RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST PAUL SOLIZ FOR VIOLATION OF THE WELD COUNTY
ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Paul Soliz, VI #9700223, is allegedly in violation of the Weld County Zoning
Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of March, 1998, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Paul Soliz, subject property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until June 8, 1998, to allow adequate time for the property owner to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Paul Soliz to remedy the violation of the Weld County
Zoning Ordinance, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until June 8, 1998, to allow adequate
time for the property owner to bring the subject property into compliance.

This manufactured home has not had any of the final inspections called for or completed,
therefore it remains in violation of Section 70.4.2 of the Weld County Building Code Ordinance.
To bring the property into compliance, the following inspections must be inspected and
approved: mechanical, skirting, water service, final plumbing, final electric, steps and landings.
Mr. Soliz' sister said he received a loan with which to buy a water tap and complete all
inspections, but he needs until the end of May to have the water meter and line installed. Due to
his willingness to complete the work and call for all inspections, the Department of Planning
Services recommends postponing legal action until June 1, 1998.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

The uses on the above described property are being considered as a Building code violation of Section
70.4.2 of the Weld County Building Code Ordinance.
The violation can be corrected by completing the installation of the mobile home and having the final
inspections approved by January 30, 1998.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from December 30, 1997 to correct this building code violation. Failure to do so will result in this
office scheduling the violation before the Board of County Commissioners to consider whether to refer
the violation to the County Attorney's office for legal action.

NOTICE

and Weld County Building Code Ordinance governing location, construction, demolition, and erection of the above proposed work for
which this permit is granted. The Building Official or her/his agents are authorized to order the immediate cessation at any time a
violation or the adopted codes or regulations appears to have occurred. Violation of any of the codes or regulations may result in
the revocation of this permit.
Buildings must conform with the plans as submitted to the Department of Building Inspection. Any changes of the plans or lay out
must be approved prior to construction. Any changes in the use or occupancy of the building must be approved.
In the event construction is not commenced within 180 days of the issuance of this permit then same is automatically expired.
Cessation of work for a period of 180 days shall also cause the permit to be expired. Weld County is not liable for workmanship.
