September 4, 1997
A regular meeting of the Weld County Planning Commission was held September 4, 1997, in the County
Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by the Chairman, Glenn Vaad, at 1:30 p.m.

The summary of the last regular meeting of the Weld County Planning Commission held on August 19, 1997,
was approved.

APPLICANT: Hall-Irwin Construction Company
PLANNER: Shani L. Eastin
REQUEST: A Site Specific Development Plan and a Special Review Permit for a Sand and Gravel Mining
Operation in the A (Agricultural)zone district.
LEGAL DESCRIPTION: The SE4 of Section 36,Ti N, R67W of the 6th P.M.,Weld County, Colorado.
LOCATION: North of and adjacent to Weld County Road 2;east of and adjacent to Weld County Road 23-
1/2.
Shani Eastin explained that the applicant submitted a letter to the Department of Planning Services, requesting
the special review permit application be withdrawn to give them time to review other alternatives.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Stephen Mokray moved Case Number-1164, Hall-Irwin Construction Company, be withdrawn. Motion
seconded by Bruce Fitzgerald.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Fred
Walker- yes; Marie Koolstra -yes; Jack Epple-yes; Bruce Fitzgerald -yes; Stephen Mokray -yes; Rusty
Tucker-yes; Glenn Vaad -yes. Motion carried unanimously.

REQUEST: A Site Specific Development Plan and Special Review Permit for an Industrial Use (Storage
and Parking of Oil field Equipment) in the A(Agricultural) Zone District
LEGAL DESCRIPTION: NE4NE4 of Section 35, TSN, R66W of the 6th P.M.,Weld County, Colorado
LOCATION: West of and adjacent to 35th Avenue; approximately 700 feet south of Weld County Road

Shani Eastin gave an overview of the area surrounding this property. The Evans Ditch is located to the south
of the property, and mature trees creating a form of screening from the county road right-of-way exist to the
north. Other uses existing in the area are an oil and gas storage facility, the South Platte River, and small
rural residences. Floodplain issues could affect the property and these issues are addressed in the conditions
of approval and development standards. Shani explained that this proposal meets the requirements of the
Weld County Zoning Ordinance and the Comprehensive Plan,which allows for commercial and industrial uses
to locate in the Agricultural zone district, when the impact to surrounding properties is minimal and where
adequate services and infrastructure are available. The application meets the intent of the Agricultural zone
district in that no prime productive farm ground is being taken out of production and it meets compatibility
issues with surrounding land uses in the area.
Todd and Rhonda Amen handed out pictures of the type of equipment to be located on the property and Lee
Morrision marked these photographs as exhibits into the record.
Fred Walker expressed concerns that the way the recommendation from the Department of Planning Services
reads, the applicant would not be able to wash any of the equipment on the site. Discussion followed with
input from Sheble McConnellogue, who explained that wastewater disposal at a commercial facility involved
a submittal of a wastewater disposal plan that would need to be approved by the Weld County Health
Department. Todd Amen explained that they haven't purchased the property yet, so he didn't want to get any
further involved in the process at this time.
Marie Koolstra asked if the applicant planned to live on the site. Todd and Rhonda said yes. Ms. Koolstra
asked why the Health Department was requiring a separate bathroom on the site, if there were facilities
located in the existing residence. Sheble McConnellogue explained that the proposed shop building will be
farther than 200 feet from the residence and as a commercial operation this requires a separate Engineer
Designed septic system.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
Gladys Mascarendas, surrounding property owner, expressed concerns regarding flooding in the area when
it rains, drainage issues, and wildlife in the area. Shani Eastin explained that staff would follow-up with the
Division of Wildlife and include any concerns they may have as conditions of approval at the Board of County
Commissioners' Hearing.
Debbie Porter, surrounding property owner, expressed concerns regarding the number of employees entering
and leaving the property. She said that this is a very quiet area so she is concerned about increased traffic,
the noise level, and the fact that her dog barks at people in the area.

Todd and Rhonda Amen addressed the above concerns. Mr. Amen reminded the surrounding property
owners that this is not a request to change the zone but a request for a use by special review. He stated that
the word "commercial"sounds so immense,when in actuality the proposed operation is very small and most
of the equipment stays in the field not at the site. The amount of equipment that would be in and out of the
site compares to agricultural equipment used in the fields.
The Commission members had concerns that the applicant would not have room for even small growth due
to his application request listing the exact numbers of equipment and employees he now operates with. Shani
Eastin explained the process for a review of changes to a use by special review through the Department of
Planning Services. Language was also proposed for additional conditions of approval and development
standards in response to the surrounding property owners concerns.
Condition of Approval 2F.
2F. A wastewater handling plan shall be submitted for review and approval by the Weld County Health
Department for the washing of vehicles associated with the oil field business.
Development Standards-deletion of the existing#9,with an addition of a new#9, a new#10, and subsequent
renumbering.
9. Storage of oil field equipment on site shall be limited to 10 pieces
10. The number of employees on site shall be limited to 12.
Jack Epple moved Case Number USR-1163, Todd and Rhonda Amen be forwarded to the Board of County
Commissioners with proposed staff changes and additions for recommendation for approval. No second was
made. Motion failed.
Discussion followed regarding language that staff suggested.
The Planning Commission recommended the following language:
Condition of Approval#2F
2F. A wastewater handling plan shall be submitted for review and approval by the Weld County Health
Department for the washing of vehicles associated with the oil field business.
Development Standards-deletion of the existing#9, with an addition of a new#9, a new#10, and subsequent
renumbering.
9. Storage of oil field equipment on the site shall be limited to 12 pieces.
10. The number of employees on site shall be limited to 15.
Fred Walker moved Case Number USR-1163, Todd and Rhonda Amen, be forwarded to the Board of County
Commissioners with the Planning Commission's recommendation along with the Planning Commission's
changed verbiage, for approval. Stephen Mokray seconded the motion.
