Statement of Facts: On October 10, 1995, a vehicle driven by Jesus Valenzuela was traveling southbound on Weld County Road 15, approaching the intersection with Colorado 14. The Corman vehicle was traveling westbound on Colorado 14, approaching the intersection with Weld County Road 15 . Mr. Valenzuela drove through the stop sign, and then broadsided the Corman vehicle. At the time of the October 10, 1995 accident, the stop sign was covered by a tree, preventing Mr. Valenzuela from seeing the sign. One week prior to this accident, there was a fatal accident at this intersection due to the covering of the stop sign. Upon information and belief, there have been other such accidents at this intersection. Failure to remove this tree constitutes negligence and carelessness. - 3. Nature and extent of the injury: It is still too early to determine the exact nature and severity of the Claimant' s injuries. However, claimant has suffered right hip pain, right upper abdomen pain, lower chest pain, right facial pain, right elbow pain, and a zygomatic fracture. 4.
