The application materials indicate water will not be necessary for the new building and bathrooms are located at the applicants house, approximately one hundred and twenty (120 ft) away. The following conditions are recommended to be part of any approval: I) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2) No permanent disposal of wastes shall be permitted at this site. 3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4) Prior to recording the plat,the applicant shall submit a waste handling plan to the Environmental Protection Services Division of the Weld County Health Department. The plan shall include at a minimum 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 5) Fugitive dust shall be controlled on this site. 6) The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 7) All pesticides,fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner. The applicant is indicating that the proposed structure will be used for personal use, primarily for boat and vehicle storage and provide an area for wood working. Storm water drainage does not appear to be a problem. The open pasture section will absorb any runoff that may occur. -he front of the site is fully developed and landscaped. The rear of the property will be accessed through an existing gravel lane. Ute Lane is a dead end cul-de-sac and does not carrying any through traffic. PROJECT OVERVIEW AND BACKGROUND: The request is for a 30-foot by 60-foot (1,800 sq. ft.) garage and workshop for personal use. Mr. Rathe intends to utilize the garage to store his vehicles and a 17- foot-long fishing boat as well as a place to do his woodworking. Existing on the site is a single-family home with an attached 22-foot by 32-foot garage, and a 12-foot by 25-foot storage shed. The proposed garage and workshop will be constructed in the location of the existing shed and will have a minimum 25-foot setback from the nearest property lines. (See Attachment B.) The property is 1.2 acres and is located in the Arrowhead Subdivision. The property is located outside the City's Long-Range Expected Growth Area (LREGA) and Mid-Range Expected Service Area (MRESA), but within the three-mile area of influence. The property is south of 37th Street and is within the City of Evans future growth area. By virtue of Section 19-7 of the City Charter and the Weld County Policy of referring land-use proposals for review and comment to appropriate jurisdictions, the proposal is within the purview of the Greeley Comprehensive Plan. SITE DATA: Property Zoning County .A (Agricultural) Surrounding Zoning County A (Agricultural) Surrounding Land Uses Residential Lot Size 1.2 Acres KEY ISSUE: Does the request comply with the Greeley Comprehensive Plan? ANALYSIS: The applicable City Comprehensive Plan policies which address the proposed use for this property include: Comprehensive Plan Policy 4.3 All development is encouraged to promote compatibility among neighboring land uses of differing intensity and character. These efforts, where practical and appropriate, should include complementary landscaping, building massing, material selection, and site design. Staff Comment: The area consists predominantly of large-lot single-family uses. Accessory uses include horses and large garden areas, which are accompanied by small pole barns and accessory buildings. The applicant has indicated that the structure will be for personal use only. It is staffs opinion that the proposed use of the garage, boat storage, and woodshop would be compatible with the area as long as it is for personal use and not for business or for commercial uses. Additional landscaping should be installed and be complementary to the existing home and garage. The Greeley Development Code states that an accessory structure shall be subordinate to and customarily found with the principal use of the land and shall not exceed sixty percent (60%) of the main floor area or height of the principal building, except in the H-A Zone. In this case, the main floor area of the principal building is 2,324 square feet, resulting in a limit of 1,394 square feet for the accessory building. The proposed accessory building is 1,800 square feet. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Administrative Review Team members informally reviewed this proposal at its meeting on November 4, 1998. Even though the site is located in the Johnstown/Milliken Fire Protection District, there were a couple of comments from the representative from the Union Colony Fire Rescue Authority: (1) The access to the garage should be 20 feet wide in order to meet fire safety requirements. Also this access drive needs to be maintained by the home owner to the standards of the fire authority; and (2) The oversized garage needs to be within 500 feet of a fire hydrant. PLANNING STAFF RECOMMENDATION: The Planning staff recommends to the City of Greeley Planning Commission that a recommendation be forwarded to the Weld County Planning Commission that the Use by Special Review permit be approved.
