USR-1135) DISCUSSION: The Windsor Planning Commission is recommending approval of the Soukup Investments, LLC Site Development Plan and Special Review Permit, subject to all of the following requirements being met: 1 . That there be an annual review of the operation by Weld County to verify that the on-site health facilities (septic system, water discharges, ditches, waste removal, etc.) will be maintained properly and not cause public nuisances, as outlined in the Applicant's Use by Special Review Questionnaire. 2. That if there is any residential development which qualifies as a "major subdivision" within the corporate limits of Windsor and is within one thousand (1 ,000) feet of any of the property lines of the subject property, the operation will be required to cease and desist on a permanent basis at the end of the six- month operating period in which the preliminary subdivision plat is filed; and 3. That area residents be contacted to offer public input and, in considering the application, the Weld County Board of Commissioners take all of said public under advisement prior to making any decision on the application. Finally, I am planning to attend the public hearing on December 3, 1996 to reiterate these comments before the Board, and as such I would like you to fax me an agenda of that meeting date and time as soon as possible. The ADT exceeds 3,000 vehicles per day at this particular location. My major concern is to close two access points, one to the silage pit and one just east of the silage pit. Both access points are below the crest of the hill with limited sight distance to the west. I measured the distance at 315 ± feet. This is NOT adequate sight distance for a posted speed of 55 MPH. The silage pit may be accessed from the scale house area through an internal road system. Drainage: The storm water run-off from the cattle pins are to be addressed by the Health Department. Prior to recording the plat, the applicant shall submit, for review and approval, a plan which describes how the facility intends to handle manure and wastewater. The plan shall be submitted to the Environmental Protection Division of the Weld County Health Department. At a minimum, the plan shall demonstrate: a) How manure generated at the site will be managed. This should include the frequency at which pens are cleaned, manure storage locations, manure land application sites, etc. b) How precipitation and flow-through water which has come into contact with manure is managed. This should include any control structures such as lagoons, ditches, terraces, etc. which will be in place to control manure contaminated runoff. c) How the facility will prevent discharges off-site, with the exception of that which is allowed by the Confined Animal Feeding Operation Regulations (5 CCR 1002-19) . Specifically, how the facility will prevent contaminated water discharges to the irrigation ditch which dissects the property. d) Any other features which will be incorporated at the facility to manage manure and manure contaminated water. 2. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. 3. The facility shall operate in compliance with the Confined Animal Feeding Operations Control Regulations (5 CCR 1002-19) and Weld County Zoning Ordinance, Section 47. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 917.05/? Soukoup Investments, LLC. USR-1135 October 23, 1996 Page 2 5. The facility shall not discharge to surface or groundwater with exception to what is allowed by the Confined Animal Feeding Operations Control Regulations. 6. No permanent disposal of solid wastes, as defined in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2) , shall be permitted at this site. 7. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s) . In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. 10. A dust abatement plan shall be submitted to the Health Department for approval prior to any expansion of the operation. The facility shall have sufficient equipment available to implement the dust control as required by the Health Department. 11. The facility shall be operated in a manner to control flies. A fly control plan shall be submitted to the W.C. Health Department for review and approval. The plan shall be implemented at the request of the W.C. Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. This plan shall be implemented in the event the W.C. Health Department receives a significant number of fly (associated with the facility) complaints and, in the judgement of the Health Officer, there exists a fly condition requiring abatement.
