RE: APPROVE TECHNICAL CORRECTION TO RECORDED EXEMPTION #1860 - CLAUS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on March 25, 1996, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101(10)(d), CRS, as amended, did approve Recorded
Exemption #1860 for Clayton Claus, 3759 Weld County Road 36, Platteville, Colorado 80651,
for property which is located in part of the Section 3, Township 3 North, Range 68 West of the
6th P.M., Weld County, Colorado, being more particularly described in the plat, and
WHEREAS, on April 24, 1996, the Board considered a request to consent to a
correction to Recorded Exemption #1860, which will expand Lot B to the existing fence line and
which expansion was originally intended by the applicants, but was erroneously omitted, and
WHEREAS, on October 28, 1996, the Board considered a request to approve a
technical correction to Recorded Exemption #1860, which will delete a triangular piece of
ground in the NW1/4 of Section 3, Township 3 North, Range 68 West of the 6th P.M., Weld
County, Colorado, located on Lot B of RE #1860, and
WHEREAS, corrections to recorded exemptions are allowed pursuant to Section 11.9 of
the Weld County Subdivision Ordinance to correct technical errors on the plats of approved
recorded exemptions, if such corrections are consistent with the intent of the original
applications.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request for a technical correction to Recorded
Exemption #1860, submitted by Clayton Claus on October 28, 1996, be, and hereby is,
approved.

SUBJECT: RE-1860 and SE-576 for Clayton Claus
Dear Commissioners:
Since the original approval of RE-1860 and SE-576, it has come to the attention of the applicant that
a parcel of ground originally included in the recorded exemption was actually held in a separate
deed. After conferring with legal staff, it became evident that the parcel could be considered a
separate parcel of ground and that it did appear at this time to be under separate ownership from
the rest of the property. The letter from the applicant's representative adequately explains the history
of the small parcel that lies north of and adjacent to the section line. Because this RE / SE
combination was originally approved by the Board of County Commissioners, staff is submitting the
requested changes to the applications for the Board's consideration.

RE: TECHNICAL CORRECTION REQUEST ON RE 1860
With this letter, I am requesting that a correction be allowed to the RE 1860 that was approved
by the Board of County Commissioners on March 25, 1996.
It seems that Mr. Claus thought he owned a triangle piece of ground in the NW'4 of Section 3,
Township 3 North, Range 68 West. His deed showed that he was the rightful owner, even the
Certificate of Conveyance that was completed for the application process of the Recorded
Exemption showed his ownership.
However, when Mr. Claus sold the Lot B, RE 1860, it was discovered by the title company when
they did a tax search that the triangle piece was owned by someone else who had purchased it
through a tax sale in 1960. It seems that a Quit Claim was made on the property in the NW'% of
this Section and the County Assessor's Office later determined that the parcel was separated
through that action. When no one paid taxes on that parcel, it was sold. To give clear title to the
purchaser on Lod B, RE 1860, it is now necessary to correct the plat by removing the triangular
piece and recording the correct legal description for Lot B.
I have enclosed a small plat map that shows the land in question and the technical correction to
be made to the plat map that will clear up the title for Mr. Claus and the new owner. Please let
me know when you have received approval for this correction, and or if additional information
is needed.
