LEGAL DESCRIPTION: Part of the NI NEi of Section 35, T1N, R68W of the 6th P.M. , Weld County, Colorado LOCATION: North of Weld County Road 2 and west of and adjacent to Weld County Road 11. be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The proposed use is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. The proposed use is located within the Urban Growth Boundary area of the City of Northglenn, City of Thornton, and the City of Broomfield. The Representatives from the City of Northglenn, the City of Thornton, and from the City of Broomfield have reviewed this request and found no conflicts with their interests. The proposed use is consistent with the intent of the Agricultural zone district and is provided for as a use by special review. EXHIBIT 95O46O f� e& 1 (Born 4 �• Johnson/Chana Amended USR-478 Page 2 - The proposed use is compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Agricultural zone district, the City Broomfield's Planned Unit Development zone district and the City of Thornton's Industrial zone district. The surrounding land uses include a wastewater treatment facility, farm production, and rural residential uses. - No overlay districts affect the site. - Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to scheduling before Board of County Commissioners: - all conditions of approval for RE-1248 shall be met and the recorded exemption plat recorded; and - the applicant shall submit evidence to the Department of Planning Services that the State Engineer Division of Water Resources has approved the water supply for the dog kennel operation. 4. Prior to recording the special review permit plat, the plat shall be amended to show the correct boundary line for the special review permit. 9504SO • 5. Within 30 days of approval by the Board of County Commissioners: - the applicant shall submit evidence to the Department of Planning Services that a soil erosion control plan has been approved by the West Adams Soil Conservation District; and - the applicant shall submit evidence to the Department of Planning Services that an I.S.D.S. Evaluation has been completed on all existing septic systems on site. Secr- ary 950460 A w• SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS ROBERT AND KATHERINE JOHNSON RICHARD AND MARCIA CHANA AMENDED USR-478 1. The Site Specific Development Plan and Special Review permit is for a breeding, raising, and training facility for no more than 300 greyhounds as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. Dog manure, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be confined on this site. 7. The maximum permissible noise level shall not exceed the industrial limit of 80dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 8. An individual sewage disposal system, is required for the facility and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. 9. The property shall be maintained in compliance with the Soil Erosion Control Plan approved by the West Adams Soil Conservation District. 10. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 9504►B0 •ry A • Johnson/Chana Amended USR-478 Page 2 12. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 13. Personnel from the Weld County Health Department, Weld County Department of Planning Services, and West Adams Soil Conservation District shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 14. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. LEGAL DESCRIPTION: Part of the Ni NE$ of Section 35, T1N, R68W of the 6th P.M. , Weld County, Colorado. LOCATION: 3/4 mile north of Weld County Road 2 and west of and adjacent to Weld County Road 11. APPEARANCE: John Barry, Attorney, representing Robert & Katherine Johnson and Richard and Marcia Chana. Mr. Barry explained the Dr. and Mrs. Johnson purchased part of the property north of the canal which is approximately 30 acres. They wanted to separate the younger greyhounds from the rest of the dogs. There are approximately 30 greyhounds north and 70 greyhounds south of the canal. John Barry stated that they did not have a problem with the Department of Planning Services' staff recommendation except for Development Standard #9, regarding the time that the dogs should be kept inside the kennel building. Richard Chana stated the reason to amend is to allow the greyhounds to be housed north of the canal. The nearest neighbor is .25 mile to the north, there are a couple of families that live on the farm to the south and to the east there is a wastewater treatment plant. Mr. Chana said that the greyhounds keep normal hours and don't bark unless there is a prowler, deer or someone is disturbing them, and has never seen a solid wood fence in a greyhound facility. The vice chairman asked for discussion from the audience. There was none. MOTION: Jean Hoffman moved to accept the Department of Planning Services' staff recommendation with the exception of Development Standard #9. It would be deleted and the remaining devlopment standards renumbered.
