Dear Commissioners:
As the above project lies partially in the flood plain[all of it, if it
were not for the former UPRR embankment],we remind the County and
applicant of the FEMA regulations relating reporting and application
necessary if development will result in changes to the flood plain.
We, also, remind the County and the applicant of Army Corps of Engineer
requirements in regard to changes resulting from development affecting
wetlands.
In general,we are encouraged by any project that will serve to retain
some open lands to preserve the rural nature of the area. It is
reassuring that in this case priority will be given to mining,as
required by statute,and County government will not have the opportunity
to ignore this by first permitting commercial, industrial or residential
development. If federal and state restoration regulations are observed
on the completion of mineral extraction,the site should become an
aesthetic asset to the area.

Subject: Colorado Geological Survey wetlands study and survey
Dear Commissioners:
It has come to our attention that the Colorado Geological Survey in
cooperation with EPA is involved in a program to assess the status and
management practices of counties and municipalities relating to wetlands
in Colorado. In connection with this the CGS sent a questionnaire to
each county requesting information regarding its engagement in wetland
management through land use or environmental ordinances, regulations or
policies,technical tools used,the existence of wetland maps,
inventories or classification schemes,types of wetlands recognized and
level of interest in technical assistance from the Dept.of Natural
resources for efficient wetland management.
We were surprised to find that there had been no response to the
questionnaire from Weld County government,according to the CGS report:
*Characterization and Functional Assessment of Reference Wetlands in
Colorado*.
We, in the Rinn-Del Camino area,are concerned with retention of the
character of this part of the County,part of which is its natural,
ecological attributes.There are considerable wetlands in the St.
Vrain-Boulder Creek drainages,and the restorations that are required to
follow the large number of ongoing surface mining operations will add
substantially to them.The fact that semiarid areas such as eastern
Colorado do not lend themselves to having extensive wetlands make what
we have even more valuable.The failure to respond to and cooperate with
this study leads to reinforcement of the perception that County
government is not concerned with these interests, but motivated only by
maximizing development and tax revenues in the MUD district. Even if
County government has no wetland program, it would seem supportive of
the interests of its citizens and the environment for it to accept the
offer of the CGS to provide technical assistance in formulating and
implementing such a program.
We would appreciate a response as to what the position of County
government is on this issue.
