COLO IRRADO Subject: Legal Action Authorization
The Department of Planning Services has scheduled the following violations to be considered at the January 12,
1999, hearing beginning at 10:00 a.m. The Department of Planning Services is requesting that the Board review
the individual cases and determine whether or not to authorize legal action to remedy the violations.
VI-9800063, Charles and Renee Ottinger (Continued from October 13, 1998, hearing.)
Section 30.5.2 of the Weld County Building Code Ordinance
Temporary Certificate of Occupancy has expired without the final building, electrical, plumbing and heating
inspections approved.
VI-9800177,Jerry and Ruth Fogg/David and Micki Fogg
Sections 20.10.9, 50.5.3, 60.5.2, and 71.4.2 of the Weld County Building Code Ordinance.
Final inspections were not completed on the structure within 180 days after the issuance of Permit Number PR-
9630114.

Sections 31.4, 31.4.8, and 45.6 of the Weld County Zoning Ordinance.
KENNEL-Any place other than a pet shop or veterinary clinic or hospital,where five (5) or more household pets
of one species, or a total of eight (8) or more household pets of two (2) or more species are kept or maintained.
Property that is zoned agricultural and not part of a platted subdivision or unincorporated town and which is
larger than ten (10) acres shall be permitted to keep or maintain eight(8) household pets of one species or sixteen
(16) household pets of two (2) or more species without being considered a kennel.

Noncommercial junkyard consisting of derelict vehicles, old buses, mobile homes, boats and semi trailers.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.
