RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST RAY MITCHELL FOR VIOLATION OF THE WELD
COUNTY ZONING AND BUILDING CODE ORDINANCES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ray Mitchell, VI #9800089, is allegedly in violation of the Weld County
Zoning and Building Code Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of July, 1999, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Ray Mitchell, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until September 13, 1999, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Ray Mitchell to remedy the violation of the Weld
County Zoning and Building Code Ordinances, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until
September 13, 1999, to allow adequate time for the property owner to bring the subject
property into compliance.

CASE SUMMARY
June 22, 1998 Site inspection. Sharyn Frazer, Code Compliance Officer, met with Ray Mitchell on the
property to discuss the noncompliance issues occurring.
June 23, 1998 Thirty day notice sent
August 7, 1998 Progress inspection. Building materials stockpiled on the property to continue building
the fencing and to start work on the structure.
August 10, 1998 Ray Mitchell met with Sharyn Frazer to pick up the building permit application. He
stated that he is scheduled for surgery and will not be able to start work for
approximately two months. Mr. Mitchell also stated that he is residing in Sterling,
Colorado, and will not inhabit the structure or the mobile home.
October 15, 1998 Site inspection conducted by Dan Parkos, Environmental Protection Services and
Sharyn Frazer. It was determined that the condition of the property had worsened.
Sharyn Frazer spoke with Dave Sprague, Building Official and it was agreed that a
combination inspector and an electrical inspector would conduct an inspection of the
structure (old Weld County grader shed).
October 15, 1998 Substandard building inspection checklist. (See attached packet).
October 16, 1998 Telephone call between Ray Mitchell and Sharyn Frazer. He reiterated that he is not
attempting to live in the structure and that he is only at the site to conduct clean up
activities.
November 17, 1998 Voice mail message left by Ray Mitchell on Sharyn Frazer's voice mail. He stated that
he was checking in and should be able to start work within a month.
November 19, 1998 Memorandum to Dan Parkos, Environmental Protection Services from Sharyn Frazer,
updating the status of the property.
December 1, 1998 Periodic site inspections conducted from December 1, 1998 through March 31, 1999.
April 5, 1999 Ray Mitchell and his sister came into the Department of Planning Services to apply and
pay for a temporary electrical permit to provide electricity to the property to continue
to clean up and build fence. Discussion followed regarding habitation of the structure.
Mr.Mitchell stated that he is not, and will not attempt to reside in the structure until the
building permit is finaled.
April 6, 1999 Electrical Permit EL-9910050,was issued. Dave Sprague, Building Official documented
that no other buildings or equipment(other than portable tools) are to be permanently
connected to the service.

May 10, 1999 Progress inspection conducted. Clean up is occurring.
June 25, 1999 Sharyn Frazer met with concerned citizens in the area. It was stated that it appears that
Mr. Mitchell is attempting to reside in the mobile home based on observing lights in the
structure, at night.
June 25, 1999 Site inspection of the property. Mr. Mitchell was on site and did admit that he has been
staying in the mobile home. Sharyn Frazer explained that she would schedule him to
appear at violation hearings.
July 1, 1999 Letter to Ray Mitchell scheduling him to appear before the Board of County
Commissioners at violation hearings on July 13, 1999, at 10:00 a.m.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.

Attorneys Office.

Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation, Our records indicate that

COLORADO Subject: Buckingham Townsite
Updates of the situat.ons with Patrick O'Brien , 56731 Nebraska Avenue, and Ray Mitchell 11780 DeFord, both
located in the Townsite of Buckingham.
Patrick O'Brien has almost reached compliance with the noncommercial junkyard issues of VI-9800090. The
existing septic and cistern are currently supplying the required services. He has been in contact with Jim
Sheehan, Housing Authority, and is working toward submittal of the required paperwork for a new well and a
new septic system. He won't be able to file for assistance until after the first of the year (1999), because the
Housing Authority won't have the funding available until then. Jim Sheehan will review Patrick's submittal to
determine if he qualifies. Patrick is adamant that he will pursue this avenue as a course of action to achieve
complete compliance.
Ray Mitchell has had surgery and is currently living in Sterling with his mother. Through telephone conversations
he has been instructed that he may not, at any time, reside in the structure located at 11780 DeFord. Building
and Electrical Inspectors conducted inspections at this site and it has been determined that the building is
structurally unsound, and there is no electricity connected to this site, at this time. I have enclosed a copy of their
findings. I have also instructed Mr. Mitchell that once he is capable of doing the work (6-8 weeks), he will need
to address the noncommercial junkyard issues and obtain current building, septic and well permits.
Both of these individuals have been very dedicated to working with the County to bring these properties into
compliance. The Department of Planning Services recommends that adequate time allowances be granted. If
you should have any questions, please contact me.

Hazardous,-or Unsanitary Premises.
Those premises on which an accumulation of weeds, vegetation,
junk, dead organic matter, debris, garbage, offal, rat harborages,
stagnant water, combustible materials and similar materials or
conditions constitute fire, health or safety hazards as determined
by the Weld County Health Department - 12. 13. 11
Inadequate Exits.
Except for those buildings or portions thereof which have been
provided with adequate exit facilities conforming to the
provisions of this code, buildings or portion thereof whose exit
facilities were installed in violation of code requirements in
effect at the time of their construction or whose exit facilities
have not been increased in number or width in relation to any
increase in occupant load due to alterations, additions or change
in use or occupancy subsequent to the time of construction shall
be considered substandard. Notwithstanding compliance with dode
requirements in effect at the time of their construction,
buildings or portions thereof shall be considered substandard when
the building official finds that an unsafe condition exists
through an improper location of exits, a lack of an inadequate
number or width of exit, or where other conditions exist which are
dangerous to human life - 12. 13. 12
Inadequate Fire-protection or Fire-fighting Equipment.

fire-resistive construction or fire-extinguishing systems or

Reference to occupancy of the town site of Buckingham, Colorado
located in Section 33-8-59 Weld County.
As it had been many years that the Town of Buckingham had any
dwellers, it was a surprise to residents that suddenly it became
such a popular place for folks to become dwellers upon. It
was also startling that when folks made a decision to move into
this area so many changes took place.
I would like to address some concerns that are already covered
by zoning regulations for health and safety of the general
community.
A permit for a. "non-commercial salvage yard"has been issued
to Ray Mitchell . A non-commercial salvage yard means you may
junk items out - but not buy or sell from the premises - but
what does it allow you to store and how?
At the present Mr. Mitchell has several extremely well used
house trailers , that is in close proximity to some scrap wood
piles that are near as high as the trailers . This provides
an extreme fire danger as this is old dry wood. . This is also
a haven for rodents - especially skunks . Although he has dogs,
rodents have a way of surviving.
The shop he is attempting to redo at one time was the property '
of Weld County, used a a maintenance shed.It still has a buried
fuel tank in the building. As I understand the property was
purchased as is by a Ken Thompson and conveyed to Mitchell as
is. There are Federal and State regulations reguarding buried
fuel tanks and people dwelling around them. How is this to
be addressed? The removal of fuel tanks is quite expensive.
Will this tank be converted to a sewage system some time in
the future?
At present there is not a sewage system on the property as there
is not any water, unless it is being hauled in, on 2 lots that
are approximately 75 ' by 140 ' and taken up by many other
items,where will a leach field go ? Will the neighboring land
owners find that they are encroached upon without their knowledge
or consent ?

Is the option to have an outdoor privy or outhouse ? Where
does it drain to?
Trash has become a problem as a neighbor. I have sheet metal
and fiber glass insulation blowin into my hay field. And there
are dogs at large which limited my useing a pasture in Buckingham
for grazing as I have done in the past years.
Buckingham is also on the bad weather route for the Pawnee
Pioneer Trails Scenic and Historic Byway, which is visited by
several thousand people from all over the world, as it is
adjacent to Colorado Highway 14 . I have had inquiries as to
what happened to the town site as it is covered with "trash" .
This is by local people that travel this way as well as
outsiders .
For the safety of the "dwellers" and the ajoining property owners
these concerns are being expressed.

solutions there may be to the situation as it exhists.
