profits thereof or both,and to have such
receivers appointed as a matter of right without regard to the solvency of any person or the adequacy of
any security or the existence of waste,and to have sums received by such receivers after deducting
and paying costs and expenses of such receiverships,including attorney's fees of the Bank.applied to •
the Obligations in such manner and order as the Bank may request;and(g)apply the balance of such
proceeds to sums due under the Note and the Deed of Trust and then to any other Obligations.
4. Release.A release of the Deed of Trust shall automatically release this Assignment of Leases and
Rents,and the curing of any default under the Obligations and the Deed of Trust in accordance with
their terms shall stay the application of this Assignment of Leases and Rents until subsequent default,if
any.
5. General.(a)No failure of the Bank to avail itself of any of the terms and conditions of this
Assignment of Leases and Rents for any period of time shall be construed to be a waiver of any of its •
rights hereunder;and the Bank shall have the full right and authority to enforce this Assignment of •
Leases and Rents,or any of its terms,at any time or times that the Bank shall deem fit.(b)Assignor
hereby expressly waives the Bank's written acceptance of this Assignment of Leases and Rents.(c)My
• consent notice or other communication required or contemplated by this Assignment of Leases and
Rents shall be in writing.If intended for Assignor,it shall be deemed given if mailed,postage prepaid to
Asssignor at the address given on the front page of this Assignment of Leases and Rents or at such
other address given by notice as herein provided.If intended for the Bank,it shall be deemed given only
if actually received by the Bank.(d)This Assignment of Leases and Rents shall be governed by the laws
