BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Christie Nickles that the following resolution be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: CASE: Ordinance 147-N APPLICANT:Tuttle Applegate Inc., c/o Glen S. Douthit PLANNER: Shani L. Eastin REQUEST: Comprehensive Plan Amendment Structural Land Use Map 2.1 LEGAL DESCRIPTION: NE4 of Section 26, T3N, R68W of the 6th P.M., Weld County, Colorado. be recommended favorably to the Board of County Commissioners for the following reasons: Section 2.E.1 -The existing Comprehensive Plan is in need of revision as proposed. At the time of revision of the Mixed Use Development Plan public sewer was not available to service the subject property. Public sewer service can currently be made available to the subject site by St.Vrain Sanitation District. The Mixed Use Development area was recognized in 1987 in the Weld County Comprehensive Plan as a future urban development corridor within Weld County. In February of 1997 the Mixed Use Development area was re-evaluated by County staff and consultants to formulate the Mixed Use Development Ordinance (Ord. 191). Ordinance 191 is intended to guide and implement planned land use changes in the MUD area. The subject property is within a % mile of the interchange of I-25 and State Highway 66. The surrounding area has experienced recent growth which has occurred partially through the County and also through the Town of Mead. Inclusion of this property within the Mixed Use Development area will ensure that proper measures are taken to impose urban type standards on development as it occurs. Staff, however, recommends that the applicant adjust the proposed structural land uses to include limited site factors along the natural drainage area that traverses the property from the south west to the north east. Section 2.E.2-The proposed amendment will be consistent with existing and future goals, policies and needs of the County. MUD.Goal 1 -To plan and to manage growth within the 1-25 Mixed Use Development area and Urban Development Nodes so as to balance relevant fiscal, environmental, aesthetic, and economic components of the area. The current policy statements and regulations concerning the 1-25 MUD area require environmentally and aesthetically pleasing designs. All development in the MUD area is required to address and pay its proportionate share of the impacts created in the community. Future application proposals will be required to describe in detail the impacts of any proposed development of the subject site. MUD.Goal 2-To assure a well-integrated, balanced,transportation system which meets the public need with maximum efficiency, comfort, safety and economy. The major thoroughfares within this area are either federal or state systems. However,there is an increasing concern about the present congestion on these systems. With the addition of more people to this area Weld County roads will be required to handle more and more of the transportation in the area. Development will also require that the local road systems be enhanced to an urban level of service. MUD.Goal 3-To provide efficient and cost-effective delivery of adequate public facilities and services which assure the health, safety, and general welfare of the present and future residents of Weld County and the area. All of the proposal can be served in the future by a public sanitation district(St.Vrain Sanitation). Public water is also available to the proposed area (Little Thompson Water District). All future developments will be required to connect to these systems. Fire protection in the area is provided by Mountain View Fire Protection District. MUD.Goal 5-The coordination of other municipal, county, regional, and state growth policies and programs which include this area should be evaluated in order to minimize discrepancies, promote a better understanding of growth dynamics in the area,avoid duplication of services and to provide economies of scale. The area,in general,is growing at an accelerated rate,therefor the additional population base will encourage a further expansion of the economies of scale of services. Additionally cooperation with the Town of Mead will encourage a coordinated growth approach to handle impacts to the area. MUD.Goal 6-To assure that new development occurs in such a manner as to maintain an attractive working and living environment. Any proposed development will be required to adequately satisfy all goals and policies designed to ensure that an attractive and compatible working and living environment exists along the 1-25 corridor. The area to be included in the proposed expansion of the MUD district is in the Planning Area of the Town of Mead. 2. In its Interim Coordinated Planning Agreement with the TriTowns, Weld County has agreed that; "..the COUNTY shall require that there be executed [sic] annexation agreement between the applicant and the MUNICIPALITY upon the terms and conditions and within the time stated in the agreement." One must assume that the County agreed to this provision as being equitable to all parties. 3. Even though such an agreement does not formally exist between the Town of Mead and Weld County, in the interest of dealing in an evenhanded manner with all the municipalities in the County, it would seem only fair that the same terms and conditions be extended to the Town of Mead. Specifically, this courtesy should be extended to the Town of Mead in regard to an annexation agreement with the owner of the land now proposed to be included in an enlarged MUD. 4. The BOCC must be able to understand that all the developable land in the MUD will ultimately be annexed into one of the surrounding municipalities. This will occur in the natural course of economic and political events, and rightfully under the provisions of the Municipal Annexation Act. For the County to permit this land to be developed in a manner other than in conformity with the planning, zoning and building regulations of the Town of Mead would blatantly contradict the County's government alleged goal of having common development standards for county and municipal developments in the Southwest Weld Planning Area. 5. Further, it must be assumed that the area contained in the MUD when it was established was well considered. Therefor, there is the inevitable perception that this increasing of the size of the MUD is a preferential accommodation for the landowner[s] involved. 6. According to a newspaper report, the major landowner is proposing a commercial and employment center for his property. This zoning is inappropriate for this the land. The zoning should at the very least conform with the land use plan of the Town of Mead. 7. In the same article, it was stated that the landowner does not anticipate that the land would be developed in his lifetime. Taking into account the high cost of t l 031110V9Y �d iv 'ry C G : �L j CA running the sewer line to the property and not offsetting that cost promptly through its development; it would seem as a practical, economic matter that the landowner is not anticipating a long life. 8. This situation, where a landowner is given a choice of jurisdiction to get the best land use deal, runs counter to the best interests of appropriate planning and development. The County's MUD district has been a continuous source of developer leverage to gain their selfish interests, rather than the interests of the residents of the area. In addition, County government's continuous approval of inappropriate zonings and land use has further contributed to the planning and development chaos in the area [specifics on request]. It would be hoped that the BOCC will accept these comments as constructive input and not as a general criticism of their performance. As a group representing area residents and property owners in Southwest Weld County, there area number of issues with the MUD request that are not being addressed by the county. The report the LAND consultants sent to you addresses some our group's concerns. Today, we would like to highlight these concerns and add some of our own. I. Why would Weld County want to expand the I-25 MUD area when you referred and allowed property owners near I-25 and WCR 24 (Del Camino interchange) to annex to Firestone? II. Will the Mead Planning Commission and Town Board have an opportunity to formally review this proposal prior to your board's final decision? III. Why shouldn't a referendum allowing the voters in Mead to vote on formal annexation of this property to Mead be granted if the Town Board so chooses? IV. Who will pay for the additional infrastructure needed to service this development? A School facilities to accommodate 594 additional children plus the thousands of dollars needed to pay for staff and building maintenance. B. Road improvements 1. The Weld County Public Works Department has reviewed this proposal; the following requirements are recommended to be a part of any approval: COMMENTS: All access points to State Highway 66 will be controlled by the State Highway Department. Please contact Tess Jones to verify access requirements. The applicant is identifying commercial and residential areas as being a part of the proposed development. This abuts the Mead annexation so it should be determined if these land designations are compatible. REQUIREMENTS: I would recommend that the main access to the proposed facility be placed directly across from WCR 9%. This corridor is being expanded at the Rademacher Business Park, PUD, '/ mile north on WCR 9%. An 80-foot right- of-way will be required to accommodate a full billed out section. This would be the same concept as the Del Camino East Parkway, directly south and adjacent to 1-25, which is presently being constructed to relieve additional traffic from the 1-25 frontage roads and to relocate traffic to major interchanges. All roads within the MUD area must be built to the standards that reflect the usage in the area. Due to deadline for comments,neither the Mead Planning Commission nor the Town Board have had the opportunity to formally review this proposal at a regular meeting. When that review occurs, however,if there are other comments either body wishes to make we will forward those to you immediately. We realize that what is being considered is an amendment to the Weld County Comprehensive Plan (WCCP)to add an area to the I-25 Mixed Use Development (MUD)Plan Area. The request appears to be the start of a process leading to development of the proposed property under the jurisdiction Of the County although no time frame is mentioned. The proposed development appears to be adjacent to the MUD Plan Area- one of the criteria for addition. It also appears to be capable of - achieving 1/6 perimeter contiguity to Mead's existing boundary and therefore may be eligible for annexation tu Mead. There are parcels within the MUD Area that are already annexed to Mead. It is a goal of the WCCP is to concentrate urban development in or adjacent to existing municipalities or the I-25 MUD Area..." Perhaps we could achieve mutually beneficial goals by including the area within the MUD Area but simultaneously requiring that the proposal be set before the voters of Mead for annexation while there is still one owner. We,therefore, request that the voters of Mead be given the opportunity to vote on the question of annexing this land to Mead. By the creation of development standards for the MUD Area, Weld County is clearly interested in seeing that any development of an urban nature within the MUD Area be developed to an urban level of service. This includes standards for road design and construction, landscaping, signage, parking,open space,lot coverage, structure siting and utilities among others. There may be some concern that if this proposal were to be developed under Mead's jurisdiction, a comparable level of development standard would not be obtained. To attempt to resolve this concern, we would like suggest renewal of discussions between Mead and Weld County on the subject of an intergovernmental agreement(IGA). The subjects of development standards, urban growth area boundaries,land development referrals and other topics could be addressed therein. One of the criteria for amending the Weld County Comprehensive Plan is that the amendment will not place a burden upon existing or planned service capabilities. We have serious concerns regarding the impacts this development will have on the local schools. Otherwise the proposal will clearly represent an unresolved burden making the proposal not in compliance. Another major burden on existing and planned service capabilities will be realized when quite a bit of the vehicular traffic generated by this proposal is funneled to State Highway 66. REQUIREMENTS: I would recommend that the main access to the proposed facility be placed directly across from WCR 9%. This corridor is being expanded at the Rademacher Business Park, PUD, '/3 mile north on WCR 9%. An 80-foot right- of way will be required to accommodate a full billed out section. This development will impact the all levels of school capacity, and, in addition, the elementary school is already over capacity. Further, there are other approved developments in these attendance area which will, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in the Mead Elementary area with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. The District typically would oppose this type of development because it adds to the enrollment of already overcrowded schools. The developer, however has indicated the intention to enter into an agreement with the District to mitigate the impacts. This agreement would include the calculation of appropriate fees for cash-in-lieu of land to provide for the purchase of school land to serve these students. The attached spreadsheet indicates the equivalent land dedication or the per unit fee. We would like to meet with the developer when appropriate to develop the agreement. Once the agreement is implemented the District would not oppose this land use amendment. Douthit 4886 State Highway 66 Longmont, CO 80504 Consultant: TUTTLE APPLEGATE, INC. 11990 Grant Street Suite 555 Denver, CO 80233 TA#97-186 PROPOSAL TO AMEND THE WELD COUNTY COMPREHENSIVE PLAN INTRODUCTION This proposal wishes to amend the Weld County Comprehensive Plan by adding area to the I-25 Mixed Use Development (I-25 MUD) area. The parcel is 310 acres in size and is located north of St. Vrain Creek, south of WCR 30 (SH 66) and west of WCR 11. The general legal description of the property is as follows: E '/2 of Section 26, T3N, R68W, 6th P.M. The property is owned by Glen S. Douthit. The current land use is agricultural. In the future the owner would like to develop approximately 75%of this property for residential, and divide the remaining 25% between employment center and regional commercial uses. Following I-25 MUD/Weld County guidelines, 20% of each land use will be for open space/recreational activities. This property was not included in the original I-25 MUD area, in part due to the lack of water and sewer service, which will now be available. The Big Thompson Water District is willing to provide water to this parcel, and the St. Vrain Sanitation District would like to expand its service area to include this property (and others). Please refer to the attached I-25 MUD map locating the land and showing its land use designations. STATEMENTS (1) The Comprehensive Plan is in need of revision. The Weld County 1-25 Mixed Use Development Structural Plan was developed in 1987 as a joint effort between MUD area landowners and the newly formed St. Vrain Sanitation District. Properties adjacent to the Sanitation District service area which could not be served at that time were omitted from the MUD. With sewer system expansion in the intervening years, several of these landowners have petitioned successfully to be included in the MUD area. To accommodate employment and residential growth in this area of the I-25 corridor,the St. Vrain Sanitation District would like to expand the I-25 MUD boundaries to include the area north of St. Vrain Creek to SH 66. This property, which is directly adjacent to (north and east of) the existing MUD boundaries,plays a key role in these expansion plans. To serve this property and others, the Sanitation District will extend an existing service line north over St. Vrain Creek and across this property. This project would be funded partially by the Sanitation District, with the remainder from affected landowners. To realize a return on his investment and properly plan his property, this landowner is requesting that his land be included in the I-25 MUD Plan Area. 1 (2) This proposed amendment is consistent with the existing and future goals, policies, and needs of Weld County. The 1-25 Mixed Used Development Plan: Development Standards (Ordinance 191), was adopted in 1997 "to guide and implement planned land use changes within the MUD area." This amendment proposal has been prepared according to these guidelines, as well as those in the 1996 Weld County Comprehensive Plan. I-25 MUD Area Goals and Policies The provision of water and sewer services to this property through extension of the MUD boundaries will assure the health, safety and general welfare of future residents. Additional public facilities and services are available in the existing MUD Area, which will prevent duplication of service costs and help to support those facilities. The plan amendment will create an attractive living environment, with associated employment/commercial uses. The Planned Unit Development(PUD) process is well suited for this mixed-use proposal incorporating housing, employment uses, and open space. Low to medium density residential is compatible with the surrounding commercial, open space, and agricultural land uses. (3) The amendment will not place a burden upon existing or planned service capabilities. a. Roads Main access for this parcel is onto SH 66. Proper access permits will be obtained from Colorado Department of Transportation. Any additional roads or expansion to existing roads will be built and paid for by developers. The planned development of this area will control access onto County roads and the proposed land uses are compatible with the State and County road system in this area. b. Sewer Sewage collection and treatment will be provided by the St. Vrain Sanitation District. Mixed-use development of this property will contribute to the financial base of the Sanitation District and allow them to operate in a more efficient manner. c. Water Water distribution will be provided by the Little Thompson Water Company who 2 is willing to serve this area. Service from Little Thompson to the parcel will be from an existing 8-inch water line north of SH 66. The company has other customers in the area and the developer will pay for any additional waterline extensions or expansions. d. Fire Protection The Mountain View Fire Protection District serves this area. Initial response to this property will be from two of their seven stations: (1) The Main Central Station at 9119 County Line Road, which is maimed continuously, and (2)the Del Camino Station, which is volunteer response. e.
