RESOLUTION
WHEREAS, Victor Klein, the sole owner of the hereinafter
described real property has petitioned and requested that the
Board of County Commissioners consent to the vacation of all
roads, streets, avenues, alleys and park contained within that
part of the townsite of Kuner, Weld County, Colorado, and which
part of said Kuner townsite is described as follows:
That part of the North Half (NZ) of Section Twenty-five
(25), Township Five (5) North, Range Sixty-four (64) West
of the 6th Principal Meridian in Weld County, Colorado,
described as follows: Considering the East line of said
Section 25 to bear North and with all other bearings
contained herein relative thereto: Commencing at the
northeast corner of said Section 25; thence South along
the East line of said Section 25, 795.00 feet; thence West
47.50 feet to the northeast corner of Lot 1, Block 3; thence
South parallel to the East line of said Section 25 to the
northeast corner of Lot 1 of Block 4; thence West to the north-
west corner of Lot 9 of said Block 4; thence South to the
southeast corner of Lot 10 of said Block 4; thence West to the
southwest corner of Lot 12 of said Block 4; thence South to
the southwest corner of Lot 13 of said Block 4; thence West
to the southwest corner of Lot 27, Block 13; thence South
to the northwest corner of Lot 14, Block 12; thence East
to the northeast corner of Lot 14, Block 5; thence North
to the northeast corner of Lot 11 of said Block 5; thence
East to the northeast corner of said Block 5; thence South
47.50 feet distant from and parallel to the East line of
said Section 25 to a point on the South line of the North-
east Quarter (NE4) of said Section 25; thence West along said
South line to the southwest corner of the Northeast Quarter
(NE4) of said Section 25; thence North along the West line
of the Northeast Quarter (NE4) of said Section 25, 1,020.00
feet, more or less, to a point on the East line of the
Northwest Quarter (NW4) of said Section 25; thence north-
westerly to a point on the West line of said Northwest
Quarter (NW4) 92.00 feet South of the northwest corner
thereof; thence North along said West line to the northwest
corner of said Section 25; thence East along the North line
of said Section 25, 3,487.64 feet, more or less, to a point
of intersection with the southwesterly boundary of the Union
Pacific Railroad Right -of -Way, which is 50.00 feet distant
from, as measured at right angles to, the centerline of the
said Right -of -Way; thence southeasterly along the south-
westerly Right -of -Way of said Union Pacific Railroad 895.45
feet to a point; thence southwesterly to the southeast
corner of Lot 1, Block 18; thence continuing southwesterly
to the northwest corner of Lot 8, Block 16,; thence South
to the southwest corner of said Lot 8; thence East to the
southeast corner of said Lot 8; thence South to the south-
west corner of Lot 3, Block 15; thence northeast to the
southeast corner of Lot 2 of said Block 15; thence North to
the northeast corner of Lot 2 of said Block 15; thence East
to the northeast corner of Lot 1, Block 3, said point being
the True Point of Beginning.

WHEREAS, the Board of County Commissioners of Weld County has
satisfied itself that no roadway or part thereof will be vacated
so as to leave any land adjoining said roadway without an
established roadway connecting said land with another established
roadway, and
WHEREAS, it is in the best interests of the public and Weld
County, Colorado, to have the described roads, streets, avenues,
alleys and park in the townsite of Kuner, Weld County, as contained
in plat or map of same and within the hereinabove described tract
of land, vacated.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that all the roads, streets,
avenues, alleys and park in the townsite of Kuner, Weld County,
Colorado, as contained in said map or plat thereof, be and the
same are hereby vacated and closed, and that the Chairman of the
Board of County Commissioners of Weld County be authorized to
sign such a vacation deed on behalf of the Board of County
Commissioners and the people of the County of Weld, State of
Colorado.
PASSED AND ADOPTED, SIGNED AND APPROVED THIS 15th day of
April, A. D. 1964.

PETITION TO CLOSE ROAD
To the Board of County Commissioners, County of Weld, State of Colorado:
Victor Klein by and through his attorney, Rodger I. Houtchens, hereby
and close
petitions the Board of County Commissioners to vacate/all open roads within the
Northeast Quarter of Section Twenty-five (25), Township Five (5) North, Range.
Sixty-four (64) West of the 6th P.M., which are not constructed upon, and which
do not follow section lines, and which fall within that part of Kuner Townsite
which the undersigned seeks to vacate.
As grounds therefor the undersigned would show that he has provided
to the County easements around the east and north perimeter of the said Kuner
Townsite as a substitute for the County maintained road which presently traverses
the said Northeast Quarter of Section Twenty-five (25); that the granting of
the prayer of this petition will not close any road now open and maintained
by the County so as to deprive any owner of an access to a public road.
Further, the undersigned would show that he is the owner of the area sought
to be vacated with the exception of divided interests in minerals and of the land
on both sides of the road which he asks the County to close.
Rodger I. Houtchens, being first duly sworn upon oath, deposes and says:
That he is the attorney for the petitioner above named; that he has read the above
and foregoing petition, well knows the contents thereof and that the matters and
things therein stated are true of his own knowledge, information and belief.

WHEREAS, E. F. COTTIiOHAM and V. W. CONNER did on the 19th day of June, A. D. 1908,
take, execute and file in the office of the County Clerk and Recorder a certain map
or plst of the Townsite of Kuner, which map or plat is recorded in Book 4 of Maps,
Page 72A, Weld County Records, and
WHEREAT, Victor Klein has advised the Board of County Commissioners that ho intends
t.c; vacate part of the area subdivided into the Townsite of Kuner and has requested
that the Board of County Commissioners consent to the vacation thereof and join in
the vacation of all roads, streets, alleys, and park contained within that part of
Townsite of Kuner to be vacated by Victor Klein and hereinafter described, and
WHEREAS, the Board of County Commissioners has satisfied itself that no roadway cr
part thereof has been vacated so as to leave any land adjoining said roadway without
an established roadway connecting said land with another established roadway, and
WHEREAS, the Board of County Commissioners at a meeting thereof on the 15thiay of
11 , 1964 passed a resolution authorizing theChairman of the Board to
execute this vacation deed.
NOW, THEREFORE, the Board of County Commissioners acting through its chairman on
behalf of the County of Weld hereby vacates all streets, avenues, alleys and park
in the Townsite of Kuner, Weld County, Colorado, contained within the following
described tract of land, to -wit:
That part of the North Half (N 1/2) of Section Twenty-five (25),
Township Five (5) North, Range Sixty-four (64) West of the 6th
Principal Meridian in Weld County, Colorado, described as follows:
Considering the East line of said Section 25 to bear North and
with all other bearings contained herein relative thereto: Com-
mencing at the northeast corner of said Section 25; thence South
along the East line of said Section 25, 795.00 feet; thence West
