RE: APPROVE AMENDMENT TO COLORADO WORKS IN WELD COUNTY POLICIES
AND PROCEDURES MANUAL AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the Colorado Works
in Weld County Policies and Procedures Manual by the Department of Social Services, with
terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Board of Social Services, that the Amendment to Colorado Works in
Weld County Policies and Procedures Manual be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 3rd day of August, A.D., 1998.

6011 Participant Sanctions and Appeals
Effective 9/10/97
6.011.1 Participant Sanctions
6.011.11 Definition of Sanctions
Sanctions against assistance participants shall include the following.
A. Failure to cooperate with child support enforcement,to comply with IRC
requirements, or to secure proper immunizations for children shall result in a loss
of 25% of the family's cash benefit for the first sanction, a 50% loss for the
second sanction, and a loss of the entire cash benefit for the third sanction. Each
sanction shall follow immediately after the previous. The first and second
sanctions shall extend for a period of 30 days each. The third sanction shall
extend for a minimum of 90 days and until the reasons for the sanction are cured.
B. Conviction of fraud as determined by a court or through administrative hearing
shall result in the caretaker being removed from assistance for a I 2-month period
for the first offense, twenty-four months for the second offense, and lifetime for
the third offense.
C. Assistance shall be denied for ten years to any individual who has been convicted
by a court for misrepresenting his or her residence in order to obtain assistance in
two states at the same time.
Revised 3/98 D. Refusal to participate in training, education, or work as evidenced by an
affirmative statement by the participant or demonstrable evidence, may result in
denial or termination of the basic cash assistance grant in its entirety for a
minimum or one month. The Department's referral of an applicant or recipient to
Employment Services is a referral to employment.
6.011.12 Notice of Proposed Applicant or Recipient Sanction
A notice of proposed sanction shall be sent to any applicant or participant for whom there
is a reasonable suspicion that his or her actions or inactions come within at least one of the
categories described in Section 6.011.11 of the Department's Operations Manual. "this
notice shall:

Department of Human Services Volume III regulations, 3.830.2.
B. Advise the applicant/participant of the opportunity for a local level dispute
resolution conference where he or she may present his or her side of the story.
C. Advise the applicant/participant that failure to respond to the notice may result in
a reduction or termination of the family's cash benefits or continued processing of
his or her application.
Revised 8/4/98 The Department's notice of proposed sanction consists of the Colorado Department
of Human Services Notice of Proposed Sanction. The Notice of Proposed Sanction
is included in Exhibit H. The Notice of Proposed Sanction shall be issued prior to a

6.011.2 Absences or Late Occurrences of Participants in Work Supplementation Programs,
On-the-Job Training Program,and the Job Retention and Skills Training Program
Colorado Works in Weld County Program participants who are participants of Work
Supplementation Programs, On-the-Job Training Program, and the Job Retention and
Skills Training Program, are expected to adhere to the employer's policies and procedures
concerning absences and late occurrences to work. Participants who do not observe
absence and late occurrence policies of the employer will be failing to participate in work
activities.
6.011.3 Absences From or Late Occurrences to Other Work Activities or Scheduled
Appointments
Colorado Works in Weld County participants of the other work activities are expected
actively to participate in all assigned work activities and to attend all scheduled
appointments. These other work activities include: public sector work activity, private
sector work activity, IRC Skill Development Seminar, Job Skills Training, Education
Directly Related to Employment, Secondary School or Equivalent Education, or County
Designed Occupational Skills Training.
Clients who do not observe absence and late occurrence policies of Section 6.01 I.3 of the
Department's Operations Manual will be failing to participate in work activities. The
client's failure to observe absence and late occurrence policies is considered an unexcused
absence that will result in a sanction.
6.011.31 Late Occurrences to Work Activities and Scheduled Appointments
A. Colorado Works in Weld County participant responsibilities are as follows:
I. Telephone the appropriate Colorado Works in Weld County staff or
contractor staff if the client expects to be late.
2. Telephone at least fifteen minutes before the start time of the client's
assigned work activity.
B. Clients who are more than one hour late and do not telephone the appropriate
Colorado Works in Weld County staff or contractor staff will be considered as
absent.
C. During the first six months of work activity participation, the Department may
allow the client a maximum of three late occurrences during any work activity
participation.
D. After the first six months of work activity participation, the Department may allow
the client one late occurrence in work activity participation.

6.011.32 Absences from Work Activities and Scheduled Appointments
A. During the first six months of work activity participation,the Department may
allow the client a maximum of three excused absences during any work activity
participation.
B. After the first six months of work activity participation,the Department may allow
the client two excused absences during any work activity participation.
C. Excused absences are defined as follows:
I. Jury Duty: Jury duty will be an excused absence if the client presents
verification to the appropriate Colorado Works in Weld County staff
member before the time jury duty will start. The Department will require
that the client provide verification from the court that he or she was
present for jury selection. Jury duty time will not count against the total
excused absences.
2. Child(ren) School Registration: A child(ren) school registration will be
considered an excused absence if the client arranges the absence with the
appropriate Colorado Works in Weld County staff member before being
absent from a work activity or work activity appointment.
3. Inclement Weather: If the Department determines that the client is unable
to attend a work activity due to inclement weather, the Department will
excuse the absence. Generally, if city buses are transporting individuals
or Weld County is open for business, the Department will not consider
that day to be an inclement weather day.
4. Appointments for Food Stamp Redetermination: The client's
appointments for food stamp redetermination will be considered an
excused absence if the client notifies the appropriate Colorado Works in
Weld County staff member 48 hours in advance and provides proof of
attendance.
5. Sick Day Absence: During any eight(8) week period, the Department will
allow the client a total of two (2) sick day absences for him or her and for
a member of his or her immediate family. A sick day absence may be
used for:
a. A scheduled doctor's appointment. The client must notify the
appropriate Colorado Works in Weld County staff member 48
hours ahead of the start day of work activity.
b. An emergency sick day. The client must notify the appropriate
Colorado Works in Weld County staff member no later than 8:30
a.m. on the day the absence will occur.
c. Serious illness. The Department will allow the client one
additional sick day if the client or a member of the client's
immediate family has a serious illness. The client must notify the
appropriate Colorado Works in Weld County staff member no
later than 8:30 a.m. on the day the absence will occur. If the
client or his or her immediate family member is sick for three (3)

consecutive days, a physician's excuse for the days missed is
required. The client must notify the appropriate Colorado Works
in Weld County staff member no later than 8:30 a.m. on each day
the absence will occur.
d. Court Absence: During any two-month period,the Department
will allow the client a total of one (I)court day. The client must
notify the appropriate Colorado Works in Weld County staff
member at least one week before the date of absence.
e. Emergency Absence: During any two-month period, the
Department will allow the client one(1) emergency day. The
Department may allow the client, subject to the approval of the
appropriate Colorado Works in Weld County staff member, an
emergency absence for the purposes of:
1) transportation problems if the client lives outside the
Greeley Bus System
2) child care problems if the client is not a member of a two
parent family who has a non-working spouse.
3) eviction from housing problems if the client is not a
member of a two parent family who has a non-working
spouse.
4) funeral of a member of the client's immediate family.
6.011.33 Definition of Immediate Family for Purposes of Section 6.0011.3
A client's immediate family means a client's husband or wife, son, daughter, stepson,
stepdaughter, father, mother, stepfather, stepmother, brother, sister, father-in-law, mother-
in-law, grandmother, grandfather, grandchild, foster child(ren), or foster parent.
6.011.4 Participant Appeals
Revised 8/4/98 A. The Department will adhere to the general policies of participant appeals as
outlined in Colorado State Rules, Volume III, Section 3.600, Income
Maintenance Programs.
B. The Department will send a notice of adverse action to all applicants and
recipients, who in the opinion of the Department, have failed to comply with the
terms outlined in their individual responsibility contact. The notice will advise the
applicant or participant of the opportunity to present evidence that good cause
reasons existed for their noncompliance with the IRC. The notice will also advise
the applicant or recipient that failure to respond to the notice of adverse action and
present good cause evidence will constitute willful and demonstrable evidence of
refusal to cooperate or participate in training, education, work, child support
enforcement, and/or immunization of children, and result in discontinuation or
denial of the entire cash assistance grant.
C. If the applicant or recipient refuses, either by demonstrated evidence or by an
affirmative statement,the Department may deny or terminate the basic cash
assistance grant in its entirety as determined by the county.
D. If the applicant or recipient responds to the notice of adverse action and presents
evidence that, in the opinion of the Department, does not constitute good cause for

failure to participate,a 25% sanction will be initiated for the first month, 50%the
second month, and the entire cash assistance grant for the third month and will
continue until they resolve the sanction.
