Health Department COLORADO CASE NO.: USR-1181 NAME: WEIDENHAMER, DAMEN & WALKER, KELLY Environmental Protection Services has reviewed this proposal; the following conditions are recommended to be conditions of approval: 1) A dust abatement plan shall be submitted to the Weld County Health Department for approval prior to operation. The facility shall have sufficient equipment available to implement the dust control as required by the Weld County Health Department. The following are recommended to be development standards: 1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2) No permanent disposal of wastes shall be permitted at this site. 3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4) Fugitive dust shall be controlled on this site. 5) The maximum permissible noise level shall not exceed 60 db(A), as measured according to 25-12- 102, Colorado Revised Statutes. This standard shall be monitored and enforced only as the result of an adjacent property owner complaint. 6) Adequate toilet facilities shall be provided for patrons of the facility. 7) The facility shall provide a safe and adequate drinking water source, at all times to patrons of the facility. In the event the on-site well provides water for drinking, it shall meet all the necessary requirements for a "non-community" water supply as defined in the Colorado Primary Drinking Water Regulations (SCCR 1003-1). Bottled water provided by a commercial source shall be considered an adequate source. 8) Two permanent individual sewage disposal systems are required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Vault systems shall be acceptable. Both systems shall be located near the snack bar and stands. It shall provide a separate unit for both men and women. A) The permanent on-site systems(described above) shall be adequate for up to 100 daily users of the facility. In the event daily used of the facility exceeds 100 patrons, separate men and women septic systems shall be installed for every 100 daily f. - EXHIBIT 981578 Weidenhamer/Walker USR-1181 Page 2 B) The facility may supplement the on-site septic systems with port-a-potty units for temporary events where the existing systems are not sufficient for patrons of the facility. The on-site systems shall be adequate for up to 100 daily users of the facility. The facility shall provide one(1)port-a-potty unit for each additional 100 expected patrons for temporary events. C) If vault units are installed, they shall be maintained in a sanitary manner to prevent nuisance condtions, such as odor, flies, etc. The vaults shall be pumped by a licensed septic tank cleaner. D) In the event the facility installs a sub-surface absorption septic system or other septic system where disposal will occur on-site,those systems must be designed by a Colorado Registered Professional Engineer. E) The disposal of all sewage generated at the site shall comply with the Weld County Individual Sewage Disposal System Regulations. 9) The applicant shall remove, handle,and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 10) The facility shall comply with the Rules and Regulations Governing the Sanitation of Food Service Establishments in the State of Colorado. It is maintained by Weld County. The site is vacant with no visible structures. Our most recent traffic count taken in 1991 indicates that WCR 398 east of the Keenesburg city limits is 200 vehicles per day. No more recent count has been taken. REQUIREMENTS: The applicant has indicated two access points to the facility. I recommend that only one access point is granted. The access point at the east portion of the property will require a very large drainage culvert. The applicant needs to submit a drainage study identifying how the run-off water from the site would be handled at this facility. The drainage study should indicate the size of the culvert required at the entrance to the facility. The study should also include calculations and a detention or retention facility, if required. I have reviewed the off-site parking. The site appears to have adequate parking spaces with some possible over flow parking, if needed. There will be no staging or parking on WCR 398 at this facility. All parking will be within the facility. The applicant needs to place on the plat the utility set backs at this location. The minimum utility set back is a 15- foot perimeter easement around the entire site. This would accommodate any utility that would need to use the easement. BROMLEY LANE SOIL CONSERVATION CONSERVATION BRIGHTON, CO 80601 DISTRICT SERVICE (303) 659-7004 ***************************************************************** March 9, 1998 TO: Scott Ballstadt, Weld County Planning Department FROM: Southeast Weld Soil Conservation District RE : Site Specific Development Plan and Special Review Permit for a Recreational Facility, Case #USR-1181 We have reviewed the application for a Site Specific Development Plan and Special Review Permit for a Recreational Facility, Case #USR-1181, for Darren Weidenhamer and Kelly Walker and have the following concerns : EROSION CONTROL *************** The Olney loamy sand and the Valent and Osgood sands are considered extremely erosive soils . The existing weed cover is not adequate to control soil erosion over the long term. We request that the applicant plant the enclosed mix of native grasses according to specifications on areas not covered by gravel for parking to prevent soil erosion. Construction activities need to be limited to impact as few acres as possible . If soil erosion is observed during construction, silt fences can be constructed to prevent the soil from blowing. In addition, water can be sprinkled on disturbed areas to control blowing dust . WASTE DISPOSAL ************** The applicant stated that the storage and/or stockpile of wastes will occur in a dump site, enclosed in a fenced area near the office structure . We are concerned that there was no mention of how long waste will be stored or where eventual disposal will occur. Before approval of this application, we request that the applicant provide a more detailed plan wherein these issues are resolved. SOUND BARRIER ************* A row of trees will be planted along the west side of this facility to act as a sound barrier. An effective sound barrier requires careful planning and design. We recommend that the applicant contact the Natural Resources Conservation Service to develop design for the barrier that will succeed in reducing the sound produced by raceway activities . 9S15t8 SOIL LIMITATIONS **************** All of the soils located where the construction will occur have moderate limitations for the development of septic systems because of slow percolation. The Colby-Adena loamy have moderate limitations for the construction of local roads and streets because of low strength. The Weld loam has moderate limitations for roads from shrink-swell capacity and frost action as well as low strength. Small commercial buildings constructed on the Colby-Adena loam or the Olney loamy sand will encounter moderate limitations from steep slopes . If small commercial buildings are constructed on the Weld loam, moderate limitations from shrink- swell capacity will be encountered. SOCIAL IMPACT ************* Since this facility could have a potentially negative impact on the rural quality of life of people living in the vicinity, we recommend that those living near enough to be adversely impacted by the sound produced be contacted to determine if they would support this application.
