DOCKET NO. 97-09
RE: SITE SPECIFIC DEVELOPMENT PLAN AND RESUBDIVISION, S #413, FOR THE
PURPOSE OF DIVIDING A 2.11-ACRE LOT IN THE ETHERTON SUBDIVISION -
VETRONE
A public hearing was conducted on January 22, 1997, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 6, 1997, and duly published January 9,
1997, in the South Weld Sun, a public hearing was conducted to consider the request of A. Michael
and Rosemary A. Vetrone for a Site Specific Development Plan and Resubdivision, S#413, for the
purpose of dividing a 2.11-acre lot in the Etherton Subdivision. Lee Morrison, Assistant County
Attorney, made this a matter of record. Chris Goranson, Department of Planning Services
representative, presented a brief summary of the proposal and reminded the Board of a work
session in November 1996, at which the requirement for public sewer was waived. He stated the
existing 2.11-acre lot is proposed to be split into a 1.36-acre lot and a 0.75-acre lot. Mr. Goranson
then entered the favorable recommendation of the Planning staff into the record. A. Michael
Vetrone, applicant, was present and stated he wants to subdivide the lot because it is too large for
a residential lot, but too small for an agricultural lot, and they intend to build a new house. He
referenced Condition of Approval #1.B. requiring he move the concrete divider box currently in the
middle of Bluebell Avenue onto his property and clarified he is not served by it nor is he sure who
owns it. Don Carroll, Public Works Department, explained during his site inspection he observed
a small concrete splitter box with a culvert, which is a hazard and should be moved off Weld County
right-of-way, and assumed Mr. Vetrone used the water. Commissioner Hall suggested staff find
out who owns and uses the water. Mr. Vetrone stated he uses Greeley Irrigation. Commissioner
Harbert suggested Condition of Approval #1.B. be deleted and staff negotiate with the owner

concerning relocation. Mr. Carroll confirmed Bluebell Avenue is on the Weld County road system.
Mr. Vetrone agreed the box is dangerous and voiced concern regarding Condition of Approval
#1.C. concerning compliance with the Fire Prevention Bureau, Greeley Fire Department. He
explained the Fire Department requires sprinkler systems in new homes and he is very concerned
about the cost. Mr. Goranson explained the Fire Prevention Bureau recommends new properties
in subdivisions meet urban standards. Commissioner Kirkmeyer clarified the Condition states: "The
applicant shall attempt to comply with the requirements . . .". Mr. Vetrone stated he has tried to
work with the Fire Department, and Mr. Morrison explained it is the intent of the Fire Code to install
a sprinkler system; however, one is not required and the issue is a matter of interpretation. He
further explained the sprinkler system is recommended as an alternative to a hydrant; however,
there are other alternatives such as smoke alarms in each room, etc. Mr. Vetrone stated the cost
for a sprinkler system is $1.85 to $3.00 per square foot, excluding the costs for wiring, electrician,
etc., and the cost is not justified. Commissioner Baxter reiterated the applicant is required to only
attempt to comply, and Commissioner Hall suggested the condition be removed or required.
Responding to questions from the Board, Mr. Vetrone stated he cannot hookup to sewer at this
time; however, when the City of Greeley annexes the area, he assumes sewer will be available.
Mr. Morrison explained if a septic system fails, a new permit is required unless city sewer is within
400 feet. He also noted cities can do local improvement districts and assess costs to install sewer,
and the switch from septic to sewer system could be forestalled. Mr. Vetrone confirmed he realizes
the septic system is temporary; however, 3/4 of an acre is adequate room to redo the leach field.
Jeff Stoll, Health Department, confirmed there is adequate space for repair and stated a plot plan,
which is informal but represents a commitment from the applicant, has been provided. Mr.
Morrison noted future maintenance cannot be prohibited by future construction and suggested a
replacement leach field envelope be included on the plat to preserve the area, indicating a plot plan
is not binding enough. Mr. Vetrone concurred, and Mr. Morrison suggested proposed language
for Condition of Approval#1.D. Mr. Vetrone confirmed for Commissioner Kirkmeyer that the divider
box is the only hazard of which he is aware, and that only one new driveway would be added for
the new lot. Mr. Carroll recommended one access per legal parcel to be upgraded and widened
with gravel to the access point. He clarified the applicant may retain the existing access to the
smaller lot and one new access will be granted to the larger lot. Mr. Carroll also confirmed he will
draft a letter requesting removal of the box from the Weld County right-of-way. Further discussion
ensued, but no public testimony was offered concerning this matter. Commissioner Harbert moved
to approve the request of A. Michael and Rosemary A. Vetrone for a Site Specific Development
Plan and Resubdivision, S #413, for the purpose of dividing a 2.11-acre lot in the Etherton
Subdivision, based on the recommendation of the Department of Planning Services staff, with the
Conditions of Approval as entered into the record, including the following: delete Conditions of
Approval #1.B. and #1.C., renumber #1.D. to #1.8. to which the language concerning the
replacement leach field envelope will be added, and add #1.C. allowing only one access per legal
lot. Commissioner Kirkmeyer seconded the motion, and Mr. Carroll clarified the applicants should
be allowed to retain the existing circle drive, but only one access is allowed on the new lot.
Commissioners Harbert and Kirkmeyer agreed to so amend the motion,which carried unanimously.
