Dear Ms. Keithley:
Reference is made to the Mike Faulkner Site Specific Development Plan for a 2500
head dairy in the A (Agricultural) zone district. The project is located in Section 29,
Township 7 North, Range 64 West, Weld County, Colorado.
If any work associated with this project requires the excavation in or placement of
dredged or fill material, either temporary or permanent, into Willow Creek or wetlands at
this location, this office should be contacted by a proponent of the project for proper
Department of the Army permits pursuant to Section 404 of the Clean Water Act.
Any wetland determinations for this project should be conducted by the Natural
Resource Conservation Service of Weld County, since the project is on agricultural land.

The Environmental Protection Services Division has reviewed this proposal; the
following conditions are recommended to be part of any approval:
1. Prior to recording the plat:
a) The facility shall demonstrate compliance with the Confined Animal
Feeding Operations Control (CAFO) Regulation. This shall be
demonstrated by submitting a comprehensive manure run-off and
process waste water handling plan, for a 2,500 head dairy, to the
Weld County Health Department for review and approval. This plan
shall include, but not be limited to the following:
(1) Demonstration that all manure stockpile areas and waste water
collection, conveyance, and retention facilities are
adequately constructed and sized to handle a twenty-five year,
twenty-four hour storm event. This shall be conducted by a
Registered Professional Engineer.
(2) Demonstration that any waste water retention structure
constructed after August 30, 1992, has been constructed with
a lining material which does not exceed a seepage rate of
1/32" /day (1 X 10-6 cm/sec) . This shall be conducted by a
Registered Professional Engineer.
(3) Demonstration that the facility has the ability to manage and
land apply manure and waste water at agronomic rates in
accordance with the CAFO Regulations.
(4) Demonstration that adequate measures are in place to prevent
a discharge to Willow Creek, with the exception of any
discharge allowed by the CAFO Regulations.
(5) The schedule at which manure and waste water will be removed
and applied to the land.
(6) Other necessary measures which are required in order to comply
with the CAFO Regulations.
b) A dust abatement plan shall be submitted to the Weld County Health
Department for review and approval. The facility shall have
sufficient equipment available to implement dust control as required
by the Weld County Health Department.

c) A fly control plan shall be submitted to the Weld County Health
Department for review and approval.
2. The facility shall maintain records on-site, available for inspection
during business hours, at all times which demonstrate the following:
A. That the manure storage areas and waste water collection, storage,
and land application facilities are adequately constructed, and
sized to handle a twenty-five year twenty-four hour storm. These
shall include construction as-built, engineered drawings, etc.
B. The schedule in which manure and waste water is removed and applied
to land. This should also include any agreements between the
facility and other parties concerning the removal of manure off-site
for land application, treatment or disposal.
C. The method in which waste water and\or manure will be applied to
land, including the procedure which will be used to insure that
agronomic rates are not exceeded.
D. Other measures which are in place to insure that the facility is
operating in accordance with the CAFO Regulations.
3. The applicant shall remove, handle, and stockpile manure from the
livestock area in a manner that will prevent nuisance conditions. The
manure piles shall not be allowed to exist or deteriorate to a condition
that facilitates excessive odors, flies, insect pests, or pollutant
runoff.
4. The facility shall operate in compliance with the Confined Animal Feeding
Operations Control Regulations (5 CCR 1002-19) and Weld County Zoning
Ordinance, Section 47.
5. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
6. The facility shall not discharge to surface or groundwater with exception
to what is allowed by the Confined Animal Feeding Operations Control
Regulations.
7. An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit maybe
required for this facility. If applicable, the applicant shall submit an
application to the Air Pollution Control Division, Colorado Department of
Health.
8. No permanent disposal of solid wastes, as defined in the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) ,
shall be permitted at this site.

9. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
10. Fugitive dust shall be controlled on this site.
11. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit(s) . In the event the system(s)
is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
12. The facility shall be operated in a manner to control flies. The plan
shall be implemented at the request of the W.C. Health Department in the
event that flies (which can be determined to be associated with the
facility) are in such a number to be considered a nuisance condition.
This plan shall be implemented in the event the W.C. Health Department
receives a significant number of fly (associated with the facility)
complaints and, in the judgement of the Health Officer, there exists a fly
condition requiring abatement.
13 . In accordance with the CAFO Regulations, the applicant shall submit the
facility's manure and waste water management plan to the Water Quality
Control Division of the Colorado Department of Public Health &
Environment.

The West Greeley Soil Conservation District has completed its review of Case Number USR-
1133,the Faulkner Dairy expansion proposal. The district has a number of comments on this
Site Specific Development Plan.
The site proposed for the dairy expansion north of Galeton has severe limitations for a
development of this type. Most of the soil is shallow, close to shale, and has rapid permeability.
High water tables are prevalent in this area and much seepage occurs. The site is divided by
Willow Creek and if the project is not designed and constructed correctly, excessive effluent
could enter the creek. Solid manure storage should not be allowed in an area adjacent to the
riparian area. The district would like to see adequate buffer strips maintained along the creek to
alleviate this problem.
The soils also have severe limitations for liquid effluent storage lagoons. The lagoons need to
be engineered and constructed to overcome these limitations by placing a lining inside each pit.
Manure by itself will not seal these pits. The district would like to see all manure storage pits
lined.
The limited number of acres on the site, combined with the shallow soils, may lead to a problem
with waste water disposal. This could lead to a possible nitrate concentration which could be
transported into Willow Creek. The Confined Animal Feeding Regulations should be strictly
adhered to throughout the entire planning process for this development.
Willow Creek meanders through several livestock operations before it reaches the Faulkner
Dairy. The district is concerned that water quality in the creek is already poor and the addition
of more cattle will worsen the problem. The district would like the Weld County Health
Department to test the waters and soil in the creek for contaminants in an effort to determine if
there is a current pollution problem. With the focus on water quality, new regulations on the
horizon, and the land along the South Platte River named a water quality priority area, the
possibility exists that an operation could invest large amounts of money, only to find the new
laws will not allow it to continue operating without significant and costly changes.

The West Greeley Soil Conservation District would also ask that adjacent landowners receive
adequate individual notification of this project to allow them a voice in the planning procedure.
A project of this size will have a long term affect on all involved.

Dear Ms. Keithly,
I have reviewed Case Number USR-1133, the expansion proposal for the Mike Faulkner Dairy near Galeton,
Colorado. Further,I've made an on-site inspection of the present facility. I offer to you the following comments:
The size of the present dairy requires it to adhere to the Confined Animal Feeding Regulations (CAFR), and
continued compliance with these regulations must be observed during all phases of expansion.
Animal density at the present time is approximately 600 square feet/animal,and is within the recommended range
for dry lot facilities in semi-arid climates (see attachment). No detail is available on animal density after
expansion,but I would recommend that it remain within the accepted range.
In my opinion, the dairy is presently employing best management practices for fly and odor control, and these
practices should be continued during and after expansion.
I understand the sensitive nature of the environment in this area,with Willow Creek transversing the property,and
with the high ground water and permeable soils. Berms are presently in place along both sides of Willow Creek.
Solid waste is currently stored adjacent to the creek,on the south side of the property, until used by local farmers.
It is recommended that adequate buffer strips be maintained on both sides of Willow Creek where practical,
especially in the solid waste storage area.
A settling(sludge)lagoon,as well as primary and secondary lagoon storage facilities are in place to handle liquid
effluent, and periodic dewatering of the lagoons for crop application is standard practice at present. It is
recommended that liquid effluent be applied at proper agronomic rates. Storage capacity of the lagoons,based
on the proposed expansion, should be verified as adequate by a qualified individual or organization. A Manure
and Processed Waste Water Management Plan, as called for in the CAFR, should be submitted if one has not
already been submitted.
Based on my review and observations, and with consideration of the above recommendations, Weld County
Extension has no objection to the proposed expansion of the Mike Faulkner Dairy near Galeton.

While visiting the site,I counted eleven access points to the property. Most of the access points are
agricultural related or residential and appear to be justified for the usage at the site.
My major concern is the mobile home housing development located adjacent to WCR 76. The
applicant needs to utilize the existing road adjacent to the future mobile home park with no direct
access to the County road. I recommend that all trailers access on to an internal road system.
The average daily traffic count(ADT) taken in December 1979 on WCR 51 was 363 vehicles per
day. The ADT on WCR 76 taken August 1996 was 80,with no accidents being reported in the past
three years at this intersection.
The future storm water structure and lagoon are to be addressed by the Health Department.
