HomeMy WebLinkAbout950823.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1713 - MATLOCK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1713, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1713 was submitted by William T. Matlock, 8601 Weld County Road 8, Brighton, Colorado 80601, for property which is located in the NWV4 of Section 22, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS,this request is to divide the property into parcels estimated to be approximately 61.5 acres and 18.5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1713 submitted by William T. Matlock be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. It shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 3. Dear Commissioners: This request for a recorded exemption is submitted by William T. Matlock. The parcel of land on which this request is being made is described as the W2,NW4 of Section 22, T1N, R66W of the 6th P.M., Weld County, Colorado. The property is located east of and adjacent to Weld County Road 31 and south of and adjacent to Weld County Road 8. This request is to divide a 80 acre parcel into two parcels of 61.5 acres and 18.5 acres, more or less. Currently both proposed lots are vacant farm ground. The property is located within the Urban Growth Boundary area of the Town of Lochbuie, City of Fort Lupton and City of Brighton. The Town of Lochbuie had no conflict of interest. No response was received from Fort Lupton. The City of Brighton had no conflict of interest but have concerns that if there is no end to exemptions what will happen to agricultural land? The Department of Planning Services' staff recommends denial of this proposal based on the lack of efficient and orderly development and inconsistency with the agricultural goals and policies as stated in the Weld County Comprehensive Plan. The applicants currently have the legal right to place a single family dwelling on the existing 80 acre parcel. This request, if approved, would allow for a residence on both Lots A and B, greatly intensifying the residential uses on the property thus reducing the agricultural use of farm ground. The A (Agricultural) Zone District was established to promote and maintain agriculture as a vital support element for Weld County Citizens, and not be continually decreased for residential development. Matlock Page 2 It is staffs opinion that this proposal does not encourage or enhance agricultural land uses as intended by the Comprehensive Plan. Agricultural Policy#1 states: "The agricultural zone district is intended to preserve prime agricultural land and to provide areas for agricultural activities and uses dependent upon agriculture without the interference of incompatible residential land uses." The 18.5 acre property is identified as prime farmground by the Department of Agriculture Soil Conservation Service. Staff does not see the benefits to the Agricultural Zone District for establishing the potential for increased development at this location. Due to the above stated reasons,the Department of Planning Services' staff requests that the Board of County Commissioners deny this recorded exemption request. It is the staffs opinion that this proposal does not meet the criteria for approval as stated in Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance, nor does it comply with the Weld County Comprehensive Plan. Explain the reason for the proposed recorded exemption and how each proposed lot will be used. The smaller lot(approximately 18.5 acres) includes approximately 1 acre of reservoir and 10 acres of wetlands and wildlife habitat. The remaining 7.5 acres will be used for a house,barn,garden, corals and tree rows. The larger lot(61.5 acres)will continue to be used entirely for agricultural purposes-partially for dry land pasture grass with limited grazing and partially for wildlife habitat such as tree rows, native grasses, milo and other ground covers. 2. Describe the location,size and present use of the area where each proposed new lot will be created. The two lots will be separated by the natural boundary formed by the Brighton Lateral Ditch running through the property. The smaller lot is to the northwest of the ditch. It is partially covered by a reservoir which lies mainly on the adjoining property to the west. There are approximately 11 acres of wetlands and trees. The rest of the smaller parcel(approx. 7.5 acres)has historically been planted in wheat(currently fallow). The larger lot has all been used for wheat in recent years with every other year in fallow. The larger parcel will continue to be used entirely for agricultural purposes. Some of what has historically been planted in wheat and left fallow every other year will be used for native grasses and windbreaks. This plan would maintain the agricultural use of the land while significantly reducing the amount of soil erosion by the use of native perennial grasses and tree rows. 3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan (if applicable). The parcel is being divided to create a lot for a single family residential building site. The site does not lie within a flood plain nor geologic hazard area. It does appear to lie within the 3 mile urban growth boundary of both Brighton and Ft. Lupton. 4. Explain how the use permitted will be compatible with existing uses surrounding the proposed recorded exemption. The surrounding area is agricultural property,primarily small farms, with parcels varying in size from 3 to 280 acres. As you go southwest towards Brighton or northwest towards Ft. Lupton,the parcels are notably smaller with some developments. A sizable development of 10 acre parcels lies one mile east. Conversely,the area to the northeast is comprised of larger farms. The two parcels created by this recorded exemption, 18.5 and 61.5 acres, are compatible in size with the surrounding area, and would continue to be used for agricultural and rural residential purposes, similar to the surrounding area. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. The parcel is zoned agricultural and will continue to be used for agricultural purposes. 6. Explain how the proposal is consistent with efficient and orderly development. The agricultural use of the land will continue on both sides of the natural boundary created by the Brighton Ditch Lateral. The two parcels being created are compatible in size and use with other parcels in the immediate area. 7. Explain how adequate provision for the protection of the health,safety,and welfare of the inhabitants of the neighborhood and the County will be accomplished. There is already access to each parcel on both sides of the Brighton Lateral Ditch which will serve as the boundary between the two parcels. The two access roads are used for access to the irrigation ditch easement and oil and gas equipment located on the property. One new access from WCR 8 is proposed at the intersection with WCR 31 to be used as a driveway upon the existing road right-of-way along the west boundary of the smaller lot. The owner plans to work with the Soil Conservation District to establish tree rows for wildlife habitat and to reduce wind and water erosion. The proposed dry land pasture grass will also reduce wind and water erosion since there would always be a ground cover instead of the land being plowed up and susceptible to soil erosion.
