To Whom It May Conern:
William and Margaret Kobobel, doing business as Idaho Creek Gravel Company, are
applying for Use by Special Review permit for a sand and gravel operation. This letter
will supply the narrative segment of the application requirements. This letter is formatted
in the same numerical order as the procedural guide for the application submittal
requirements.
1. The completed application form along with the application fee of$1,455 is attached.
2. A detailed description of the method of mining operation is as follows:
a. The types and numbers of equipment and facilities can be found in Exhibit D of
the DMG permit application.
b. The maximum number of employees will be five. The number of shifts will be
one, which will operate Monday through Friday.
c. The operation will be a dry pit.
d. All trucks will exit the property onto Weld County Road 201/2 and proceed east to
Weld County Road 7. The primary haul route will be from Weld County Road 7
north to State Highway 119.
e. The special use permit boundary includes approximately 80 acres, of which 26
acres will be mined. There will be only one mining phase. Mining will begin in
the east central area of the property, as shown on Exhibit C of the Division of
Minerals and Geology (DMG) application, and will then proceed in a
southwestern and northeasterly direction from the mining entry.

f. The duration of the mining operation will be four (4)to six (6) years, depending
on market demand. It is expected that the operator will excavate approximately
five (5) acres per year. This mining operation is intended to be a continuous
operation with no significant cessation in mining. It is hoped that mining will be
complete at the end of the year 2005.
g. Sand and gravel deposit depth and thickness vary from six (6)to 12 feet. The
overburden and topsoil vary in thickness from four(4)to nine (9) feet.
h. Proposed use of the reclaimed land is pasture lands with potential for residential
development. A full explanation of the reclamation process is described in
Exhibit E of the DMG permit.
i. Technical advice from the Soil Conservation Service and Tuttle Applegate, Inc.,
was used to develop the Reclamation Plan.
3. A list of the names, addresses and the corresponding parcel identification numbers
assigned by the Weld County Assessors Office for surrounding property owners is
attached.
4. A list of the names and addresses of mineral owners and lessees of minerals on or under
the parcel of land being considered is attached.
5. A copy of the reclamation plans as submitted to the State of Colorado Minerals and
Geology is enclosed for review. Copies of the plan for obtaining water supplies, cross
sections of drainage structures and profiles and typical cross sections of haul roads will
be submitted if deemed necessary by the Board of County Commissioners.
6. This Use by Special Review application for a mining operation is consistent with the
Weld County Comprehensive Plan. The Comprehensive Plan allows for and encourages
the extraction of sand and gravel deposits. CM.Goal 2 states that the County should
promote the reasonable and orderly development of mineral resources. This application
and accompanying materials clearly demonstrates compliance with this goal.
All activities at the mining site are guided by the regulations of the Mine Safety and
Health Act (MSHA) and the Occupational Safety and Health Act(OSHA). These
requirements along with the Weld County Comprehensive Plan, specifically CM.Goal4
which states minimize hazardous conditions related to mining activities and the mining
site, will minimize or eliminate the potential adverse impact of the operation on
surrounding properties. The application is proposing setbacks, noise controls, dust
controls and general site conditions which will help to comply with the goals and policies
of the Comprehensive Plan.

Reclamation activities will be concurrent with the mining operation. Disturbances to the
site will be minimized as much as possible. Wildlife habitat on the site is minimal, but
will be preserved to the greatest extent possible.
7. This application request is located in the A(Agricultural) Zone District and is listed as a
use allowed by special review under Section 31.4.1 of the Weld County Zoning
Ordinance. The subject site is also located within the Mixed Use Development Area as
described in the Ordinance 191. As stated in Section 2.5.2 of Ordinance 191, the use of
sand and gravel mining will require a Use by Special Review(USR).
8. The subject site is not located on prime agricultural ground. The ground has historically
been utilized as pasture land. Additionally, the property is located within the Mixed Use
Development Area and is described on the Structural Land Use Map, 2.1, as having
potential for residential uses.
9. The protection of the health, safety and welfare of the inhabitants of the neighborhood
and the County are being considered by the applicant. Possible fugitive dust emissions
from the site will be minimized by watering and re-vegetation activities. Noise levels
will comply with the requirements of the Weld County Health Department. Only one
access point will be used for the truck traffic at the site. Through measures taken by the
applicant along with the Conditions of Approval and Development Standards as
established by the County through the permitting process, the consideration of health,
safety and welfare of Weld County Citizens will be protected.
10. Surrounding land uses are primarily agricultural with commercial activity to the
northeast. There are other permitted sand and gravel mining areas in the general vicinity.
This use is not a high intensity use which would increase the amount of traffic in the
vicinity of the site. Compatibility with surrounding uses will be assured by setbacks,
noise limitations and Conditions of Approval and Development Standards as established
by the County.
11. Future development of the area, as described by the County Mixed Use Development
Plan, would allow for residential and employment center type activities. Additionally,
the subject property is located in the Urban Growth Boundary areas of the Town of
Firestone and Frederick, as identified in the Intergovernmental Agreement.
12. The subject site is not located in a geologic hazard area, flood plain or airport overlay
district as identified on maps officially adopted by the County.
13. Drinking water to the site will be supplied by bottled water.
14. A deed is attached which identifies the applicants interest in the property under
consideration.

15. A noise report is not included, but will be provided if deemed necessary by the Weld
County Planning Department.

Responsibilities as a Permittee:
Upon application approval and permit issuance, this application becomes a
legally binding document. Therefore, there are a number of important
requirements which you, as a permittee, should fully understand. These
requirements are listed below. Please read and initial each requirement, in
the space provided, to acknowledge that you understand your obligations . If
you do not understand these obligations then please contact this Office for a
full explanation.
k 1 . Your obligation to reclaim the site is not limited to the amount of
the financial warranty. You assume legal liability for all reasonable
expenses which the Board or the Office may incur to reclaim the affected
lands associated with your mining operation in the event your permit is
revoked and financial warranty is forfeited;
2 . The Board may suspend or revoke this permit, or assess a civil
penalty, upon a finding that the permittee violated the terms or
conditions of this permit, the Act, the Mineral Rules and Regulations,
or that information contained in the application or your permit
misrepresent important material facts;
3 . If your mining and reclamation operations affect areas beyond the
boundaries of an approved permit boundary, substantial civil penalties,
to you as permittee can result;
4 . Any modification to the approved mining and reclamation plan from
those described in your approved application requires you to submit a
permit modification and obtain approval from the Board or Office;
5 . It is your responsibility to notify the Office of any changes in your
address or phone number;
6 . Upon permit issuance and prior to beginning on-site mining activity,
you must post a sign at the entrance of the mine site, which shall be
clearly visible from the access road, with the following information
(Rule 3 . 1.12) :
a. the name of the operator;
b. a statement that a reclamation permit for the operation has been
issued by the Colorado Mined Land Reclamation Board; and,
c. the permit number.
7 . The boundaries of the permit boundary area must be marked by
monuments or other markers that are clearly visible and adequate to
delineate such boundaries prior to site disturbance.

8 . It is a provision of this permit that the operations will be
conducted in accordance with the terms and conditions listed in your
application, as well as with the provisions of the Act and the
Construction Material Rules and Regulations in effect at the time the
)ermit is issued.
9 . Annually, on the anniversary date of permit issuance, you must submit

Mining Plan
The 80-acre William Kobobel property contains a significant deposit of sand and gravel located
in alluvium of Boulder Creek in Weld County. This area of the county is well known for mining
operations. There are past, current and approved future mining operations north and one-quarter
mile west of this site. Directly west, east and south of the property are agricultural type uses. To
the northeast are commercial uses.
The mining permit boundary includes 60.8 acres, of which approximately 26 acres will be
mined. There will be only one mining phase. Mining will begin in the east central area of the
property, as shown in Exhibit C, and will then proceed in southwesterly and northeasterly
directions from the mining entry.
The duration of the mining operation will be 4 to 6 years, depending on market demand. The
operator expects to excavate 5 acres per year. This will be a continuous mining operation with no
significant cessation planned. By the end of the year 2005 mining will be complete.
Reclamation will include a 15.8-acre lake and pastureland.
There will be a minimum of a 25-foot setback for mining operations from property lines. The
Weld County Mixed Use Development Plan identifies a future road along the eastern property
line; a 50-foot wide strip for this purpose will be reserved. The minimum setback from the Rural
Ditch is 100 feet.
The site contains several physical constraints that have influenced the mining operation. The
Rural Ditch separates the northwest corner of this site from the remainder of the property, and
that area will not be mined. The area surrounding an existing house with outbuildings located
on the southwest corner of the property will also be excluded from mining. Access to the site is
from Weld County Road(WCR) 20 %:on the south. Therefore,the gravel plant and clarifying
ponds are located in the southeast corner of the property. The far southeast corner will be mined
to create enough depth for the clarifying ponds.
The mining operation will progress as follows:
1. Construct the access road into the site.
2. Construct the processing plant area, the clarifying ponds, and the office/scale area.
3. Strip topsoil and overburden from the initial mining area and place in stockpiles
and the east perimeter berm.
4. Commence mining of the resource and the processing of the aggregate.
5. Continue with mining the designated area.
All mining will occur using a dry mining technique. The potential pump locations are noted on
the plan. The groundwater will be used to replenish the clarifying ponds, and to provide water
for other consumptive uses during the operation.

The processing plant area contains the crushing and screening equipment for the raw material.
Materials will be crushed, screened, washed and sold on-site primarily as road and concrete
aggregate.

In order to gain an understanding of the extent of the mining operation, it is helpful to know the
acres disturbed by different aspects of the mine. We have selected a point in time where the
mining disturbance could be at its maximum. At this point in time, mining in the southern
portion has been completed and mining is headed in a northeasterly direction. Along the
southern edge of mining, slopes for the proposed lake are in place, and the future shoreline has
been seeded. The following acres of disturbance apply for this scenario:

Sand and gravel deposits in the area to be mined on this site vary from six to twelve feet. The
overburden and topsoil vary in thickness from four to nine feet. Bedrock under the deposit is
siltstone.

Reclamation Plan
The final reclamation plan for the 60.8-acre mining phase of this project will be as a 15.8-acre
lake and pasture land.
The proposed post-mining land uses are compatible with surrounding land uses. To the north is
another property to be mined and reclaimed as lakes and pastureland. Other lakes created by
former mining operations are within one-quarter mile of the property. Directly to the west and
east are farming and grazing uses.
The proposed reclamation land uses are also compatible with Weld County regulations. The
Weld County Comprehensive Plan allows mining as a special use in rural and agricultural zones.
This property is classified in the Weld County Mixed Use Development Plan as potential for
future residential uses. The proposed reclamation plan will be keeping with the intent of Weld
County Regulations.
While this property is being mined, concurrent reclamation will be underway. This process will
continue for the duration of the project. Topsoil and overburden will be stripped separately and
replaced in layers as the mining progresses. Slopes along the lake will be backfilled to a 3:1
configuration along the northwestern side, adjacent to the Rural Ditch. A 5:1 slope will be used
along the remainder of the shoreline.
The ultimate plan for the entire 80-acre property includes the 15.8-acre lake and approximately
35 residential lots, some with lake frontage. Although this will be a separate process, the mining
and reclamation plans have been designed to accommodate this post-mining action. Over the
next several years,the Operator will apply to Weld County for a subdivision plat on the
residential lots. When the plat is approved, the Operator will file Technical Revisions for the
release of reclaimed land from the DMG permit boundaries, in order to begin site preparation for
the proposed residential lots.
The operator will comply with Rule 3.1 according to the following measures:
Reclamation Measures/Materials Handling
The mining operation will be done with sidewalls at a 1:1 slope. The operator will utilize
concurrent reclamation during this operation. Originally, the overburden from the currently
stripped land will be placed along the south and east edges of the property to form a 5-foot high
perimeter berm (See Exhibit F). Once the berm is complete,the remaining overburden will be
placed along the shoreline at a 3:1 or 5:1 slope, depending on the location. The topsoil will be
stockpiled, seeded and used as reclamation for the shoreline. Final grading will be done along
the contours and revegetation will occur as soon as possible to prevent erosion. The final areas
will be graded and seeded within one year to two years after the mining is complete.

The mining will leave no highwalls on the property. No acid forming or toxic materials are used
in the mining. There will be no auger holes, adits or shafts left in the property.
Backfill generated on the site will include concrete, silts and clays from the materials washing
operation and non-marketable fine material. These materials will be buried along the lakeshore.
Inert fill generated off the permit area will also be brought onto the site as backfill. This material
could include concrete, soil, brick, and limited amounts of asphalt. Generally any asphalt
brought in will be recycled into new product. These off-site inert materials will be disposed of in
a similar manner as the backfill generated on-site. Since this material is inert, there will be no
release of pollutants. This reclamation plan identifies off-site material to be used as backfill.
Therefore, no further notice to the Division is required.
Water— General Requirements
In order to minimize the effect that mining will have on the prevailing hydrologic balance:
a. The operator shall comply with all applicable Colorado water laws.
b. The operator shall comply with all applicable federal and State water quality laws and
regulations.
c. The operator shall comply with all federal and State requirements for dredge and fill.
d. The operator shall regrade all sediment in siltation structures after mining is completed.
Groundwater—Specific Requirements
The operation will not affect groundwater quality on or off the site. The operation will comply
with all State groundwater quality standards.
In the wash plant, water will be recycled to a settling pond. Flocculants may be used to assist in
the settling out of suspended solids; the flocculants will not contain hazardous or toxic materials.
The water recycled in the washing operation will not be released into any waterways. The clays
and silts salvaged from the washing operation may be used as fill material for the slopes.
Due to the absence of any pollutants, groundwater quality monitoring is not required for this
operation.
Wildlife
The proposed reclamation plan does not propose to create wildlife habitat. All activities will be
planned considering the safety and protection of wildlife on the property. Some species may be
temporarily displaced by the mining activities, but are expected to re-establish with no difficulty
after the reclamation has been completed. The creation of the lake will create more opportunities
for aquatic birds, mammals, and fish.

Topsoiling
The top six inches of soil is classified as topsoil. This layer includes the root zone of the grasses
and other plants. It will be stripped and stockpiled separately. By using concurrent reclamation
techniques, the topsoil in the stockpile should only remain for one to two years. If the stockpile
remains more than one growing season, it will be seeded with wheatgrass to prevent erosion.
Topsoil will be replaced in reclaimed areas around the lake in the same six-inch depth.
Revegetation
The purpose of revegetation is to re-establish the pasture grasses and stabilize the newly
established soils. Slopes will be no greater than 3:1. The grasses were selected to be long lasting
and regenerate themselves. The ground will be fine graded and prepared for seeding. Fertilizers
will be used according to recommendations from the Natural Resources Conservation Service
(NRCS, formerly Soil Conservation Service), and the operator will contact the NRCS
periodically throughout reclamation for soil tests.
If a significant invasion of noxious weeds occurs, the area will be mowed periodically for
control. Weeds will be mowed before they go to seed during the first growing season.
Mechanical control will be used as a first priority. Chemical methods will only be used if no
other alternative produces acceptable results.

Seeds will be planted with a drill equipped with depth bands and press wheels. The seeded areas
will then be covered with straw mulch at a rate of 4,000 pounds per acre. The straw will be
crimped into the soil to control erosion until the grass becomes established. Seeding will be
done between May 1 and November 1 and as soon as possible after fine grading is completed.
Trees and shrubs will be planted in clusters around the lakeshore as indicated on the Reclamation
Plan Map. Each cluster will contain five to ten trees and ten to twenty shrubs. Trees will be
selected from the following list:

those areas mined during the past year will be graded with overburden and topsoil. Seeding and
mulching will generally occur in the fall.

Water Information
The proposed mining operation is to be located in Weld County, southwest of the
I-25 —Highway 119 exit outside Longmont (See attached Exhibit G-1). The operation will
impact the St. Vrain River in the form of depletions due to evaporation and losses associated
with mining. These impacts, however, are of minor consequence and can be mitigated without
injury to the vested senior water rights downstream of the site.
The operation will consist of sand and gravel washing. During the initial phase, a 1.5-acre area
will be mined to serve as a lined wash pond.
The project will create an open gravel pit lake with a total maximum area of 15.8 acres. The
reclamation plan will leave an unlined lake that is hydraulically connected to the alluvial aquifer.
A substitute water supply plan for the replacement of water depletions during the mining phase
will be submitted to the State Engineer's Office. The operator will obtain an approved
augmentation plan through Colorado Water Court after mining is complete. The length for the
completion of the project is estimated at 4 to 6 years.
Water Use
Water use at the site will include evaporation from the wash pond and dewatering trenches, water
retained in material removed from the site, and dust control of haul roads and stockpiles.
Mining at the site will intercept the groundwater table. In order to enable dry mining, dewatering
trenches will be constructed around the perimeter of the pit and the water routed back to the St.
Vrain. The exposed groundwater associated with the dewatering trenches is estimated at 0.5
acre. In addition to the exposed groundwater in the dewatering trenches, groundwater will be
pumped into the 1.5-acre wash pond. The total exposed water surface during mining is 2.0 acres.
The gross annual evaporation for the site is 40 inches at the subject location, taken from NOAA
Technical Report NWS 33, Evaporation Atlas for the Contiguous 48 United States. The annual
mean precipitation is 13.00 inches. The precipitation at the mine site is estimated to be the same
as that found at the nearest weather station to the site which is located in Longmont. The
precipitation was found using data from the publication, Climatography of the United States No.
81.
The effective precipitation is computed to determine the net evaporation from the exposed
groundwater. The effective precipitation is calculated as 70 percent of the total precipitation.
The net evaporation is then determined by subtracting the effective precipitation from the gross
evaporation. The net annual evaporation at the site is 2.6 feet. Thus,the resulting net annual
evaporative consumptive use during mining operations is 5.2 acre-feet. The evaporation
associated with the post reclamation lakes will be approximately 40.7 acre-feet per year. These
after mining augmentation requirements can be seen on Table No. 1.

As material is excavated, it will be washed on site. The water retained in this material is
considered as consumptive use. The anticipated amount of material that will be mined and
washed each year is estimated at 120,000 tons. Assuming a 4 percent moisture content by
weight as suggested by the State Engineer's Office, the total annual depletion is 3.5 acre-feet.
In addition, water use at the site will include dust control. This is water applied to haul roads and
stockpiles. It is estimated that one load from a 1000-gallon capacity water truck three days a
week for nine months is required for dust control. This results in a consumptive use of 0.4 acre-
feet per year.
The total annual consumptive uses associated with the mining operations are as follows:
Evaporation 5.2 acre-feet
Moisture Retained in Product 3.5 acre-feet
Dust Control 0.4 acre-feet
Total 9.1 acre-feet
Water Rights
The landowner of the amendment area, William Kobobel, will be providing the necessary water
rights for the operation. The landowner owns 8 shares of Godding Ditch, which will be made
available for augmentation. The average yield per share owned by Kobobel is approximately
31.2 acre-feet annually.
For the purpose of calculating the average annual consumptive use of the Godding Ditch shares,
a 50 percent irrigation efficiency is assumed. This results in a consumptive use of approximately
15.6 acre-feet per share.
The Godding Ditch water will be used to make replacements during mining. An application to
temporarily change the use of the Godding Ditch shares from agricultural use to augmentation
will be submitted to the State Engineer's Office. The reclamation replacement requirements will
be mitigated with a portion of the 8 shares of Godding Ditch.
Surrounding Water Rights
Exhibit G-1 shows the permitted and/or adjudicated water rights within one half mile of the site.
Well and water rights tabulations from the State Engineer's Office were used to locate the
surrounding wells and water rights as shown in Exhibit G-1. These tabulations are attached.

Wildlife Information
The site is bounded by agricultural lands to the west; on the south by Weld County Road 20 V2
and agricultural land; by agricultural land and Interstate 25 (I-25)one-quarter mile to the east;
and on the north by land with a DMG permit for sand and gravel mining. One home with
outbuildings is located on the southwest corner of the property,but is outside the permit
boundary. The Rural Ditch forms the permit boundary to the northwest, and a gas line and
irrigation ditch border the eastern side of the property. The current Weld County Comprehensive
Plan includes a proposal for a new four-lane road to be constructed along the eastern border of
the property.
Typical or probable wildlife species expected to inhabit the site include small rodents, cottontail,
jackrabbits, squirrels, coyotes, and skunks. Avian species sited in the area include geese, ducks,
pheasants, hawks, swallows, and sparrows.
According to the Colorado Latilong Study, Threatened and Endangered species in the area may
include the White Pelican, Peregrine Falcon, Greater Sandhill Crane, Whooping Crane and the
Bald Eagle. No recent sightings of these species have been reported near this property.
Due to the nature of the site, with I-25 to the east and other mining operations throughout the
area, previous seasonal use of the area by wildlife has long since been disrupted. Any further
impact to the wildlife communities resulting from this project is expected to be minimal or
insignificant.
Mining and reclamation activities will take into account the safety and protection of wildlife on-
site and will only temporarily impact wildlife.
During operations, there will be a temporary loss of food and habitat. Upon completion of
operations, reclamation of this property will include a lake and large-lot residential properties.
Although residents will use the lake for recreational purposes, the surface water and vegetated
shoreline of the lake will restore and improve some wildlife habitat. Ultimately, there will be an
increase in aquatic and waterfowl habitat due to the open water, and the rural nature of the
residential sites will accommodate the area's terrestrial species.
The Colorado Division of Wildlife has been contacted and an evaluation/inspection report will
be forwarded when available.

Soils Information
As mapped by the USDA Natural Resources Conservation Service(formerly Soil Conservation
Service (SCS)), Weld County Survey— Southern Part, two soil types occur on this site.
The predominant soil type for the 80-acre property, found on approximately % of the property, is
"Aquolls and Aquepts, flooded" (#4 on the SCS map). These are deep, poorly drained soils that
formed in recent alluvium. Commonly the soils have a mottled, mildly to moderately alkaline
loamy or clayey surface layer and underlying material that extends to a depth of 60 inches or
more. According to the SCS Survey, Aquolls and Aquepts have a seasonal high water table.
These soils are best for rangeland and wildlife habitat, and also have good potential as a source
of sand and gravel.
The soil type for the remainder of the property(approximately the NE quarter) is "Heldt silty
clay, 1 to 3 percent slopes" (#247 on the SCS map). This is a deep, moderately well drained soil
on plains at elevations of 4950 to 5050 feet. This soil type formed in alluvial sediment derived
from shale. Typically the surface layer is light brownish gray and light yellowish brown silty
clay about 7 inches thick. The subsoil is light brownish gray silty clay about 27 inches thick.
The substratum is silty clay to a depth of 60 inches.
The SCS Survey identifies the topsoil on both soil types to be poor. Aquolls and Aquepts are
poor due to wetness, and Heldt soils are too clayey. The site inspection also revealed to topsoil
to be of fair to poor quality in general.
A series of test holes have been analyzed throughout the site. The test results are available to the
MLRD upon request.

Vegetation Information
This site has been farmed periodically, and left fallow the remainder of the time. Farming on
this property will continue until the mining operation has progressed to the point where farming
is no longer feasible. When crops are not planted, vegetation is made up of a variety of weeds,
forbs and grasses, including western wheatgrass, blue grama grass,buffalo grass and alkali
sacaton.
The only trees on-site are near the farmhouse excluded from the permit boundary, and a few
larger cottonwoods along the Rural Ditch near an on-site bridge (see Exhibit C). None of these
trees will be impacted by this project. There are small pockets of wetland vegetation along the
northern and eastern fringes of the property, due to pooling in the irrigation ditch. No unique,
rare or endangered plant species are known to exist on-site.
