Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: • Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Eric Jerman Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated May 12, 1999, and duly published May 15, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Pawnee Sportsmans Center for a Recreational Facility (Shooting Range) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Eric Jerman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written and stated the site is located northeast of Briggsdale. Mr. Jerman also stated seven referrals were returned and responses from five surrounding property owners; however, Conditions of Approval and Development Standards address any issues brought to staff's attention. Mr. Jerman reviewed the reasons for conditional approval by the Planning Commission. Responding to Commissioner Baxter, Mr. Jerman said the applicant owns all of Section 7, although only one-half of the section is included in the application. Tim Brough, applicant, stated he co-owns the club, along with Richard Beck and Allen Rechnagel. Mr. Brough explained this recreational facility is for a game bird shooting range, as well as target ranges for trap, skeet, and archery. He further stated the applicants will also raise the birds and they are currently leasing ground near Windsor for the club, but are not able to expand at their present location. Mr. Brough stated accessibility and the possibility of expansion were two major reasons for purchasing the proposed site and noted there are presently no other trap or skeet shooting ranges north of Denver. He explained his concern for safety led to placing the target shooting ranges in the middle and south portion of the property, with shooting direction being to the north/northeast. Mr. Brough also described noise buffers, as well as shooting backstops,which 991254 CC. �- /-'7 PL1304 HEARING CERTIFICATION - PAWNEE SPORTSMANS CENTER (USR #1221) PAGE 2 are 20 feet high and meet National Rifle Association requirements. Mr. Brough presented a petition in support of the application and two pages from the National Rifle Association requirements, marked Exhibit F and G, respectively. Responding to questions from Commissioner Baxter, Mr. Brough reviewed the landscape screening and stated the parking lot will be near the clubhouse and accessed from Weld County Road 71. He also stated the noise is buffered from surrounding properties more by placement of the ranges than by physical barriers, and discussed the traffic flow into the site being mostly from Highway 392 to Weld County Road 80,then onto Weld County Road 71. Responding to Commissioner Geile, Mr. Brough stated the berms are artificial, earthen structure bullet stops, and he requested the 600-yard requirement in the Zoning Ordinance be waived, stating a 20-foot berm is proposed following National Rifle Association requirements. Mr. Brough explained a bullet reaches its maximum height at 20 feet, therefore, adding an additional 10 feet of height for each one hundred yards of range is not necessary. He reiterated the only berm that does not meet the standards of the Zoning Ordinance is the one for the 600-foot range, and stated the club has liability insurance with$1 million per occurrence loss provided,which wou d include accidental shooting of livestock, etc. Mr. Brough also stated there are side berms located anywhere a range runs along a road. Gerald Reid, Greeley resident, spoke in support of the facility. He stated he is a trap shooter who currently utilizes Mr. Brough's facility, and he has been doing so since 1988. He further stated there have been no accidents or safety problems and Mr. Brough is a very responsible individual. John Loftus, Greeley, stated he is a faculty member at the University of Colorado and he also supports the facility. He also stated in the five years he has been shooting at Mr. Brough's facility he has noted an extraordinary commitment to safety. Stan Cass, Briggsdale resident, said he is in support of the facility as long as the applicant follows through with the Conditions and Development Standards, since he is concerned about traffic, dust, and trash. He applauded the efforts of the applicants in creating a safe facility, and stated the noise may occasionally be a problem but since the shooting is directional, most of the concern has been abated. Mr. Cass stated the pros outweigh the cons and this will be a Best Managed range. Responding to Commissioner Kirkmeyer, Mr. Brough stated there will be no alcohol allowed, anyone with alcohol will be asked to leave the range; therefore, he has no objection to an additional Development Standard requiring a sign to be posted at the entrance. He also stated campers w II be limited to two consecutive nights, dust will be treated twice each year, and he agrees with all the other Conditions of Approval and Development Standards. Responding to questions from Commissioner Baxter, Mr. Brough clarified dust will be sprayed south along the corrals plus an additional150 feet. Responding to Commissioner Baxter regarding further dust suppressant if traffic increases, Mr. Brough stated he is hesitant to provide a long-term commitment when the amount or frequency is unknown. Commissioner Kirkmeyer moved to approve the request of Pawnee Sportsmans Center for a Site Specific Development Plan and Special Review Permit#1221 fora Recreational Facility(Shooting Range) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as 991254 PL1304 HEARING CERTIFICATION - PAWNEE SPORTSMANS CENTER (USR#1221) PAGE 3 entered into the record and amending Development Standard #18 by deleting the words, "not 1:o exceed"and replacing with the word"at"; changing Development Standard#23 to state, "Overnight camping shall be limited to two consecutive nights, and only self-contained campers shall be allowed"; adding Development Standard#29 requiring a sign to be posted at the entrance stating, "No alcohol is allowed at this facility. Anyone found to be in possession of alcohol will be asked 1:0 leave immediately";and renumbering the remaining Development Standards. Mr. Morrison clarified that if Development Standard #23 is changed to exclude the words, "No temporary housing shall be permitted on site"the applicant may apply for a temporary permit to be used during construction. Chair Hall verified Mr. Brough agreed with the changes as listed. Seconded by Commissioner Vaad, the motion carried unanimously. This Certification was approved on the 2nd day of June, 1999.
