A public hearing was on May 21, 1997, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 14, 1997, and duly published April 17, 1997,
in the South Weld Sun, a public hearing was conducted to consider the request of Flatiron
Structures Company, do Quinlan Construction, Inc., for a Site Specific Development Plan and
Planned Unit Development (PUD) Final Plan, S #418, for C-3 (Commercial) uses. Chair Baxter
informed the applicant that should a tie vote occur, since only four Commissioners are present,
Commissioner Webster would review the record and cast the deciding vote. Lee Morrison,
Assistant County Attorney, made this a matter of record. Gloria Dunn, Department of Planning
Services representative, stated the Change of Zone for this property was approved in 1995, and
she discussed water, sewer, access, landscaping, etc. She stated the Site Plan Review process
will be applicable for development and an improvements agreement including $7,000.00 collateral
will be submitted for the Board's review and approval. Ms. Dunn referenced Conditions of
Approval#3.A. and#4.0. concerning satisfaction of certain requirements of the St. Vrain Sanitation
District prior to release of building permits, and Conditions of Approval #3.B. and #4.1. concerning
the Colorado Department of Transportation's (CDOT) request to review auxiliary lanes, which will
be constructed at the cost of the applicant. Ms. Dunn then entered the favorable recommendation
of the Planning Commission into the record as written, correcting a clerical error in the second
sentence of Reason #2.B. to reflect Section 33, rather than 32, of the Zoning Ordinance.
Responding to questions from the Board, Ms. Dunn explained "Public Works Department" was
deleted from Condition of Approval#3.B. since only CDOT and Planning need to review the off-site
road agreement. Gary Shaw, Vice President of Quinlan Construction, Inc., represented the
applicant and stated he has been working on this development project for one and one-half years
and confirmed all requirements have been met. He confirmed for Chair Baxter that all Conditions
of Approval, including the changes, are agreeable. No public testimony was offered concerning
this matter. Commissioner Kirkmeyer moved to approve the request of Flatiron Structures
Company, do Quinlan Construction, Inc., for a Site Specific Development Plan and Planned Unit
Development (PUD) Final Plan, S #418, for C-3 (Commercial) uses, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval as entered into the record, including the correction to Reason #2.B. The motion was
seconded by Commissioner Harbert, and it carried unanimously.
