RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST CARMEN AND BILLY MATA FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Carmen and Billy Mata, VI #9600191, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of December, 1996, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Billy Mata, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of
said violation to the Weld County Attorney's Office for a period of sixty (60) days to allow
adequate time for the property owners to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into
compliance within sixty (60) days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that if said violation still exists on February 10, 1997, the Weld County
Attorney be, and hereby is, authorized to proceed with legal action against Carmen and Billy
Mata to remedy the violation of the Weld County Zoning Ordinance, and any other persons
occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The noncommercial junkyard is still located on the property, therefore is a violation of Sections
31.2 and 31.3.9 of the Weld County Zoning Ordinance. There are also violations of the Weld
County Building Code Ordinance, Sections 20.13.2.6, 20.13.6, 20.13.8.1, 20.13.8.2, 20.13.5.
To bring the property into compliance the noncommercial junkyard must be removed from the
. property or be visually screened from all adjacent properties and public rights of way. The
building code violations need to be brought up to Weld County Building Code Standards.

County Building Code Ordinance.
Explanation of Violation:
20.13.2.6; Lack of adequate heating facilities. The propane supply line is broken and disconnected.
20.13.6;Hazardous Plumbing. Broken P-trap under kitchen sink.
20.13.8.1;Broken windows.
20.13.8.2;Leaking roof.
20.13.5;Hazardous Electrical Wiring.
It is the intention of this office to assist and cooperate with the residents of Weld County without imposing
undue hardships;However,we have no discretion in this matter if you fail to correct this violation. You will
have five days from November 1, 1996 to correct this violation. Failure to do so will result in this office
refering the violation to the County Attorney's office for appropriate legal action.

10:00 a.m. to consider the violations occurring on the property. This meeting will take place in
the County Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915
Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the

10 10/30/96 WAS THERE ART WANTED ME TO COME IN AND LOOK AT THE INTERIOR
11 10/30/96 OF THE HOUSE. HE SAID THAT HIS ROOF WAS LEAKING AND BILLY
12 10/30/96 MATA WOULD NOT FIX IT. I WENT INTO THE HOUSE AND FOUND

The uses on the above described property are being considered as a zoning violation of Section 31.2 and
31.3.9 of the Weld County Zoning Ordinance. This is not a use allowed by right in the Agricultural zone
district.
The violation can be corrected by removing the noncommercial junkyard from the property or screening
it from all adjacent properties and public rights of way. If screening is to be used to conceal the
noncommercial junkyard, a detailed screening plan must be submitted to and approved by the
Department of Planning Services prior to installation. The sheds and addition to the west side of the
house must be inspected by a Building Inspector to determine compliance with the Weld County
Building Code Ordinance and any appropriate permits for these structures must be obtained. These
structures must also meet any required setbacks and offsets.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this.violation. You have 30 (Thirty)
days from September 26, 1996 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

The Department of Planning Services is increasingly becoming aware of code violations in your
neighborhood. We currently have several cases pending and are receiving an increase in the number
of citizen complaints. The need to have a safe place for our families is one in which we all try to
achieve. The Weld County Zoning Ordinance has established safety and health regulations intended
to ensure the safety and health of a community.
We have listed the common most prevalent violation we are experiencing in this area:
Noncommercial junkyard-this may consist of inoperable vehicles or vehicles without current license
plates, used building materials: such as used lumber, bricks, cinder blocks, plumbing, scrap metals,
etc., tires, piles of tree limbs, trash and other types of debris which is visible to other properties, public
rights of way or both.
If you would like a personal site evaluation I will be happy to visit your site to investigate the
possibility of a violation and direct you on clean up procedures. An inspection of the entire Evans
area in unincorporated Weld County will be conducted around September 2, 1996. If you have any

Dear Monica,
As you are aware the City of Evans borders an area of unincorporated Weld County southwest of
the intersection of 17th Avenue and 37th Street in the vicinity of the Valley View Subdivision.
Over the past few years City staff has received numerous complaints regarding activities being
conducted in this general area related to zoning and building issues. A majority of these
complaints were related to the storage of junk vehicles, questionable building practices, unsafe
structures and general trash and debris being allowed to exist on the properties. As the land which
surrounds this area is being developed these complaints have intensified in number and frequency.
On July 9, 1996 a number of residents from this area attended the City of Evans Planning &
Zoning Commission meeting and requested the City's assistance in regard to addressing these
issues. These residents reiterated there concerns with junk vehicles, dilapidated buildings, trash&
debris and illegal business activities such as repair shops being operated in this area.
Realizing that County staff has already begun abatement proceedings on at least two properties in
this area, those being the Parker and Downing parcels, City staff is requesting your assistance in
addressing violations of the County planning and building codes throughout the area. City staff
does appreciate the fact that there are a number of properties in this area that are well maintained
and would not be impacted by stricter enforcement of the existing regulations; however, with
development rapidly encroaching into,this area and the increase in the number of complaints the
City is receiving it is apparent that the need to address this issue is becoming more critical.
Therefore, staff with the City of Evans would like to meet with you and your staff to discuss
possible solutions to help remedy the situation. Please contact us by calling 339-3475 to arrange a
