This is a follow up memo to our conversation regarding the City of Greeley annexing the acreage for the new Public
Works facility. I will be resubmitting the General Overview and the Questionnaire to reflect only the mining portion
of the Amended USR but not the new Public Works facility itself.
No other portion of the report, such as plats or attached documents, will change.
I am submitting to you the most up-to-date and accurate packet for your review and approval.

GENERAL OVERVIEW
The Weld County Public Works Department would like to combine the two land use permits at the
Geisert Pit. The existing permits are: USR-847 and SUP-369. This site is located at the northeast
edge of the City of Greeley, Colorado, at 933 Northl l th Avenue and"0" Street. The Weld County
Public Works Department is requesting an amendment to the existing mining permit to reduce the
area to be mined. Weld County will be constructing an additional 8.2-acre wetland.
Mining will continue in the existing SUP-369 permitted area. The only change to this area would
be amending 10± acres adjacent to 1 l th Avenue on the east end of the permitted area. Portions of
this area have been annexed by the City of Greeley and will be used as commercial building sites.
There are three mining phases associated with the SUP. We are amending Mining Area#3 to reflect
10± acres.
In the USR-847 mining area, the county will construct the 8.2-acre wetland. No other mining will
take place within this area. Some of the material will be utilized for site grading for the Public
Works facility. The existing topsoil in the wetland area will be removed and will be stockpiled for
future reclamation process. The pit edges will be finished to a 4:1 slope. The topsoil will be
reintroduced and seeding and reclamation will occur in the fall or spring of 1998 or 1999.

1. A completed application form.
2. A detailed description of the method on mining operation. The description shall include:
a. The types and numbers of operation and processing equipment to be employed.
Mining and trucking operation(25±employees)
Engineering offices, Road and Bridge offices, adequate parking for all operations,
storage facilities, lake and wetlands (100 employees)
Gas facilities - number of users 500
b. The number of shifts to be worked and the maximum number of employees.
100 employees work may work one to two shifts
the hours of operation are 5:30 a.m.-6:30 p.m.
c. Whether the operation will involve a wet or dry pit.
This will be a dry pit operation. We will pump the pit to build the wetland area
and mine.
d. County roads and bridges to be utilized.
All users of the facilities will use the existing access route to North 11 th Avenue,
then north or south from there. Speed limit signs of 30 mph have been placed
from the gate to the end of the buildings. From there to the gravel pit, 15 mph
speed limit signs have been placed.
e. The size of the area and stages to be worked at any one time.
The permitted mining areas are USR-847 and SUP-369, consisting of 142.5 total
acres.
Pond#1 (29 acres)has been completed and reclamation is underway.
Pond#2(16 acres) is currently being mined.
Pond#3 (10 acres)will be the last and final mining phase at this location.
f. A time table giving the periods of time which will be required for the various stages of
the operation.
The remaining areas to be mined will be Pond #2, which is 16 acres presently
being mined. The approximate time table for this location is from five to seven
years.
Pond#3, (10 acres) will follow. The time table for Pond#3 will also be
approximately five to seven years.

g. The depth and thickness of the mineral deposit to be mined and the thickness of
overburden to be removed.
The existing depth of our other pits, in this particular area,range from 30 to 40
feet±. The overburden consists of 1 to 2 feet which will be stripped and
stockpiled in the designated area and will be utilized for reclamation and berming
areas at the existing and proposed sites.
h. The proposed use of reclaimed lands and an explanation of the reclamation process.
Weld County proposes to reclaim the land for wildlife habitat/recreational lake
because of its proximity to the Cache La Poudre River, a natural wildlife habitat.
Screening mounds along the perimeter will be constructed with side slopes no
greater than 4:1 and will be revegetated. A mixture of seeds suitable to the area
have been recommended by the Soil Conservation Service.
i. The source of technical advice in that type of reclamation for open cut mining land.
Weld County Public Works Department utilizes the Soil Conservation Service to
provide an adequate seed mix to revegetate all their pits throughout the county.
Mining practices throughout the existing county pits are on a continuous basis.
The mining department utilizes a technical staff for mining practices and state,
county, and federal permitting. We use an environmental scientist, Darcy Tiglas,
as a consultant for the wetland area and the 404 permit.
3. A certified list of the names, addresses and the corresponding parcel identification number
assigned by the Weld county Assessor of the owners of property (the surface estate) within
500 feet of the property subject to the application. The source of such list shall be records
of the Weld county Assessor, or an ownership update from a title or abstract company or
attorney, derived from such records, or from the records of the Weld County Clerk and
Recorder. If the list is assembled from the records of the Weld County Assessor, the appli-
cant shall certify that such list was assembled within 30 days of the application submission
date. (A certification form is attached).

4. A certified list of the names and addresses of mineral owners and lessees of minerals on or
under the parcel of land being considered. The Source of such list shall be assembled from
the records of the Weld County Clerk and Recorder,or from an ownership update from a
title or abstract company or an attorney, derived from such records. (A certification form is
attached).

5. The following documents or any other similar documents shall be submitted by the applicant
if deemed necessary by the Board of County Commissioners or its duly authorized representa-
tive for the protection of the health, safety, and welfare of the inhabitants of Weld County.
a. Applicant shall submit a copy of these reclamation plans submitted to the State of
Colorado Mined Land Reclamation Board. The reclamation plans must include a
map showing property boundaries,topography,bodies of water, and access.
A copy of the application to the Colorado Division of Mining and Geology is
attached. This packet also includes the reclamation plan map.
b. Plans for obtaining water supplies for the mining operation.
The mining operation will use water for dust control and some material
processing.
This water will be replaced by shares of Central Colorado Water Conservacy
District. Weld County has a substitute water,supply plan in place.
c. Cross sections of drainage structures (culverts for access to county roads, interior
haul roads crossing of ponding or stream channeling.)
The proposed drainage structures will be culvert placements between the proposed
and existing lake system to designated discharge points to the Cache La Poudre
River.
d. Profile and typical cross section of haul roads.
The unpaved haul roads have 3-4 inches of aggregate base course, the paved haul
roads have three inches of hot bituminous pavement. Both are adequate for heavy
hauling.
6. A statement which explains how the proposal is consistent with the Weld County Compre-
hensive Plan.
There will not be any farmland taken out of production. The application proposes
the continued extraction of recognized sand and gravel deposits and the return of
affected lands to a park and wildlife area. All activities at the mining site are
guided by the regulation of the Mine Safety and Health Act(MSHA and OSHA).
The applicant is proposing setbacks, noise controls, duct controls, and general site
conditions which will all comply with the policies and goals of the Comprehensive
Plan.
7. A statement which explains how the proposal is consistent with the intent of the district in
which the use is located.
Mining is allowed and is consistent with the intent of the agricultural district. A crushing
plant is also consistent with mining.
8. If applicable, a statement which explains what efforts have been made, in the location
decision for the proposed use,to conserve productive agricultural land in the agricultural zone
district.
The gravel pit and wetlands will not affect present or future agricultural land.
9. A statement which explains there is adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County.
The gravel pit meets the health and safety requirments of the State of Colorado and it will
be maintained to protect the neighborhood and Weld County. The existing mining
operation is operating under the following permits:

10. A statement which explains the uses permitted will be compatible with the existing surrounding
land uses.
The surrounding land uses on two sides are gravel pits. to the north is a county building,
and to the south is a city park. The river separates the other gravel pit and park from
Weld County's gravel pit.
11. A statement which explains the proposed use will be compatible with the future develop-
ment of the surrounding area as permitted by the existing zone and with future development
as projected by the comprehensive plan of the county or the adopted master plans of
affected municipalities.
The gravel pit and wetland will be the same uses that are presently adjacent to the site. The
uses are consistent with the City of Greeley Master Plan for the area.
12. A statement which explains the Use by Special Review area is not located in a flood plain,
geologic hazard and Weld County Airport overlay district area; or that the application com-
plies with Section 50, Overlay District Regulations as outlined in the Weld County Zoning
Ordinance, as amended.
The mining activities are located in the 100-year flood plain. Mining equipment is portable
and will not impede flood waters nor will any debris float away. The site is not on a geologic
hazard area or airport oveerlay district.
13. Proof that a water supply will be available which is adequate in terms of quantity, quality,
and dependability (e.g. a well permit or letter from a water district).
Domestic water is not being used for the mining operation. Water for the mining
activities is available through well permit No. 29-11874 RF200. See attached copy.

14. A copy of the deed or legal instrument identifying the applicant(s) interest in the property
under consideration. If an authorized agent signs the application for the owner(s), a letter
granting power of attorney to the agent from the property owner(s) shall be provided.
Warranty Deed with legal description is enclosed.
15. A noise report, unless waived by the Department of Planning Services, documenting the
methods to be utilized to meet the applicable noise standards.
The noisiest piece of equipment used at this operation is the rock crusher. Noise levels for the
rock crusher have been taken by the Mine Safety and Health Administration of the U. S.
Department of Labor and meet applicable noise standards.
16. Other information determined necessary by the Board of County Commissioners or the
Department of Planning Services will be provided upon request.
17. Miscellaneous Information:
The vehicular traffic associated with the gravel mining operation will be 8 to 20 25-ton
semi-tractor trailers.
There are no additional fire protection measures associated with the proposed use.
There are no animals involved with this use.
There are four (10.000 gal.) aboveground fuel storage tanks used by the City and County as a
fuel site. There are approximately 500 users at this site.
Storm water will be retained in the existing pond at the southwest corner of the tract. After
completion of the mining, the resultant pond will become the water retention facility.
Any debris,junk, or other waste associated with the mining operations will be disposed of
in the rummer as is being done in the existing gravel mining operation.
An additional 8± acres of wetland will be located in Mining Area#I.

1 . Your obligation to reclaim the site is not limited to the amount of
the financial warranty. You assume legal liability for all reasonable
expenses which the Board or the Office may incur to reclaim the affected
lands associated with your mining operation in the event your permit is
revoked and financial warranty is forfeited;
2 . The Board may suspend or revoke this permit, or assess a civil
penalty, upon a finding that the permittee violated the terms or
conditions of this permit, the Act, the Mineral Rules and Regulations,
or that information contained in the application or your permit
misrepresent important material facts;
3 . If your mining and reclamation operations affect areas beyond the
boundaries of an approved permit boundary, substantial civil penalties,
to you as permittee can result;
4 . Any modification to the approved mining and reclamation plan from
those described in your approved application requires you to submit a
permit modification and obtain approval from the Board or Office;
5 . It is your responsibility to notify the Office of any changes in your
address or phone number;
6 . Upon permit issuance and prior to beginning on-site mining activity,
you must post a sign at the entrance of the mine site, which shall be
clearly visible from the access road, with the following information
(Rule 3 . 1 . 12) :
a. the name of the operator;
b. a statement that a reclamation permit for the operation has been
issued by the Colorado Mined Land Reclamation Board; and,
c . the permit number.
7 . The boundaries of the permit boundary area must be marked by
monuments or other markers that are clearly visible and adequate to
delineate such boundaries prior to site disturbance.

8 . It is a provision of this permit that the operations will be
conducted in accordance with the terms and conditions listed in your
application, as well as with the provisions of the Act and the
Construction Material Rules and Regulations in effect at the time the
permit is issued.
9 . Annually, on the anniversary date of permit issuance, you must submit
an annual fee as specified by Statute, and an annual report which
includes a map describing the acreage affected and the acreage reclaimed
to date (if there are changes from the previous year) , any monitoring
required by the Reclamation Plan to be submitted annually on the
anniversary date of the permit approval . Annual fees are for the
previous year a permit is held. For example, a permit with the
anniversary date of July 1, 1995, the annual fee is for the period of
July 1, 1994 through June 30, 1995 . Failure to submit your annual fee
and report by the permit anniversary date may result in a civil penalty,
revocation of your permit, and forfeiture of your financial warranty.
It is your responsibility, as the permittee, to continue to pay your
annual fee to the Office until the Board releases you from your total
reclamation responsibility.
10 . For ioint venture/partnership operators: the signing
representative is authorized to sign this document and a power of
attorney (provided by the partner(s) ) authorizing the signature of the
representative is attached to this application.
NOTE TO CONMENTORS/OBJECTORS:
It is likely there will be additions, changes, and deletions to this document
prior to final decision by the Office. Therefore, if you have any comments or
concerns you must contact the applicant or the Office prior to the decision
date so that you will know what changes may have been made to the application
document.
The Office is not allowed to consider comments, unless they are written, and
received prior to the end of the public comment period. You should contact
the applicant for the final date of the public comment period.

Weld County (the "Applicant/Operator" ) has applied for a Regular
(112 ) reclamation permit from the Colorado Mined Land Reclamation Board (the
"Board" ) to conduct the extraction of construction materials operations in
Weld County. The attached information is being provided to
notify you of the location and nature of the proposed operation. The entire
application is on file with the Division of Minerals and Geology (the "Division" )
and the local county clerk or recorder.
The applicant/operator proposes to reclaim the affected land to
park (Wildlife Habitat) use. Pursuant to Section 34-32 .5-116 (4) (m) , C.R.S. , the
Jard may confer with the local Soil Conservation Districts before approving of
the post-mining land use. Accordingly, the Board would appreciate your comments

Dear Mr . Warden ,
In correlation with our phone conversation a time ago , I have
reviewed the Fire Code in relation to your proposed fuel storage
facility . It is my understanding that the proposed facility would
include 3 ten thousand gallon fuel tanks . The following information
should be of assistance in the planning of the site :
1 . 40 feet minimum distance from any property line which is
or can be built upon including any public way .
2 . Spacing between tanks must be at least 1/6 sum of the
adjacent tanks diameters , but not less than 3 feet . More
spacing between the tanks fosters safer firefighting
conditions .
3. Fuel storage tanks shall be within a diked area follows :
The volumetric capacity of the diked area shall not be
less than the greatest amount of liquid that can be
released from the largest area within the diked area . The
capacity of the diked area enclosing more than one tank
shall be calculated by deducting the volume of the tanks
other than the largest tank below the height of the dike .
Walls of the dike area shall be of earth , steel , concrete ,
or solid masonary design to be liquid tight . Earthen walls
which are more than 3 feet in height must have a flat
section at the top not less than 2 feet wide .
Any dike containing more than two tanks must be subdivided
to prevent spills from endangering the adjacent tanks within
the diked area . Provisions must be made for the removal of
excess water from the diked area . A valve operable from the
outside of the diked area shall be provided in the dike
system and shall be kept in the closed position .

The minimum distance from the tank to the inside toe of the
dike wall is 5 feet .
4 . All fuel storage tanks shall be provided with emergency relief
venting in case of fire exposure .
5 . Each tank shall be labeled as to its content using at least
3 inch letters . The label shall be visible from the main access
way .
6 . The fuel dispensing system shall be installed in accordance
with nationally recognized good practices .
7 . Portable fire extinguishers shall be present at the fuel
dispensing location .
8. An emergency electrical shut-off shall be provided for
electrical pumps in case of emergency .
A site plan should be submitted to the Western Hills Fire Pro-
tection District for review prior to the installation for the
fuel storage facility . If you have any questions , please call me
at any time .
