The Fire District has no objections to the project if the requirements of the District can be met. The Fire District has adopted the 1991 Edition of the Uniform Fire Code and the activities in the mine will be covered by this Code. The principle applications of the Code to a gravel mine will be for tank installations for flammable or combustible liquid, fueling operations, vehicle repair, including welding, and any use of hazardous materials. Tanks for flammable or combustible liquid storage or dispensing, either temporary or permanent, need to be installed in accordance with the requirements of the Code. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. An Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit application must be submitted to the Air Pollution Control Division, Colorado Department of Health for emissions of criteria, hazardous or odorous air pollutants. Sources of such emissions include but are not limited to the following: sandblasting operations, mining, spray paint booths, dry cleaners, haul road traffic, composting, boilers and incinerators. 3. The existing Emission Permit must be modified for the increased operation if the Colorado Department of Health determines that such a modification represents a significant change in emissions or production. 4. No permanent disposal of wastes shall be permitted at this site. 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be controlled on this site. 7. The maximum permissible noise level shall not exceed the light industrial limit of 70 db(A) , as measured according to 25-12-102, Colorado Revised Statutes. 8. Adequate toilet facilities shall be provided at this facility. These may consist of an absorption system, a vault system or maintained port-a-potty facilities. 9. A NPDES Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 10. District 5 Dear Ms. Eastin: We have reviewed the above referenced application to add 132.95 acres to an original permit for a gravel mining operation, which includes both a concrete and asphalt hatching plants, offices and scale house. The mining operation is expected to have 12 employees and have a duration of 13 to 15 years. An estimated maximum of 400,000 tons of raw material will be excavated per year. Annual water use during mining operations for dust control, processing and product content, and evaporation from exposed ground water is estimated at 21.6 acre feet. The applicants propose two lined ponds with a total surface area of 34.31 acres as the reclamation option. Water for drinking will be form bottled water. Water for restroom, washing, and processing is provided by an adjudicated well on site. The applicant has well permit No. 042746-F, for the existing pit and have submitted a proposed substitute supply plan to replace stream depletions. As long as the consumptive use of water does not exceed the 21.58 acre feet permitted and the total area of ground water ponds does not exceed 2.1 acres, a new well permit will not be required. The applicant does have a substitute supply plan to replace stream depletions which will expire on April 1, 1995. The applicants representative have indicated that an application to renew the substitute supply plan will be submitted prior to April 1, 1995. We have no objection to the proposal contingent upon the extension of the substitute supply plan being approved by the State Engineer. If you have any questions in this matter, please contact me. The DMG reviewed your current permit and did not find an approval for the use of batch plants on the Distel Farms permit area. Therefore, the DMG recommends that, prior to the installation of a concrete and/or asphalt plant on this site, you obtain a technical revision from us approving such activities. Obtaining the revision approval prior to conducting these activities will avoid any future enforcement actions related to this matter. The DMG also noted in the County application a copy of a DMG Succession of Operators form, transferring the Distel Farms permit from C & M Companies to C & M Aggregates Limited, dated January 17, 1995. Eastin, Current Planner Date February 24, 1995 COLORADO Jat From Donald Carroll Case Number 2-AM USR-877 C & M Aggregates Subject: I have reviewed the application and have the folowing comments on the existing access and the haul route: On the vicinity map, the existing access appears to be parallel to the abandoned Burlington Northern railroad tracks. Is the access point onto WCR 20.5 at a 45° angle as indicated on the vicinity map? This access should enter onto WCR 20.5 at 90° to provide adequate site distance east and west. I have verified with the County Engineer the existing haul route for all the heavy hauling in the Rinn area using WCR 20.5 and WCR 7 as the main haul routes. The applicant is indicating that they will be sending additional traffic west of the access on WCR 20.5 to WCR 1, then disbursing north and south. This is not a designated haul route, nor does Weld County have any type of road maintenance agreement for the repair and maintenance of this section at this particular time. Our latest traffic counts were taken in November of 1992 at the intersection of WCR 1 and WCR 20.5. We have counted over 2000 vehicles per day on that stretch. Shani Eastin - Current Planner Department of Planning Services Weld County Administrative Offices 1400 N. 17th Avenue Greeley, CO 80631 Dear Shani : We have reviewed the C & M Aggregates Special Use Permit, and offer the following comments : ACCESS Since this development' s access is provided by way of public street connections to SH 52 and SH 119, our interest is focused on the condition of those access points to the state highway system. The SH 119/Weld County Road 1 access is an improved intersection. This development would not likely trigger any changes there . The narrative states that 25% of the total traffic volume generated by this development would access by way of the SH 119/WCR 7 connection. We are not able to determine from the information provided if the development will result in a 20% increase of traffic. Such an increase would deem the access to have changed use and would require re-evaluation of access as defined by Section 2 . 10 . 3 of the State Highway Access Code (SHACode) - The County should be reminded of their obligation in regard to this access . Section 2 . 10 .4 of the Code states : "Vehicular use and operation of public accesses (county roads and municipal streets) to the state highway is the responsibility of the appropriate local authority. The local authority should d 1 X H IIIIT maintain access conformance with the Code to the ��. extent feasible and practicable within statutory and public funding limitation.
