RE: APPROVAL OF AMENDED RECORDED EXEMPTION #708 - BUDERUS/MCCAULEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Amended Recorded Exemption#708, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Amended Recorded Exemption #708 was submitted by
Theodore and Daniel Buderus and C. W. and Juanita McCauley, 26246 Weld County Road 45,
Greeley, Colorado 80631, for property which is located in the EA of Section 6, Township 4 North,
Range 63 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to reduce the size of said Lot B of Recorded Exemption #708
from 307 acres, more or less, to 158 acres more or less.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Amended Recorded Exemption #708,
submitted by Theodore and Daniel Buderus and C. W. and Juanita McCauley be, and hereby is,
approved conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Dear Commissioners:
This request for an amended recorded exemption is submitted by Theodore and Daniel Buderus and
C.W. and Juanita McCauley. The parcel of land on which this request is being made is the E2 of
Section 6, T4N, R63W of the 6th P.M., Weld County, Colorado. The property is located south of and
adjacent to Weld County Road 50 and west of and adjacent to Weld County Road 63.RE-708 was
approved by the Board of County Commissioners September 19, 1984. RE-708 was approved by
the Board of County Commissioners September 19, 1984. This request is to amended Lot B of
Recorded Exemption 708, from 307 acres more or less, to 158 acres more or less. The applicants
have indicated through the application materials that they plan on dividing their partnership
This request cleans up the gangly 358 acre Lot B which in fact is two separate farming operations.
Each quarter section operates with a center pivot sprinkler system. Access is existing from Weld
County Road 50 and Weld County Road 63 right-of-way. The Weld County Health Department and
Public Works Department have reviewed this request and offer conditions of approval.
The Department of Planning Services' staff recommends conditional approval of this request. It is
the opinion of the Department of Planning Services' staff that this request complies with the
standards of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance.

AMENDED RECORDED EXEMPTION
1 . The reason for the proposed Amended Recorded Exemption is to
more appropriately identify the land function with the
Recorded Exemption (RE) function. The 360 acre partial is
not appropriate for the RE function. The requested 160
acres (NE 1/4) with the historically irrigated center pivot
system is a complete package and the real world in irrigated
the terrain present on this quarter section. Lot A ( the
residence) will not change. Only Lot B will change. It
will be reduced from a large 1/2 section (East half - survey
of 358 acres) to the NE quarter. This is appropriate and
desirable at this time for the applicants would like to
divide their partnership and the land (NE 1/4, SE 1/4 &
Buderus from McCauley) and to request that a portion of Lot
B be subdivided via the simultaneously submitted Recorded
Exemption. (Its reason is presented in its application)
2 . Lot A will remain the same as it was (2 . 0 acres) . Proposed
Lot B will be reduced from 358 acres (as per survey plat) to
158 acres (160 acres NE 1/4 less the 2 acre Lot A) . The
historical use of the respective lots will continue . Lot A-
residential and Lot B-irrigated farmland and waste.
3 . This request does not circumvent Weld County Comprehensive
Plan nor the Subdivision Ordinance 173 . This request
provides for the two lots to be more descriptive of the
actual land use in a reasonable allocation.
4 . This use is the same as historically used and is the same as
the neighboring sections . This use is irrigated farmland,
rural residence, and wasteland.
5 . The (A) agricultural zone allows for lots larger than 1
acre. Lot A will remain 2 acres and Lot B will be 158+
acres . A zoning change is not applicable nor desirable at
this time. The neighboring sections are all (A)
agricultural zoned.
6. This request cleans up the gangly 358 acre Lot B which in
fact is two separate farming operations . Each center pivot
operates on its quarter section with its separate water
source . Each quarter section should be separate for zoning
and planning purposes to better evaluate and plan for
orderly development.
7 . The NE 1/4 can be very efficiency serviced by WCR 50 and
Central Weld County Water District . The SE 1/4 can only be
serviced by privately maintained county reserved rights of
way (section lines) and allows Weld County and Department of
Planning more control in changes as they may occur in the
future.

Weld County Zoning Ordinances Section 50 Overlay District
Regulations . It is not in the airport location, approach,
transitional, horizontal or conical zones . Geologic hazard
layers do not appear present nor in an overlay. Neither Lot
A nor Lot B are in a flood plain. Sufficient drainage is
available to handle irrigation and rainwater through normal
ditches and percolation present on the subject property. No
Planned Unit Development District exists for subject
property.
Existing rights of way are present for county roads to serve
said properties . Utility rights of ways are also present
along subject property for electricity, water and telephone
for NE 1/4 and electricity for SE 1/4 .
The economic welfare of the community will be enhanced by
owner-occupied buildings to be constructed, through more tax
revenue, and better farming practices allowed by a hobby
farmer handling the small field, which is not economically
feasible with the modern large equipment of the Buderus
brothers .
