The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat,the applicant shall:
A. The following note shall be placed on the plat: All proposed or existing structures will or do meet the
minimum setback and offset requirements for the zone district in which the property is located.
B. All access shall be clearly shown on the plat.

3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office
of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60)days
from the date of approval by the Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

Dear Mr. Levy,
In response to your inquiry as to the determination of the north line of the
proposed Amended Recorded Exemption No. 1311-3-2-RE722, Weld County,
Colorado, I offer the following.
Recorded Exemption No. 1311-03-2-RE1576, (Book 1436, Reception No.
02382930, of April 11, 1994) showed a dimension of 815.98 feet south along
the West line of Section 3, T3N, R67W to it's Southwest corner. Similarly, the
East line of said RE No. 1311-03-2-RE1576 shows a dimension of 805.60 feet.
The southern terminus of said west line was monumented with an accepted
survey marker as well as a newly constructed fence line being along the
purported south line of said RE No. 1311-03-2-RE1576.
To determine the location of the older fence line and concurrent established line
of occupation of the north line of RE No. 1311-03-2-RE722, the adjoiner to the
south line of RE No. 1311-03-2-RE1576, I field measured 116.5 feet along the
said west line of RE No. 1311-03-2-RE 722/1576 and 108.4 feet along the said
east line, "old fence" to "new fence". Allowing for bearing convergence, this
generated the dimensions as shown on the proposed Amended RE No. 1311-03-2-
RE1576 & proposed Amended RE No. 1311-03-2-RE722.

This is a follow-up to my letter dated February 23, 1998. Enclosed please find
copies of the following:
1. Letter of November 17, 1997 from this office to Weld County Department of
Planning Services delivering the signed mylars, asking Department of
Planning Services to review and approve the mylars and to not record the
mylars until we authorized the recording.

2. Telephone message dated December 4, 1997 which is a phone message
from Shani Eastin at Weld County Department Planning Services informing
us that the mylars have been approved.
3. Letter dated December 22, 1997, including mylar recording fee and
instructing the Department to record the plats.
4. Copy of check dated December 18th (front and back) showing that the check
was deposited by Weld County on December 31, 1997.
5. Copy of telephone message of February 20, 1998 to this office from Shani
at the Department of Planning Services informing us of Diller letter and also
advising us that the mylars had not been recorded.
I then followed up the February 20, 1998 telephone message from Shani with a call
to Shani on February 23, 1998. At that time I was informed that the Department of Planning
Services had, for unknown reasons, failed to record the mylars despite the fact that they
had received my check and letter dated December 22, 1997. Needless to say, the mylar
should have been recorded the last week of December as we gave instructions to record
the mylar and the County deposited the recording fee check.
Nevertheless, even if the mylars had been recorded, the mylars would now have to
be corrected based upon the claim by the Department of Planning Services that the survey
and mylars are in error. This merely confirms my statement of February 23, 1998 that the
alleged survey error and mylars must be resolved between the Weld County Department
of Planning Services and Bob Cumow.
As this is an issue between Weld County and Mr. Cumow, I can only urge all of you
to immediately communicate and correct the error. For purposes of convenience I am

Enclosed please find a copy of a letter that has been received by the Weld County
Department of Planning Services. In effect, Mr Diller is claiming that the surveys for the two
Amended Recorded Exemptions are in error. Due to the alleged surveying errors, the Weld
County Planning Department has not yet recorded the mylar plats.
This is not a legal problem. The alleged survey error or problem must be resolved
between the Weld County Department of Planning Services and Bob Curnow who
performed the survey and prepared the plats. It is necessary that this survey issue be
resolved between Mr. Curnow and Shani Eastin at the Department of Planning Services.
Please immediately contact Mr. Cumow so that he can contact Shani Eastin at (970) 353-
6100, Extension 3540 to resolve the issues. As a courtesy to you, I am sending a copy of

Please beware of my concern regarding amended recorded exemption
No. 1311-3-2-RE722. My concern is that part of the legal description of Lot B
which refers to a survey pin LS2152.
Survey pin LS 2152 is not on a partial section line. Lot B historically has had a
northern boundary referred to as the north line, of the south one half, of the northwest
one-quarter of the northwest one-quarter.
Quit claim Deed reception number 02312379 dated November 13, 1992 makes this
reference in the legal description of Lot B.
Recorded exemption No. 1311-03-2-Re1576 Rec. No. 02382930 establishes the
south boundary of Lot B as the north line of the south one half of the northwest one
quarter, of the northwest one quarter of section 3. This is the north boundary of Lot B on
amended recorded exemption No. 1311-3-2-Re722.
I am concerned that property lines are being moved improperly by these amended
recorded exemptions as they relate to my property which is the East one half of the North
one half of the Northwest one quarter of the Northwest one quarter of section 3 township
2 North, range 67 West of the 6th P.M.

When the above Amended Recorded Exemptions were approved by Staff a 60 day
time limit was established for completion and submission of the plats. I have been advised
by the engineer working on the project, Bob Curnow, that due to his time schedules as well
as the complicated nature of the two plats, he will not have the plats completed by
September 15. Therefore, the purpose of this letter is to request an extension until October
17, 1997 to complete and submit the plats for review. Mr. Cumow advises me that he may
be able to finish the plats prior to that date and they will be submitted to you as soon as
they are complete. If you have any questions or comments concerning this extension,

RECORDED EXEMPTION QUESTIONNAIRE
1. WATER SUPPLY STATEMENT. See letter from Central Weld County Water
District.
2. ADEQUATE MEANS FOR DISPOSAL OF SEWAGE. The Weld County
Department of Health has approved and issued permits for both existing lots. The
lots are served by a septic tank and leach line disposal system.
3. A DESCRIPTION OF HOW THE PROPERTY IS BEING USED. Both properties are
rural residential and ag use. Both parcels have outbuildings and the outbuildings
are used for livestock such as horses and chickens. Both parcels are irrigated with
water from the Coal Ridge Ditch.
4. REASON FOR THE PROPOSED RECORDED EXEMPTION. Both lots will
maintain existing uses. This Amended Recorded Exemption is being requested to
correct a boundary line dispute with the property owner to the North (property is
known as Lot"B" of RE 1576). There will be no changes in any uses for any of the
lots.
5. DESCRIPTION OF LOCATION AND USE OF LOT. No new lots are being created.
Lots "A" and "B" of Recorded Exemption No. 722 will increase in size approximately
one-half acre each.
6. NOTE LANGUAGE TO BE PLACED ON PLAT. The note language will be placed
on the Amended Recorded Exemption plat.
7. A STATEMENT EXPLAINING THE PROPOSAL IS CONSISTENT WITH
MUNICIPAL PLAN. As the lots are currently existing, an increase in size by less
than one acre each is consistent with existing municipal plans involving the area.
8. A STATEMENT EXPLAINING HOW THE USE IS COMPATIBLE WITH EXISTING
SURROUNDING LAND USES. No new uses of land are proposed. The existing
uses will remain exactly the same. Surrounding land uses are rural residential and
agricultural.
9. A STATEMENT EXPLAINING THE PROPOSAL IS CONSISTENT WITH THE
INTENT OF THE DISTRICT. Both lots are located in the ag zone district. Both lots
are currently used as rural residential and agricultural. No change of any type will
take place other than to slightly increase the size of both Lots "A" and "B".

= THIS DEED, made January 3 1990, between Ms. Anne Nye,
Public Trustee of the County of Weld, State of Colorado and
cc Colonial National Bank, at 10085 Carroll Canyon Road, San Diego,
California 92131, Purchaser WITNESSETH:
WHEREAS, Walter Souza and Anne K. Souza did, by Deed of Trust
dated January 9. 1986, and recorded in the office of the Clerk and
Recorder, of the County of Weld, State of Colorado on January 13,
1966 in Book 1099 on Film 0199 as Reception No. 02038987, convey to
the Public Trustee in Trust the property hereinafter described to
secure the payment of the indebtedness provided in said Deed of
Trust: and
WHEREAS, violation having been made in certain of the terms
and covenants of said Deed of Trust as shown by the Notice of
Election And Demand For Sale filed with the Public Trustee, copy
thereof being recorded in the office of said County Clerk and
Recorder, the said property was advertised for sale at public
auction at the place and in the manner provided by law and by said
Deed of Trust and a copy of the Notice of Sale was in apt time
mailed to the persons required by statute, and said property was in
pursuance of said notice sold to Colonial National Bank for the sum
hereinafter set forth and a Certificate Of Purchase thereof was
made and recorded and said property not having redeemed from said
sale;
NOW THEREFORE, the Public Trustee pursuant to the power and
authority vested in him/her by law and by the said Deed of Trust as
such Public Trustee and in consideration of the sum of $101,506-28
to the Public Trustee paid by the said Purchaser, the receipt
whereof is hereby acknowledged, conveys to the said Purchaser,
their successors and assigns forever all the right, title and
interest which the Public Trustee acquired pursuant to said Deed of
Trust in and to the following described property situated in the
County of Weld, State of Colorado, to wit:

this reference
To have and to hold the same unto the said Purchaser, their
successors and assigns forever.
