HomeMy WebLinkAbout971152.tiff RESOLUTION RE: APPROVE PERSONAL CARE BOARDING HOME CONTRACT AMENDMENT#1 BETWEEN THE WELD COUNTY HEALTH DEPARTMENT AND THE COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with the Personal Care Boarding Home Contract Amendment#1 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Health Department, and the Colorado Department of Public Health and Environment, commencing July 1, 1997, and ending June 30, 1998, with further terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Personal Care Boarding Home Contract Amendment#1 between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Health Department, and the Colorado Department of Public Health and Environment be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 18th day of June, A.D., 1997. WHEREAS, authority exists in the law and funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available payment in Fund Number 246, Appropriation Code 795, Contract Encumbrance Number HFD960006; and WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and WHEREAS, the parties entered into a contract dated July 6, 1995, Contract Encumbrance Number HFD960006, Contract Routing Number 960006, as amended by contract renewal letter dated June 14, 1996, routing number 9705038, hereinafter referred to as "Original Contract," whereby contractor was to provide certain services to the State; and WHEREAS, the State desires to renew the contract for one additional period and provide funding for this renewal period and to amend paragraph 4 of the Original Contract to provide for an increase in the flat reimbursement rate from $265.00 per facility survey to $290.00 per facility survey. NOW THEREFORE, it is hereby agreed that: 1. Consideration for this Amendment to the Original Contract, Contract Encumbrance Number HFD960006, Contract Routing Number 960006, dated July 6, 1995, as amended, consists of payments which shall be made pursuant to this agreement and the promises and agreements herein set forth. 2. All terms, conditions, and provisions of the Original Contract, unless specifically modified herein, are to apply to this Amendment as though they were expressly rewritten, incorporated, and included herein. 3. It is agreed that the Original Contract is and shall be modified, altered. and changed in the following respects only: a. In accordance with paragraph 4, an page 2, of the Original Contract, the parties hereby agree the Original Contract is hereby renewed for the period of July 1, 1997 through June 30, 1998. The parties agree that the maximum amount payable by the State for the eligible services, as described in the Original Contract, during this renewal period is SEVEN THOUSAND FIVE HUNDRED AND FORTY DOLLARS ($7,540.00). This dollar amount is subject to change based on differences between estimated and actual funding appropriations and legislative approval. A revised list of facilities as described in paragraph 4.b, page 2, of the Original Contract, is attached hereto as Revised Attachment 3 and incorporated herein by this reference. Reimbursement shall be conditioned upon affirmation by the State that services were rendered in accordance with the Original Contract. Attachment 3 of the Original Contract is hereby modified accordingly. b. The reimbursement rate stated in paragraph 4, on page 2, of the Original Contract, is hereby changed from $265.00 per facility to $290.00 per facility. The Original Contract is hereby modified accordingly. 4. The effective date of this Amendment is July 1, 1997. 5. Except for the "General Provisions" and "Special Provisions," in the event of any conflict, inconsistency, variance or contradiction between the provisions of this Amendment and any of the provisions of the Original Contract, the provisions of this Amendment shall in all respects supersede, govern, and control. The "Special Provisions" shall always be controlling over other provisions in the contract or amendments. The representations in the Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed. 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE. 7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS HE MAY DESIGNATE. This amendment increases the amount the Health Department will be paid for annual inspection and complaint investigation of personal care boarding home facilities in Weld and Larimer counties from$265 to $290 per facility. The Health Department will be responsible for these services for 15 facilities in Weld County and 11 facilities in Larimer County. For these services, the Health Department will be reimbursed an amount not to exceed $7,540 for the period July 1, 1997 through June 30, 1998. This is a valuable service for a critical public health population, the elderly and mentally ill, who cannot care for themselves. Health Department staff recommends your approval of this amendment.
