WELD COUNTY COUNCIL

The Weld County Council met in regular session in full conformity with the Weld
County Home Rule Charter at the Weld County Centennial Center, 915 10th Street in
Greeley, Colorado, Wednesday, December 6, 1995, 7:30 p.m.
ROLL CALLS The meeting was called to order by President Jim Gardner and the
following members were present, constituting a quorum of the members thereof: Vice
President Stephanie Hayward, Councilwoman Judy Curtis, Councilman Ralph
Campbell, and Councilwoman Pam Malcom. Also, present were: M.D. and Sharon
Hopper, June Gordon, Artie Elmquist, Nickey Jean Wilson, Kerry Jarris, Janet
Meisinger and the Council secretary.
APPROVAL OF MINUTES: Councilwoman Judy Curtis made a motion, seconded by
Councilman Ralph Campbell, to approve the November 6, 1995 meeting minutes. The
motion carried unanimously.
ADDITIONS TO THE AGENDA: At her request Janet Meisinger was added after
Sharon Hopper under public comments. President Jim Gardner added to new business
the letter from the third grader at Butler Elementary School. Bud Hopper and Artie
Elmquist also asked to speak during public comments.
APPOINTMENTS: Vice President Stephanie Hayward will try to attend the December
11, 1995 Elected Officials' Meeting. Councilman Ralph Campbell and Vice President
Stephanie Hayward will decide which of them will be speaking to the Planning
Commission at its February 6, 1995 meeting. The Council will decide at its January
meeting how many of its members will attend the January 23, 1995 Communications
Advisory Meeting. The secretary will send the agenda of that meeting to Council
members it is available. President Jim Gardner handed out copies of the 1996
schedule for the Elected Officials Meetings, noting that the time had been changed
from 10:00 a.m. to 1:30 p.m..
PUBLIC COMMENTS: Mr. Bud Hopper asked the Council to investigate the legality of
the County Commissioners' Emergency Ordinance#185. Mr. Hopper believes that
Ordinance #185 is illegal because it does not state the nature of the emergency as
required by the Home Rule Charter, Section 3-14-(6).
Mr. Artie Elmquist asked the Council to look into why the state juvenile detention
facility in Greeley does not require approval of citizens. Mr. Elmquist stated his
concerns regarding the County issuing occupancy certificates for prison facilities that

Weld County citizens have not approved. Mr. Elmquist asked the Council to explore
the early-an time line about the state's need for the land for juvenile detention facility.
He said that early-on it had been said that there was not time for voters to vote on the
facility. But, the state ultimately decided to build in Greeley after the Charter
amendment stating voters would be allowed to vote on such facilities.
Vice President Stephanie Hayward said that the Council needs to research who
will issue the occupancy certificates for prison facilities on "0" Street. She also felt that
the Council should research the Colorado State Statues regarding when state powers
supersede county and city powers. President Jim Gardner wanted to research if
County law voids cities' rights.
Sharon Hopper asked the County Council to review the right of County citizens
to vote on the construction of the State Juvenile Detention Facility in Greeley. She said
that since voters approved the amendment to vote on such facilities BEFORE this land
was given to the state, a citizen vote is needed.
Mr. Hopper will send to Councilman Ralph Campbell information regarding
reimbursements for vested rights that Mr. Elmquist referenced in his outlining of the
court case regarding the Del Camino pre-parole facility.
Councilman Ralph Campbell said that he would find answers to these questions.
Who will issue the occupancy permit for the juvenile facility? Who owns the land?
When did the ownership of the land change? Councilman Ralph Campbell will report
to the Council answers to these questions.
Sharon Hopper requested that the Council look into the cost to citizens of getting
copies from Weld County. Ms. Hopper felt that $1.50 charge per page was too much.
Sharon expressed concern that the Commissioners are already in a contractual
agreement with The Villa, and the Commissioners were not forthright with that
information.
Councilman Ralph Campbell asked Sharon Hopper to give him an approximate
date when it was stated by the Commissioners that they did not have a contractual
agreement with The Villa. Councilman Ralph Campbell said that the Council would get
a copy of the contract between the Commissioners and The Villa. Mrs. Hopper said
that perhaps the Commissioners were saying that they had no pre-parole agreement
with The Villa.
Janet Meisinger of Dacono spoke to the Council about the matter of jurisdiction
and misconstruction of government. She explained the activity of common law courts
being formed across America including Weld County. She also outlined the differences
between the national and state corporate and de jure governments.
CORRESPONDENCE:
President Gardner gave the list of 1996 Commissioners Coordinator assignments to
Council members. He also noted the mileage increase to twenty-seven cents per mile
in 1996.

COORDINATOR REPORTS:
Councilwoman Judy Curtis reported the contacts she had made regarding the
emergency on the Pawnee Grasslands in October. She stated her opposition to
staffing the dispatchers with EMTs. However, she felt that there needed to be a
specific procedure or list of questions asked by dispatchers during emergency calls.
Councilwoman Judy Curtis and Councilwoman Pam Malcom said that the Council
should discuss these matters with the Communications Advisory Board.
Councilman Ralph Campbell said that former Councilman David Young had previously
researched concerns about rural emergencies. It appeared to Councilman Ralph
Campbell that the Council's previous concerns were now happening. Councilwoman
Stephanie Hayward wondered if anything had changed procedurally since the City of
Greeley was handling emergency calls, and had anything changed since the Pawnee
incident.
The Council asked Council members Judy Curtis and Pam Malcom to prepare a list of
questions for the Communications Board. It was agreed that any such questions or
concerns should be sent to the Communications Board before any meeting that the
Council would have with the Board.
OLD BUSINESS:
CCI Conference
President Jim Gardner reported on the CCI November Conference. Councilman Ralph
Campbell suggested that President Jim Gardner write a letter to the Commissioners
regarding the value of the conference and his experience there.
December 5 Work Session
Action regarding the Council's December 5 Work Session was assigned to the January
agenda.
1996 Council Budget
Vice President Stephanie Hayward said that as many Council members as possible
should attend future Council Budget Hearings. Councilman Ralph Campbell expressed
pleasure in Don Warden's presentation for the County Council. Councilman Campbell
felt that there should be a way to reward County departments for NOT spending all
their budgets. He expressed that government personnel are currently motivated to
spend all their budgets and ask for more. He mused that, in contrast, there should be a
way "savers" could be rewarded.

Council Letters
The Council discussed the timing of sending proposed letters to the Sheriff. Vice
President Stephanie Hayward was asked to compose a letter referencing the Home
Rule Charter. President Jim Gardner was asked to hand deliver the letter referencing
the September 6, 1995 Council motion. It was decided that signatures of all Council
members should be on any letters sent.

Vice President Stephanie Hayward made a motion, seconded by Councilwoman Judy
Curtis, to pay the following bills: Councilman Ralph Campbell - $ 22.00

Council's January 1996 Meeting Date
Councilwoman Pam Malcom made a motion, seconded by Vice President Stephanie
Hayward that the County Council meet January 3, 1996 at the Weld Centennial Center,
915 10th Street, Greeley, CO at 7:30 p.m.
Letter from Butler Elementary School
It was decided that the Council would invite the third graders of Class E-8 of Butler
Elementary School to the January Council meeting. The invitation would ask the third
graders to present their case for a Colorado State Insect in person. The Council felt
that this would be an opportunity for students to get involved in their government. Vice
President Stephanie Hayward also suggested that invitations to future Council
meetings be extended to area high school students.
Secretarial Research Requests
Council secretary will be attending the County training for Banner.
Designing an evaluation form for the Council secretary was assigned to Councilwoman
Judy Curtis.
Customer Service material from Mr. Don Feldhaus was distributed to Council members.

Councilwoman Judy Curtis requested secretarial research into the background of
Ordinance#173-C. Specifically, she wanted the history of the ten-year time
requirement for recorded exemptions. Council members requested a copy of
Ordinance#173-C
President Jim Gardner, Vice President Stephanie Hayward, and Councilman Ralph
Campbell want a copy of the final Comprehensive Plan.
ADJOURNMENT: The meeting was adjourned 10:40 p.m.

REPORT TO THE PEOPLE
January 3, 1996
The Weld County Council is mandated by the Home Rule Charter of Weld
County, Colorado, to report to the people the events that have shaped the previous
quarter. This report summarizes the activities of the Weld County Council during the
fourth quarter of the calendar year 1995.
The County Council met in a special session September 5, 1995 in the
Centennial Center. The Council went into executive session to obtain legal advice
regarding possible conflicts of interest when the Council may review matters arising
from or pertaining to the Weld County Sheriffs Office. This was a concern because
two of the current Councilwomen are married to men working for the Weld County
Sheriffs Office.
The September 6, 1995 Council meeting was convened at the Pierce Town Hall.
Gary McCabe, Director of Weld County Ambulance Service and Mr. John Pickle,.
Director of Weld County Health Department, were present. They each gave
presentations regarding the services offered by their departments and the direction
these departments are currently taking. Council members heard from President Jim
Gardner regarding his meeting with Sheriff Jordan about the Grover Rodeo problems.
The Council passed a motion to recommend to the Sheriff that volunteers, posse
members, and Sheriff officers wear plainly displayed name tags indicating their status
in the Sheriff Department. Council members also voted to send Councilwoman Judy
Curtis an InterNet workshop as this would be a source of information for Council
business.
October 4, 1995 the County Council met at the Weld County Centennial Center
in Greeley. The Council set goals for a work session to be conducted on County
customer service forms.
The Council met at the Weld County Centennial Center in Greeley November 6,
1995. Councilwoman Judy Curtis reported an ambulance dispatch problem on the
Pawnee National Grasslands during October. Council members were assigned to get
more information about this emergency and the response system available in rural
areas of Weld County.
President Jim Gardner reported his work on the Referendum/Initiative checklist.
He talked about impact fees from developers for schools, and the possibility of
incorporating them into the County's Comprehensive Plan. Councilman Ralph
Campbell committed to speak with County Clerk and Recorder Suki Tsukamoto
regarding election campaigning by elected officials.
A motion was passed to send President Jim Gardner to part of the November
CCI meeting as the Council's representative. Councilwoman Judy Curtis reported on
the Council's 1996 Budget Hearing with the County Commissioners. The Council work
session was scheduled for December 5 at the Ramkota. Councilman Ralph Campbell
had arranged for a guest speaker, Mr. Don Feldhaus, from the Center for Quality
Improvement and Customer Service at Aims College.
December 6, 1995 the Council met at the Weld County Centennial Center in
Greeley. Mr. Bud Hopper, Mr. Artie Elmquist, and Mrs. Sharon Hopper, asked the
Council to look into their concerns. The concerns focused on County Ordinance #185,
the state juvenile detention facility planned in Greeley, and the Pre-parole facility to be
built in Del Camino. Janet Meisinger spoke to the Council about jurisdiction and
misconstruction of government, and the activity of common law courts in America.

regarding its activities. The County Council believes that the Weld County
Home Rule Charter continues to be a viable tool for the citizens of Weld County.
