The county charter limits advisory board members to a maximum of two full consecutive terms. Sometimes this creates a problem for the utility companies. They may have very few employees available who can provide the technical expertise needed to serve. The commissioners agreed the bylaws need to be amended to allow greater flexibility for the utility companies providing members . Roth Subdivision: Monica Daniels-Mika, Bruce Barker, Ed Jordan, Kim Fliethman, Dave Becker, and Don Warden The board received a request to post signs prohibiting motor vehicles from entering the park area within the Roth Subdivision. The board decided to acknowledge the park and regulate it in accordance with Ordinance No. 170 . Ed Jordan will schedule some neighborhood meetings to discuss community policing. Law Enforcement Advisory Boards: Ed Jordan, Bruce Barker, and Don Warden The Sheriff' s Office has received a $27, 038 Local Law Enforcement Block Grant directly from the Federal Bureau of Justice Assistance. Before the money can be disbursed, a Local Law Enforcement Block Grant advisory board needs to be established. Ed Jordan recommended combining this new board and as many existing law enforcement advisory boards as possible into one comprehensive board. The commissioners approved the idea. Ed and staff will study the possibilities and make a recommendation to the board. March 12, 1997 Dallas Horton (Cowan Feeders) Special Use Permit: Dallas Horton, Joe Hoff, Howard Franklin Monica Daniels-Mika, Shani Eastin, Julie Chester, Bruce Barker, Lee Morrison In 1971, a Special Use Permit was approved on a parcel located in the northeast quarter of Section 18 . Pens were built in part of the southeast quarter, which was not included in the Special Use Permit area. Dallas Horton, the current owner, is beginning an expansion of the pens in the southeast quarter. He believed the area was included in the permit. He can include a letter with the application to ask the board for permission to proceed with the expansion at his own risk. FACTS: 1.) Our current Special Use Permit #112 is for expansion to 22,000 head on 177 acres. 2.) Prior construction, prior county inspections and conflicting documents in the file are confusing as to whether we can expand on the NE quarter, the SE quarter or both. 3.)Horton Cattle Companies has been under the assumption since the purchase of the property it could expand on the full 320 acres. 4.) The feedlot was expanded in 1972-73.1300 feet into the South quarter. 5.) An inspection by the county in September of 1985 stated 18,000 "cows" are in the lot and "the feedlot is in compliance". At the time of that inspection approximately 4,000 head of cattle would have been in the pens located across the line on the SE quarter. 6.) Horton Cattle Companies felt because of prior construction into the SE quarter by 1300 feet and the county inspection stating we were in compliance that we had the authority to continue the prior expansion to the South into the SE quarter. 7.) With that assumption contractors are scheduled to start construction next Tuesday, March 18th with a May 15th deadline for completion. The May 15th deadline is because the Spring feeder cattle "run" is over by then and we would not be able to fill the pens until next Fall. 8.) To delay the contractors or cancel will cause Horton Cattle Companies heavy penalties and cost the contractors as well. Page 2 Honorable Commissioners, Horton Cattle Companies respectfully requests an administrative change to provide a boundary line adjustment to Special Use Permit #112. This boundary adjustment would allow expansion to the South which has the least impact on the majority of the neighbors, and fits the natural drainage best for optimum waste management. If Horton Cattle Companies expands to the West the neighbors and Highway 49 traffic will have a complete view of the pens. Also, the drainage is not as compatible for waste management. We want to emphasize we are not asking to expand the permit, change the head count or to expand the surface area above 177 acres. Thank you and the staff for your time and consideration. Eastin, Current Planner SUBJECT: SUP-112, Cowan Feeders (Dallas Horton) DATE: March 11, 1997 SUP-112 was approved by the Board of County Commissioners on August 23, 1971. The Special Use Permit allowed for 22,000 head of cattle on a parcel located in the NE%of Section 18, and that part of the NW% of Section 17, T3N, R64W of the 6th P.M., Weld County, Colorado. Upon construction of the facility in 1973, the pens were actually erected in part of the SE% of Section 18, which was not included in the Special Use Permit area. The current property owner, Dallas Horton, stated that he was under the belief that the Special Use Permit area was valid on the entire EA of Section 18. Upon confirmation of the resolution it was determined that the use is valid only on the NE'/ of Section 18 and part of the NW% of Section 17. Mr. Horton is beginning an expansion of the pens in the SE%of Section 18, which he believed to be in the permitted area of SUP-112. The original application request submitted to the Department of Planning Services in 1971 indicated that the Special Use Permit area was to include the entire EA of Section 18. The application legal description was changed in pen and initialed by "RWS", which appears to be the property owner at the time, to only include the NE % of Section 18. In 1983, the Department of Planning Services staff issued a zoning permit for a mobile home to be used as a office for the facility which included the legal description of the SE'/ and NE% of Section 18. On September 27, 1985, Keith A. Schuett, Zoning Inspector, inspected the site and stated the property was in compliance. To bring the property into full compliance with the current rules and regulations of the Weld County Zoning Ordinance the property owner would need to apply for and receive approval of an amendment to the original Special Use Permit (SUP-112) area to include the acreage in the SE% of Section 18. March 10, 1997 MAR 1 ? 997 Weld County Board of Commissioners ®"' °' w/ '°° Honorable Commissioners: This letter is regarding Special Use permit#112, a proposed expansion of the Horton feedlot located approximately 11 miles South and East of Kersey, Colorado on Road 49 (see map), and unusual discrepancies and extenuating circumstances of our dilemma. When Horton Cattle Companies purchased the property it was represented to us by the previous owner as having the permits in place and the ability to expand on the East '/z of Section 18 to 22,000 head capacity. Subsequently, it has been discovered the files regarding our Special Use permit #112 have conflicting information regarding whether Horton Cattle Companies has the right to expand on all of the East half of Section 18 (both the NE and SE quarters of 18) or only on the North East 1/4 of Section 18. Bullet points of the conflicting file data are as follows: I.) A legal application showing the total 320 acres submitted was changed to show only the NE 1/4 by a hand written correction. 2.) A resolution passed by the county planners stating the submission of an amended legal would allow them to recommend to the County Commissioners to grant expansion to the South(building pens on the full 320 Acres) versus building pens to the West restricting construction to the NE 1/4 only. 3.) No evidence is in the file to show the amended legal yet conversation with the applicant at that time, Mr. Bob Scherlong, assures me all legal documents were filed. The owners at that time, Cowan Feeders, went ahead and constructed pens to the South in 1972-1973 across the quarter section line onto the SE quarter- i.e. they built pens on the full 320 acres. 4.) An inspectors report dated September 27, 1985 stating 18,000 "cows" are in the lot and "the property is in compliance." Cont. as the NE quarter had cattle in them further assuring us the full use of all 320 acres was approved regarding our Special Use Permit #112. 5.) A resolution by the County Commissioners approving the NE 1/4 for expansion. In summary, Horton Cattle Companies assumed the Special Use Permit#112 covered the full 320 acres from the following facts. 1.) Pens have been on the full 320 acres for 25 years. 2.) A inspector stated the feedlot was in full compliance in 1985 at which time cattle were in all pens covering both the NE and SE quarters (all 320 acres). 3. At the time Horton Cattle Companies purchased the lot the seller assured us the expansion was for both quarters as they had already expanded into both quarters. Our current dilemma is twofold. 1.) We have committed to dirt and concrete contractors to start March 17th with a deadline for completion of May 15ffi . Therefore, a 60 day delay is cost prohibitive for us as well as the contractors. 2.) Our option to expand to the West with confinement to the NE quarter is less than desirable because of the following factors. 1.) Many nearby residents will then be able to see the feedlot from their homes along County Road 49. 2.) The expansion pens will be visible to the County Road 49 traffic. 3.) Drainage is not as desirable. 4.) Space is limited in this area and consequently there will be more cattle per square foot whereby wet pens and flies will be more of a problem. Therefore, we respectfully request. with all the Commissioners discretionary judgment, an approval, without a 60 day process, of expansion of this feedlot to the 22,000 head capacity as presently permitted and that, based on the unusual discrepancies and extenuating circumstances outlined above, expansion be approved to continue to the South onto the SE 1/4 of Section 18. It would not hook on to the Greeley system. DISCUSSION: Mr. Lorenson recommended approval . It is compatible with the surrounding land use and zoning , it has been approved by the Health Department, the County Agent stated there is no problems with the design of the expansion , there are no waste f or soil problems related to it. Any possible drainage would be into a dry creek. Mr. Sherlong stated they have 12 ,000 head at this time and would increase to 22 ,000 . They would like to make a change in some of the pens . Some of the pens shown on the west side of the proposed expansion would to added to the south . They have very little run off due to the sandy soil . Mr . Lorenson stated they would have to amend their legal descrip- tion before a recommendation could be made to the County Com- missioners . RESOLUTION : Be it therefore resolved to recommend approval of the feed lot expansion to the Board of County Commissioners subject to the submission of an amended legal description . Motion by Mr . SUBJECT : Discussion with Gerhart Brunner DISCUSSION : Mr . Lorenson stated the property in question is located two miles north of Windsor. Three building permits have been issued in that area , a fourth one was recently issued . Mr . Colette has sold 5 parcels without subdividing . The 5th parcel was separated by a distinct area .
