#1215 FOR OPEN CUT GRAVEL MINING IN THE A(AGRICULTURAL)ZONE DISTRICT-
WELD COUNTY PUBLIC WORKS DEPARTMENT,ON BEHALF OF DARRELL BEARSON
A public hearing was conducted on April 7, 1999, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 19, 1999, and duly published March 24, 1999,
in the Fort Lupton Press, a public hearing was conducted to consider the request of the Weld
County Public Works Department, on behalf of Darrell Bearson, for Open Cut Gravel Mining in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Sheri Lockman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written. Ms. Lockman gave a brief description of the location of the site, which is approximately
74 acres in size. She stated surrounding uses consist of agricultural activities including a tree farm
and sand and gravel mining, as well as residential sites located on reclaimed gravel pits. Ms.
Lockman stated six referrals were received in favor of the proposal, four did not respond, and two
surrounding property owners submitted letters of concern. In response to Commissioners Geile
and Kirkmeyer, Don Carroll, Department of Public Works, stated trucks will head south on Weld
County Road 25 to Weld County Road 18, both of which are paved.
In response to Commissioner Kirkmeyer, Greg Nelson, Public Works Department representative,
the number of trucks will vary throughout the year based on the weather conditions, but on the
average, there will be approximately twelve to fifteen trucks daily. Responding to Commissioner
Vaad, Mr. Nelson explained there is a 100-foot buffer between the holding ponds and the South
Platte River as required by the Division of Minerals and Geology. In response to Commissioner
Geile, Mr. Nelson reiterated truck activity will not be constant and will vary as trucks are needed
for projects in other parts of the County. He explained a large amount will be stockpiled and
operations will stop until more materials are needed to haul off-site. Mr. Nelson stated the mining
will be done in phases and as one phase is completed, that area will be reclaimed. Commissioner
Baxter commented Leo Butler, surrounding property owner, submitted a letter of concern regarding
increased traffic. Mr. Nelson stated the Butler property is located approximately one-half mile from

the site west of Interstate 25 and the haul route does not go that direction. Mr. Morrison stated the
lease will be for five years with the term to begin six months after the date of signature which will
be in May to allow the Use by Special Review process to be completed. Responding to
Commissioner Vaad, Ms. Lockman stated the concern raised in the Planning Commission hearing
regarding mosquitos was not addressed. Commissioner Vaad commented there is a lot of water
in the area that is not a result of the mining operation.
No public testimony was offered concerning this matter.
Commissioner Baxter moved to approve the request of the Weld County Public Works Department,
on behalf of Darrell Bearson, for a Site Specific Development Plan and Special Review Permit
#1215 for Open Cut Gravel Mining in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Geile, and it carried unanimously.
This Certification was approved on the 12th day of April, 1999.
