RE: APPROVE REVISIONS TO BYLAWS OF FAMILIES, YOUTH AND CHILDREN
COMMISSION (FYC)AND APPOINT MEMBERS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Bylaws of the Families, Youth and Children Commission (FYC) were
approved by the Board by Resolution #980802 on May 11, 1998, and amended by Resolution
#981668 on September 9, 1998, and
WHEREAS, after review and upon the recommendation of the FYC and the Weld County
Department of Social Services, the Board deems it advisable to revise the FYC Bylaws to delete
the local foundation representative position (Article III.A.(16)), and add the position of"kinship
care person or adoptive parent" (Article III.A.(16)) as members to the FYC, and
WHEREAS, the Board also deems it advisable to appoint Jacqueline Martinez to
membership on the FYC, in the position of foster parent with her term to expire December 31,
1999, and
WHEREAS, the Board also deems it advisable to appoint Brian Lessman to membership
on the FYC, in the position of occupational training or employment programs with his term to
expire December 31, 2000, and
WHEREAS, the Board also deems it advisable to appoint Theodore Palmisano to
membership on the FYC, in the position of kinship care and/or adoptive parent with his term to
expire December 31, 2000.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the FYC Bylaws be, and hereby are, revised to delete the local foundation
representative position (Article III.A.(16)), and add the position of"kinship care person abd/or
adoptive parent" (Article III.A.(16)) as members to the FYC.
BE IT FURTHER RESOLVED by the Board that Jacqueline Martinez be, and hereby is,
appointed to membership on the FYC, with her term to expire December 31, 1999.
BE IT FURTHER RESOLVED by the Board that, Brian Lessman and Theodore
Palmisano, be, and hereby are, appointed to membership on the FYC, with their terms to expire
December31, 2000.

BYLAWS
WELD COUNTY FAMILIES, YOUTH AND CHILDREN (FYC) COMMISSION
Article I - Name of Commission
The Commission shall be called the "Weld County Families, Youth and Children Commission"
(hereinafter referred to as "the FYC").
Article II - Functions of the FYC
The functions and duties of the F'YC are to:
• Function as the "placement alternatives commission" for Weld County, as referred to
in C.R.S. § 19-1-116 (2)(a), and prepare the plans required by C.R.S. § 19-1-116
(2)(b).
• Review and advise the Board of County Commissioners of Weld County regarding the
following:
1) The local plan for Expedited Permanency Planning between Weld County and
the 19th Judicial District.
2) Weld County's compliance with the Child Welfare Settlement Agreement
between the Colorado Department of Human Services and the Colorado
Lawyers Committee.
3) Weld County's compliance with the out-of-home placement allocations and
associated requirements of C.R.S. §§ 26-5-101, et. seq.
4) Weld County's Family Preservation Program with Core Services and Family
Support Program.
5) The effectiveness of programs within Weld County which are designed to
prevent or reduce placement.
• Function as the"family preservation commission" for Weld County, as referred to in
C.R.S. § 26-5.5-106 (1), and comply with the review and reporting requirements of
C.R.S. § 26-5.5-106 (2).

Article III - Membership of FYC
A. Membership-The FYC shall consist of sixteen(16)members. The membership shall include:
(1) A physician or licensed health professional.
(2) An attorney.
(3) A representative of a local law enforcement agency.
(4) A representative of the probation department.
(5) A representative of the Juvenile Court or District Court of the 19th Judicial District..
(6) A representative from a local mental health clinic.
(7) A representative of a local school district specializing in special education.
(8) A foster parent.
(9) A representative specializing in occupational training or employment programs.
(10) A representative of a local substance abuse program.
(11) A representative from the "SB-94 Committee" for Weld County.
(12) A representative from the"Child Protection Team" for Weld County.
(13) An accountant from the lay community.
(14) A parent from the lay community.
(15) A clinic nurse from the lay community.
(16) A kinship care person or adoptive parent.
No members may be employed by or otherwise associated with a provider of out-of-home
placement services.
B. Appointment of Members - The members of the FYC shall be appointed by the Board of
County Commissioners of Weld County, according to the following procedure:
(1) Persons interested in serving on the FYC shall submit an application which will
provide biographical information.

(2) A Nominating Committee, consisting of the FYC Executive Committee members and
the Board of County Commissioners' Coordinator for the Weld County Department
of Social Services, shall review each application and establish a list of nominee(s) for
vacancies and reappointments for consideration by the FYC.
(3) The FYC shall review and consider the list for recommendation to the Board of
County Commissioners.
(4) The Board of County Commissioners shall review the list of nominee(s) and may
interview such nominee(s) according to the Board's desires. The Board, in its sole
discretion,may appoint members to fill vacancies or reappoint members for additional
terms.
(5) The Board of County Commissioners may designate on an annual basis such
community advisors as the Board deems necessary in order to benefit the FYC
Standing Committees of Program Effectiveness and Outcomes, Family Support, and
Collaboration and Innovation. Such community advisors shall be representative of the
community and have demonstrable personal or professional knowledge of the area of
their designation. Community advisors shall not vote on matters which come before
the Standing Committees for determination.
C. Terms of Members - Regular membership terms of the FYC shall be for three (3) years. No
member may serve for more than two (2) consecutive terms. New FYC members may be
assigned first terms of less than three (3) years to assure appropriate staggering of members'
terms.
D. PAC Membership on Date of Approval of Bylaws - Members of the former Weld County
Placement Alternatives Commission ("PAC") as of the date of the approval of these Bylaws
shall automatically become members of the FYC for the length of their current terms on the
PAC and shall be subject to the two(2)term limit set forth in Section III., C., above. Members
of the former PAC, who are considered to be "Providers," as that term is defined in Section
III., A., above, shall not be eligible for a second term once their current term has ended.
Article IV - Officers
A. The FYC shall elect from its own members a Chair and Vice-Chair. Term of
office shall be for one year.
B. In the absence of the Chair, the Vice-Chair will act in that capacity.
C. In the absence of the Chair and the Vice-Chair,a temporary Chair will be selected by the FYC.
D. A secretary shall be appointed by the FYC Chair.

Article V -Nomination and Election of Officers
The nomination and election of annual officers shall be held during the first regular meeting
of each calendar year. Each nomination shall be seconded to be placed on the ballot, and elections
shall be written ballot unless there is no contest for the office.
Article VI - Meetings
A. Regular meetings of the FYC will be conducted quarterly on days agreeable to the
membership, provided there is business to conduct.
B. Written notice of all regular meetings shall be mailed to each member at least seven(7) days
prior to each regular meeting date.
C. Special meetings may be called when deemed necessary by the Chair.
D. A quorum shall consist of not less than nine (9) members of the FYC. A quorum shall be
necessary at any meeting in order to conduct business.
E. The concurring vote of a majority of those present shall be required to pass any motion made.
F. Robert's Rules of Order shall prevail to the extent they are not in conflict with specific
provisions of these Bylaws.
Article VII - Duties of Chair
It shall be the responsibility of the Chair to call all special meetings, preside at all meetings,
and carry out general Chair responsibilities.
Article VIII - Duties of Vice-Chair
It shall be the responsibility of the Vice-Chair to assume the duties of the Chair in his absence.
Also, he shall perform other duties assigned by the Chair.
Article IX - Duties of Secretary
It shall be the responsibility of the secretary to send members notices of all meetings of the
FYC and to keep minutes, or to arrange for the keeping of minutes, of all meetings.

Article X - Standing Committees
There shall exist at least five (5) standing committees of the FYC, including the Executive,
Nominating,Program Effectiveness and Outcomes,Family Support,and Collaboration and Innovation
Committees. The Nominations Committee shall have the membership, duties and responsibilities
listed in Section III.,B., (2),above. The remaining Committees shall have the membership, duties and
responsibilities which are listed on the attached Exhibits "A-D." The Chair of the FYC may appoint
such other committees as are deemed necessary.
Article XI - Amendment of Bylaws
These Bylaws may be amended according to the following procedure:
1. The proposed amendments to the Bylaws may be presented at any meeting of the FYC
at which a quorum is present, provided seven (7) days notice has been given to each member.
2. For passage, such proposed amendments must receive the vote of the majority of the
entire membership of the FYC.
Article XII - Disputes
Disputes between Social Services and the FYC shall be resolved as expeditiously as possible
either by concurrence between the two entities or by intervention by the Board of County
Commissioners.
Article XIII - Confidentiality
Members of the FYC may, by virtue of such membership, inspect or be privy to records and
other materials containing personally identifying information maintained by the Weld County
Department Social Services. Members shall protect the confidentiality of such records and other
materials. Except as provided by law, no information in possession of a member of the FYC about
any individual client shall be disclosed in a form including identifying information.

Per the attached correspondence, please prepare a resolution to accomplish the following:
The board approved revising the bylaws as follows:
I) Kinship care or adoption parent position added
2) Local foundation position deleted.
The board also approved the following three appointments:
1) Jacqueline Martinez, foster parent
2) Brian Lessman, occupational training or employment programs
3) Theodore Palmisano, kinship care and/or adoption
In determining expiration dates for the three new members, I realized an error in previous
appointments. Members appointed 06-17-98 were given staggered terms that expire 12-31-99, 12-
31-2000, and 12-31-2001. We really should not have assigned any terms expiring in 2001 as those
terms are three years plus six months. I apologize for not catching that at the time. Do we need to
correct it? Our decision will affect the terms we assign these three new members. Please advise.

Concerning FYC Commission Candidates to Fill Vacancies and Propose a
Bylaw Revision
The purpose of this Memorandum is to outline recommendations proposed by the FYC
Commission to the Board of Weld County Commissioners for approval. The FYC Commission
approved these recommendations at its General Membership Meeting of September 18, 1998.
FYC Vacancies and Recommendations for Members:
The FYC Commission Bylaws outline that the membership of the FYC Commission will
consist of sixteen (16) members, not employed by or otherwise associated with a provider
of the Weld County Department of Social Services. There are currently seven (7)
vacancies within the FYC Commission. The list below outlines those vacancies and
recommends two candidates for FYC membership. Each candidate being proposed has a
biographical information sheet attached to this report. These candidate recommendations
are being forwarded to the Board of Weld County Commissioners for approval and
appointment.

II. Request for FYC Bylaw Revision Concerning FYC Membership Representation:
As the FYC Commission reviewed its program of work, the FYC Commission feels that
the inclusion of another parent who represents kinship care and/or adoption would be
beneficial to the Commission.
In our original meeting with the Board of County Commissioners, the Board expressed
their preference of having the FYC membership limited to sixteen. In reviewing the
representative areas of the FYC,the FYC Commission feels that a"representative from a
local foundation" may be less of a priority.
Recommendation: That a"a kinship care or adoption parent" be included as part of the
sixteen membership list of the FYC Commission and that a"representative from a local
foundation"be deleted from the membership list.
Recommendation: If the above recommendation is approved by the Board of County
Commissioners,that Mr. Theodore Palmisano whose biographical information sheet is
included in this packet be approved by the Board of County Commissioners for FYC
Commission appointment.
