We have compiled numerous recommended conditions and standards. We have attempted to simplify our referral by separating the proposed conditions into conditions of approval and development standards. The following are recommended to be conditions of approval: 1. Prior to recording the plat: A) The facility shall demonstrate compliance with the Confined Animal Feeding Operations Control (CAFO) Regulation. This shall be demonstrated by submitting a comprehensive manure and waste water management plan, for a 5,000 head dairy, to the Weld County Health Department for review and approval. This plan shall include, but not be limited to the following: (1) Demonstration that all manure stockpile areas and waste water collection, conveyance, and retention facilities are adequately constructed and sized to handle a twenty-five year,twenty-four hour storm event. This shall be conducted by a Registered Professional Engineer . (2) Demonstration that any existing or proposed waste water retention structure has, or will be, constructed in accordance with the criteria described in the CAFO Regulations. This shall be conducted by a Registered Professional engineer. (3) A site map demonstrating the layout of the site. This should include the locations of all pens, structures, feed storage areas, any water courses through the property, manure storage areas, lagoons, etc. (4) A surface contour map which demonstrates all surface water control features on the site. This should include surveyed surface elevations, indicate flow direction, run-on control features, etc. (5) Demonstration that the facility has the ability to manage and/or land apply manure and waste water at agronomic rates in accordance with the CAFO regulations. EXHIBIT /0 982255 Bella Holsteins, Inc. USR-1195 Page 2 (6) Demonstration that adequate measures are in place to prevent any discharges except those which are allowed by the CAFO Regulations. (7) Other necessary measures which are required in order to comply with the CAFO Regulations. B) The facility shall demonstrate compliance with Section 47 of the Weld County Zoning Ordinance. C) In accordance with CAFO, the applicant shall submit the facility's manure and waste water management plan to the Colorado Department of Public Health and Environment for review and comment. D) The Weld County Health Department was unable to find septic permits for the septic systems serving the existing housing units, the office, or the hospital. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an ISDS evaluation. In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with the current Individual Sewage Disposal System Regulations. 1) The septic systems serving the office and the hospital must be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Protection Division of the Weld County Health Department. In the event the system shall be brought into compliance with current regulations. The following are recommended to be development standards: 1. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance, at all times, with the dust abatement plan included in the application materials. The dust abatement plan is included in the document, titled Management Plan for Nuisance Control, dated May 30, 1998. 2. All liquid and solid waste shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. There shall be no permanent disposal of solid wastes, as defined in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site. Bella Holsteins, Inc. The facility shall maintain compliance with confined Animal Feeding Operations Control Regulations (5 CCR 1002-19) and, Section 47 of the Weld County Zoning Ordinance, as amended. 5. The maximum permissible noise level shall not exceed the light industrial limit of 70 db(A), measured according to Section 25-12-102, C.R.S. 6. Any required NPDES Permit shall be maintained in compliance with the Water Quality Control Division of the Colorado Department of Public Health& Environment. 7. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance, as amended. 8. The facility shall not discharge run-off or other waste waters to surface or groundwater with exception to what is allowed by the Confined Animal Feeding Operations Control Regulations. 9. Wastes materials, not specifically addressed by other development standards, shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 10. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff The surface beneath the manure storage areas shall be of materials which are protective of State waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operations Control Regulation(5 CCR 1002-19). 11. The facility shall be operated in a manner that controls odors. The facility shall operate, at all times, in accordance with the odor abatement plan provided in the application materials. The odor abatement plan is included in the document, titled Management Plan for Nuisance Control, dated May 30, 1998. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional odor controlling measures shall be implemented at the request of the Weld County Health Department in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to- one dilution threshold, or in the judgement of the Weld County Health Officer, there exists an odor condition requiring abatement. Bella Holsteins, Inc. USR-1195 Page 4 12. The facility shall maintain records on-site, available for inspection during business hours, at all times, which demonstrates the following: A. That the waste water collection and storage facilities are adequately constructed, and sized to handle a 25-year 24-hour storm event. B. The manner in which manure and waste water has been removed and applied to land. This should also include any agreements between the facility and other parties concerning the off-site removal of manure or waste water for land application, treatment or disposal. C. The method in which waste water and/or manure will be applied to land, including the procedure which will be used to insure that agronomic rates are not exceeded. 13. A spillage retention berm shall be required around any fuel container with a volume greater than 50 gallons. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. 14. The facility shall be operated in a manner to control flies. The facility shall be operated in accordance, at all times, with the pest control plan included in the application materials. The pest control plan is included in the document, titled Management Plan for Nuisance Control, dated May 30, 1998. Additional fly control measures shall be implemented at the request of the Weld County Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition or in the event the Weld County Health Department receives a significant number of fly (associated with facility) complaints, and in the judgement of the Weld County Health Officer, there exists a fly condition requiring abatement. 15. Any septic system located on the property must comply with all provisions of the Weld County Individual Sewage Disposal System Regulations. 16. There shall be no burning conducted at the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. 1 of the Colorado Air Quality Control Commission Regulations. 17. This is an existing facility and the applicant is proposing expansion WCR 32 is designated on the Transportation Plan Map as a local paved road and is maintained by Weld County. REQUIREMENTS: The main entrance to the facility, the internal road structure, and main parking lot around the shop, hospital, and milking parlor are paved. The remaining road portions of the operation appear to be gravel. The ranch house is approximately 1,000 feet west of the main entrance and the access is onto WCR 32. There appears to be a separation between the living quarters and the main operating facilities. In the Use by Special Review Questionnaire, the applicant is indicating that an existing mobile home will be removed and a four-plex housing unit will be constructed directly south of the Platteville Cemetery. There appears to be adequate parking for this facility. The applicant should utilize the existing access from WCR 32 as no additional accesses will be granted. Section Line: Between Sections 19 and 20, the applicant is indicating that the proposed lagoon pond will straddle this section line. I recommend this be researched and all easements or right-of-way that may reflect the proposed expansion of the pond be placed on the plat. Items that may appear could be dedicated right-of-way for future expansion of WCR 27 or oil and gas lines, etc. Once these have been placed on the plat drawing, the applicant should address all easements or rights-of-way Storm Water Drainage: The existing storm water drainage plan appears to be accommodating the facility and paved area. The applicant is channeling the runoff from the asphalt and buildings in a northerly direction, the main drainage pattern flows from the north to the south. The applicant has identified a storm water retention facility. Dear Ms. Chester: This letter supplements the response of the Town of Platteville to your referral of the referenced case. Its purpose is to address more fully the issues relating to Town water service to the subject property. Enclosed is a copy of the 1982 Agreement for Water Service pursuant to which Bella Holsteins, as successor to the interests of Shirley Henrickson and Virginia Henrickson, currently receives water from the Town system. Under the agreement the Town committed to serve only that property specifically described therein. The property involved in the application includes that property but is far more extensive. To illustrate the size and location of the two parcels, I enclosed a copy of a topographical map showing the boundary of the property subject to the application in solid black line and the boundary of the property the Town has agreed to serve in dashes. According to Mr. Tom Haren of EnviroStock, Inc., which submitted the special use permit application on behalf of Bella Holsteins, if the application is approved and the property is used to the fullest extent permitted by such approval, water demand on the Town system will be increased primarily, if not exclusively, by the presence of additional livestock. According to Mr. Haren, the additional livestock will number approximately 2,500. He advises that for planning purposes each cow is assumed to consume approximately 12 gallons of water per day. If these assumptions are correct, the increased water demand works out to approximately 900,000 gallons per month, or 33.6 acre feet per year. In order for the Town water system to supply the additional water demand, the contract between Bella Holsteins and the Town will have to be renegotiated to provide for service to the additional property, to compensate the Town in terms of additional system development charges and conveyance of raw water, and possibly to construct specific improvements to the system. Any such contract amendment would further need to protect and accommodate the interest of Mr. & Mrs. Olin, the other Town customers presently served under the 1982 agreement. TOWN HALL • P.O. This contract provides, among other things, for Town water service to property outside of its corporate limits to be restricted to the services in existence at the time the contract was made. The addition of new services or the expansion of existing services to property outside the Town will require an amendment to the contract between the Town and the district. The Town first learned of the Applicant's plans when it received your referral dated June 23, 1998. Included within that referral is a letter dated May 26, 1998 from the undersigned to Mr. Haren stating that"the Town will continue to serve Bella Holsteins at 13278 Weld County Road 32, Platteville, Colorado 80651 with Town water." At the time Mr. Haren requested this letter, he did not mention, nor was I aware of, any plan or intent on the part of Bella Holsteins to expand its operations. That letter, therefore, should be read to state that the Town would continue to serve Bella Holsteins under existing conditions. It cannot under any circumstances be taken as an informed statement of availability of Town water service for the type of operation described in your referral. Town water service for the operation described in that referral is subject to all of the conditions and limitations described above in this letter. Bella Holsteins, Inc. has made no effort to negotiate the expansion of Town water service for its proposed expanded operation. Accordingly, the Board of Trustees of the Town has had no occasion to consider or determine any position with respect thereto. If you need any further information concerning this or any other issue associated with the application, please do not hesitate to call me. As this proposal is located off of the state highway system, my concerns are focused upon the impact of traffic to the State Highway(SH) 85/Weld County Road (WCR) 32 connection. The County is reminded of their obligation in regard to the connection. Section 2.10.4 of the State Highway Access Code states: "Vehicular use and operation of public accesses (county roads and municipal streets)to the state highway is the responsibility of the appropriate local authority. The local authority should maintain access conformance with the Code..." If the County determines that the development would increase traffic at the connection by more than 20%, the Department would have the obligation and opportunity to review the connection to determine if improvements are required to bring the road connection into conformance with the Code. If changes at the connection are required, an access permit must be obtained from this office. Also, the proximity of the property access to the railroad tracks and intersection should be reviewed. First, Platteville's Comprehensive Plan calls for low density residential development in the portions of Section 19 subject to the Application. See, attached copy of future use map from the Comprehensive Plan. The Application proposes uses in Sections 19 and 20 which materially conflict with the Town's plan for Section 19. The Town has been negotiating with the owner of the southeast quarter of Section 19, Township 3 North, Range 66 West of the 6th P.M., located immediately to the south of a portion of the property involved in the Application, concerning its annexation to the Town and development in a mixed-use configuration, which would put low density single family residences in the east half of that quarter section, above the Evans Ditch No. 2 and Platte Valley Canal. The Application would, if approved, create seriously incompatible uses in the same area, based upon the noise, dust, and odor from the feeding operations proposed in Section 20. As part of these negotiations, the Town has a much-desired opportunity to bring commercial development to the area below the ditches. The loss of this opportunity would be an additional and very substantial blow to the Town. The Town has adopted a Transportation Plan which, recognizing the development of the southeast quarter of Section 19 as described above, designates the county road right-of-way along the boundary between Sections 19 and 20 as a major street, whose purpose will be among other things to serve the proposed development in that quarter section. Chester 'Weld County Planning Department uIy 29, 1998 Page 2 That portion of the property subject to the Application located in Section 19 is within the Town's Urban Growth Area, as defined in the Interim Coordinated Planning Agreement between the Town and Weld County, dated effective as of March 12, 1996. Depending upon whether the proposed development in Section 19 is characterized as agricultural on one hand, or commercial/industrial on the other, subsections 4.3.(b) and 4.3.(g) of that Agreement are involved. If the development in Section 19 is industrial or commercial, the Agreement requires a commitment from the property owner to annex to the Town. If, on the other hand, it is characterized as agricultural, subsection 4.3.(g) of the Agreement would require the County to deny the same as a non-urban development in the Urban Growth Area. As indicated in previous correspondence, an adequate water supply for the proposed development is anything but assured at this time. While the Town is certainly open to discussing expanding its water supply to the Bella Holsteins property, a water supply sufficient to served the expansion is by no means dependable, within the meaning of Section 24.5.1 of the Weld County Zoning Ordinance. The proposed expansion would nearly double the demand of the Bella Holsteins operation upon the Town's system. The costs of securing the additional water supply, and constructing plant improvements, will be very substantial. As indicated in earlier correspondence, the Applicant has not even approached the Town to discuss these issues. We will be attending the hearing on this Application before the Planning and Zoning Commission on. August 4. At that time, we will be able to furnish additional information concerning each of the above points and may have a. .itional ones to offer in addition. In summary, the Town of Platteville vigoro sly opposes the Application as being in direct conflict with its Comprehensive Plan, and for ii - other reasons set forth above. As you are aware, I also observed the site with you, Julie Chester, and Eric Jerman, on Thursday, July 16, 1998. The purpose of our review was to assess the Plan's compliance with the Confined Animal Feeding Operation Control Regulations (CAFO Regulations) and the conditions of the facility's proposed Special Use Permit. The WCHD has the found that the "draft" Plan is inadequate as submitted. We have summarized the deficiencies and the areas that require additional information below. Our comments are as follows: 1) The Plan does not adequately demonstrate the surface drainage on the site. Based upon our review of the Plan and my observation of the site, the surface drainage of the exercise pens on the north eastern portion of the site and the location of the proposed pens is not adequately described. During our visit to the site, we also discussed that a portion of the eastern pens, that do not appear to have adequate surface drainage, may be abandoned. This should be represented in the Plan. Also, as we have discussed, in the event a temporary holding pond will be incorporated into the Plan, the Plan should describe the ponds lining, the volume of the pond, the method of transferring wastewater, etc. Thomas Haren July 29, 1998 Page 2 2) The Plan should include a detailed surface contour map that demonstrates all surface water control features on the site. This should include surveyed surface elevations, indicate flow direction, run-on control features, swales, underground pipes, culverts, etc. Please note, the WCHD has recommend that this condition be a part of any permit issued to Bella Holstein, Inc. 3) Page 14, Section 5, discusses the required capacity of the Storm water Retention Facilities. The calculations provided in this section do not appear to consider the volume from process water generated in the milking parlor, flushing of pens, flow-through water, etc. The calculations should consider all flows into the retention facilities. In addition, the calculations do not address the required storage of wastewater generated during winter months that must be stored until they can be disposed in accordance with the CAFO Regulations. These items should be addressed in the Plan. This section also indicates that 123 acre/feet of capacity is available between the east and west ponds and that this is "...4 times the necessary stormwater and process wastewater capacity." It also states that "the east and west storage systems are interconnected." However, the Plan must either demonstrate that each pond is adequate for the basin that will drain into it or demonstrate the manner which they are "interconnected" and how this system will function during of a 25-year, 24-hour storm event. 4) Page 15, Section 6, discusses Retention Facility Dewatering. It indicates that wastewater will be land applied. This section should discuss the method of land application, i.e. flood irrigation or center pivot distribution. In the event flood irrigation of wastewater will be used at this facility, tailwater ponds must be provided in accordance with Section 4.8.5 (A)(2) the CAFO Regulations. Any tailwater ponds should be either shown or described in the Plan. 5) The Plan does not appear to adequately address the construction of the manure and process wastewater conveyance structures on the facility. Any conveyance structure should be constructed to handle the 25-year, 24-hour storm event. In addition, in accordance with Section 4.8.4 of the CAFO Regulations, the Plan should demonstrate or discuss how any conveyance structure is, or will be, designed to prevent exceedances of Thomas Haren July 29, 1998 Page 3 applicable water quality standards. 6) The Plan does not appear to include a manure storage area. During my visit to the site, you indicated that manure would be stored on the southern portion of the facility. The manure storage area should be described in the Plan. The Plan should also describe how any precipitation that comes into contact with the manure will be managed. These conclude the WCHD's comments at this time.
