HomeMy WebLinkAbout991517.tiff HEARING CERTIFICATION DOCKET NO. 99-39 RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1227 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (MANUFACTURING OF ANIMAL CONFINEMENT STRUCTURES)IN THE A(AGRICULTURAL)ZONE DISTRICT- JACK WALKER A public hearing was conducted on June 23, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tern Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Anne Best Johnson Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 9, 1999, and duly published June 12, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Jack Walker for an Agricultural Service Establishment (manufacturing of animal confinement structures) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Anne Best Johnson, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Johnson gave a brief description of the location of the site which will be accessed from Weld County Road 20 on the north, and stated the operation will employ 15 people, there will be no animals housed on-site, and three of the eight referral agencies did not respond. She described the surrounding uses and stated on April 1, 1999, the Department of Planning Services staff approved Recorded Exemption #1039. Ms. Johnson submitted Exhibits marked E, F, G, H, I, and J, and indicated there are typing errors in the Planning Commission Resolution which need to be corrected. In response to Commissioner Geile, Ms. Johnson stated Conditions of Approval #2.0 and#2.F have peen addressed and should be deleted. Commissioner Kirkmeyer commented there is an error in Condition of Approval #2.E which needs to be corrected. Jack Walker, applicant, stated there is very minimal waste generated in the manufacturing of portable livestock confinement structures and he has reviewed and agrees with the Conditions of Approval and Development Standards with the discussed changes. No public testimony was offered concerning this matter. Ms. Johnson stated Development Standard #9 needs to be amended to indicate the existing well will be used for irrigation only and the applicant is applying for an additional well for domestic uses. 991517 �L Pit PL1312 HEARING CERTIFICATION - JACK WALKER (USR #1227) PAGE 2 Mr. Walker explained the second permit is for a commercially exempt well to be used in the facility only and will be recycled in the septic system. Commissioner Kirkmeyer stated Development Standard#9 should state, "The facility shall use the existing well for irrigation only," which implies an additional well will be necessary for drinking water and domestic use. Commissioner Kirkrneyer moved to approve the request of Jack Walker for a Site Specific Development Plan and Special Review Permit #1227 for an Agricultural Service Establishment (manufacturing of animal confinement structures) in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, and delete Conditions of Approval #2.0 and #2.F, re-letter the remaining sections, amend Development Standard #9 to state, "The facility shall use the existing well for irrigation only," and correct all of the typing errors. The motion was seconded by Commissioner Vaad, and it carried unanimously. This Certification was approved on the 28th day of June, 1999.
