RE: APPROVAL OF RECORDED EXEMPTION #1717 - STAN BARRETT, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1717, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1717 was submitted by Stan Barrett,
Inc., 811 Main Street, Longmont, Colorado 80501, for property described as Lot 1 of RE #1201
in part of the SW' of Section 11, Township 2 North, Range 68 West of the 6th P.M., Weld County,
Colorado, being more particularly described in the plat which shall be provided by the applicant and
known as Exhibit "A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
9.21 acres and 7.65 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1717 submitted by
Stan Barrett, Inc., be, and hereby is, approved conditional upon the following:
1. Prior to the release of building permits for Lot A or Lot B, the applicant/property
owner shall provide to the Department of Planning Services a letter of absolute
commitment from the St. Vrain Sanitation District for sewer service on the property.
2. Prior to recording the recorded exemption plat, the applicant shall provide to the
Department of Planning Services sufficient documentation, which has been
recorded in the Office of the Weld County Clerk and Recorder, indicating that the
20-foot utility easement (described in Book 838 as Reception No. 1760436 and
recorded July 18, 1978) has been vacated and absolved. The applicant shall also
provide to the Department of Planning Services an affidavit stating that interest in
said utility easement has not been transferred to any other party.

3. In accordance with Section 33.4.5 of the Weld County Zoning Ordinance, the
completion of a Site Plan Review is required prior to any development taking place
on Lot A or Lot B.
4. Prior to the construction of any new access on 1-25 Frontage Road, a State
Highway Access Permit shall be obtained from the State Department of
Transportation.
5. Access to Lot A and Lot B shall be limited to one per parcel.
6. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 3rd day of May, A.D., 1995.

Dear Commissioners:
This application for a recorded exemption is submitted by Stan Barrett, Inc. The parcel of land
under consideration is described as Lot 1 of RE-1201 in part of the SW4 of Section 11, T2N,
R68W of the 6th P.M., Weld County, Colorado. The property is zoned C-3 (Commercial) and is
located east of and adjacent to the 1-25 Frontage Road and north of Weld County Road 22.
Two large billboards are the only structures existing on the parcel at the present time.
The approval of RE-1201, which was approved by the Department of Planning Services in
1989, divided a 22.86 acre parcel, more or less, into 16.86 and 6 acres, more or less. Lot 2 of
RE-1201 is located directly south of the subject site, and its landowner is currently in the
process of requesting a zone change from C-3 (Commercial) to PUD (Planned Unit
Development); Flatiron Structures Company has one building located on the property. The
applicant is requesting to further subdivide Lot 1 into two parcels of 9.21 and 7.65 acres, more
or less. New Vision Homes, Inc., located directly north of the property, wishes to relocate its
facility on proposed Lot A.
Central Weld County Water District is proposed to provide water to the site, and sewer service
is available from St. Vrain Sanitation District. Weld County Public Works and Health
Departments have no conflict with the submitted request.
The Colorado Department of Transportation recommends that proposed Lot A access the 1-25
Frontage Road at the north boundary of the parcel, in order to avoid conflict with the planned
acceleration lane to be built for Flatiron PUD. A Reciprocal easement deed, which has been
recorded with Weld County and described in Book 1364 as Reception Number 02316562,
provides for a 30-foot wide access to be shared by proposed Lot B and Flatiron PUD.
According to the deed, the easement parcel is the entire length of the property boundary line
between the Barrett property and the Flatiron property, having 15 feet located on either side of
the boundary line.

It is the opinion of the Department of Planning Services' staff that this recorded exemption
proposal complies with the Weld County Comprehensive Plan Commercial, 1-25 Mixed Use
Development Area and Urban Growth Boundary goals and policies. The proposed division of
land does not appear to conflict with the 1-25 Mixed Use Development Area Conceptual Land
Use Plan. Parcel size appears to be compatible with other surrounding commercial land uses.
Adequate public services and facilities are available to serve commercial development at this
location. A Site Plan Review, required for all development within the Commercial zone district,
will ensure that issues such as landscaping, screening, lighting, parking, signage, etc. be
evaluated, in accordance with Performance Standards as set forth in Section 33.6 of the Weld
County Zoning Ordinance.
This 17-acre parcel is located within the Urban Growth Boundary of the incorporated areas of
Frederick and Firestone. The Tri-Area Planning Commission has reviewed the recorded
exemption application and has no conflict with the proposed division of property.
The Department of Planning Services' staff recommends approval of this request. It is the
opinion of staff that the proposal satisfies the criteria for review and approval of recorded
exemptions, as stated in Section 11.5.1 through 11.5.6 of the Weld County Subdivision
Ordinance.

Dear Gloria:
We have reviewed the Stan Barrett Application for Recorded Exemption,
and offer the following comments :
ACCESS The narrative states that Lot A consisting of 7 . 65± acres is
to be used as a manufactured home sales center. Lot B, 9 . 21±
acres, is to remain undeveloped and an access is not proposed. An
access to Lot A has been proposed but has not been indicated on
the plans .
A site visit was conducted on March 29 and it was noted that the
south property boundary of Lot B borders the recently constructed
Flatiron Structures access . Additional improvements to this
access are planned at such time as the I-25/SH 119 interchange is
realigned. Those improvements would include an acceleration lane
that would run along the west property boundary of Lot B and
possibly a portion of Lot A. An access within the acceleration
lane would not be desired. The plans indicate a proposed 24'
access and utility easement on the Flatiron property immediately
adjacent to Lot B. The Department would encourage access to be
shared or provided by way of this access.
Access to Lot A should be planned at a location outside of the
acceleration lane and some distance from the existing access
located at the north property boundary.
A State Highway Access Permit must be obtained prior to the
construction of any new access .
Our comments are based upon submittal received March 16 , 1995 and the
site visit of March 28, 1995 .

Camiitment to Serve
Gentlemen:
This letter is in reference to the following described real property:
East I-25 Frontage Road in NW/4 of the SW/4 of Section 11, T2N,
R68W of the 6th P.M. , Weld County, Colorado.
Referenced property can be served. A District lateral sewer line is
available along the east side of this property.
St. Vrain Sanitation District has 1852 SFE (single family equivalent) taps,
of which 342 have been purchased, resulting in 1510 available for purchase.
These taps are available to referenced property and other eligible
properties on a first-cane, first-serve basis. As the present supply of
taps is consumed, the District plans to increase the size of its treatment
plant to serve 5,555 SFE taps. These additional taps would also be made
available on a first-cane, first-serve basis.
The above-referenced property is eligible to utilize the available supply
of taps on a first-cane, first-serve basis, subject to the following:
a. Execution of a Service Agreement;
b. Installation of on-site lateral, as may be required;
c. Purchase and payment of the required number of taps; and
d. Compliance with the District's Rules and Regulations.
Should this property wish to obtain an absolute commitment to serve, taps
may be prepurchased and held until needed. Monthly service charges will be
assessed upon connection or twelve months after purchase, whichever comes
first.

This letter is in response to a request for water service to serve the following property described as
follows:
Lot 1 Recorded Exemption No. 1313-11-3-RE1201 located in SW 1/4 Section 11,
Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado.
Water service can be made available to the above described property provided all requirements of
Central Weld County Water District and the Northern Colorado Water Conservancy District are
satisfied, including easements where required for District facilities.
Central Weld County Water District requires that contracts be consummated within one (1) year from
the date of this letter, or this letter shall become null and void unless extended in writing by the District.

Dear Mr. Barrett:
Your recorded exemption application has been received by our office and is currently being processed.
Additional information, as identified below, is required to be submitted in writing to our office prior to
scheduling the request before the Board of Weld County Commissioners.
1) Please indicate whether the parcel of land under consideration is the total contiguous land owned by
you.
2) Please provide documentation regarding the 20-foot utility easement which extends through the center
of the parcel in a north-south direction. Please provide evidence if the easement has been vacated. If it has
not been vacated, the RE application will require a list of parties who have interest in the easement and
information indicating that there would be no objection to vacation of the easement. It is the staffs opinion
that vacation of the easement could be accomplished as a part of the RE, if it is approved by the
Commissioners. If you have questions regarding submittal requirements associated with this easement
vacation, please feel free to contact me.
The recorded exemption processing period is approximately 30 days. When all the necessary information
is supplied and referral agencies have had the opportunity to review the application, staff will contact you
and schedule a hearing date with the Board of County Commissioners.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the Tri-Area Planning Commission for its review and comments. It is recommended
that you and/or a representative be in attendance at the Tri-Area's Planning Commission meeting to answer
any questions the Commission members may have with respect to your application. Please call Jay Curtis,
