HomeMy WebLinkAbout991561.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST KEITH NORDEN AND JENNIFER GIDEA FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Keith Norden and Jennifer Gidea, VI #9900084, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of July, 1999, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Keith Norden and Jennifer Gidea were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals as hereinabove named to correct said violation. Parking semi trailers on property in the A(Agricultural) zone district. March 4, 1999 Five day letter sent. March 10, 1999 Thirty day notice sent. March 12, 1999 Keith Norden called the Department of Planning Services and scheduled an appointment with Sharyn Frazer, Code Compliance Officer, on March 24, 1999, at 10:00 a.m. March 24, 1999 Meeting between Keith Norden and Sharyn Frazer regarding the situation occurring on the property. Mr. Norden stated that the actual owners of the semi trailers are in Federal Bankruptcy Court. He explained that the Norden's Attorney is a Mr. Jeff Bedingfield. Mr. Norden requested an additional thirty (30) days to address this situation. He stated that currently they cannot put current license plates on the trailers or move them from the property because they are not the actual owners. May 12, 1999 Letter sent to Mr. Norden from Sharyn Frazer requesting an update on the noncompliance issues. June 18, 1999 Progress inspection. At least 13 trailers and a couple of cabs remain parked on the property. Violation hearings were not scheduled for June, due to staff conflicts. This violation will be scheduled for the July 13, 1999, hearings. July 1, 1999 Photographs were taken with the digital camera. July 1, 1999 Letter sent to Mr. Norden scheduling him to appear before the Board of County Commissioners at violation hearings on July 13, 1999, at 10:00 a.m. The Department of Planning also recommends that the County Attorney be authorized to proceed with legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties.
