HomeMy WebLinkAbout960613.tiff RESOLUTION RE: APPROVE RESUBDIVISION, S #398 -WAKEFIELD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 10th day of April, 1996, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Gary S. Wakefield, 25554 Sandy Knoll Boulevard, Kersey, Colorado 80644, for a Resubdivision, S #398, on the following described real estate, to-wit: Lot 10, Block 1, Sandy Knolls Estates, Second Filing Replat, Weld County, Colorado WHEREAS, Steve Stencel, Intermill Land Surveying, represented said applicant, and WHEREAS, Section 8.3 of the Weld County Subdivision Ordinance provides standards for review of said Resubdivision, S #398, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.3 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.3 of the Weld County Subdivision Ordinance including specifically: a. The Resubdivision will not adversely influence the adopted rules, regulations, and ordinance currently enforced upon and affecting this subdivision. Sandy Knolls Subdivision is zoned agricultural, and this proposal is consistent with the existing zone district. The Resubdivision will not adversely influence surrounding property owners and conforms with the Weld County Comprehensive Plan. The surrounding properties are zoned agricultural, and to date the Department of Planning Services' staff has not received any negative comments towards this proposal. This proposal is within the Urban Growth Boundary Area of the Town of Kersey, which reviewed this request and found no conflicts. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Gary S. Wakefield for a Resubdivision, S #398, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Within 30 days from the date of approval by the Board of County Commissioners, the applicants shall submit a mylar plat prepared in accordance with Section 7.2.6 of the Weld County Subdivision Ordinance, as amended. The plat shall be recorded with the Office of the Weld County Clerk and Recorder, and the applicant shall be responsible for all recording fees. 2. Prior to recording the plat: a. The existing utility easements shall remain on Lot 10, and no structures shall be constructed or placed within the easements. b. If a public utility easement does not exist on the south and west sides of the property, a 15-foot utility easement shall be delineated on the plat. c. A 15-foot utility easement on the east property line shall be delineated on the plat. d. All existing utility and drainage easements shall be delineated on the plat. e. A standard utility provider sign-off list shall be placed on the plat. f. The applicant shall submit evidence to the Department of Planning Services that the existing septic systems are permitted through the Weld County Health Department or that an ISDS evaluation has been performed on any septic systems that are not currently permitted. in the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current ISDS regulations. 3. Wakefield to adjust the southern lot line of Lot 10, Block 1 Sandy Knolls Subdivision. The property is located south and adjacent to Sandy Knolls Boulevard. Based upon the submitted application materials and other relevant information regarding this request,the Department of Planning Service's staff recommends conditional approval of this request. This determination was based on the following: 1. The submitted materials are in compliance with the application requirements of Section 8.3 of the Weld County Subdivision Ordinance. The Weld County Utility Board reviewed this proposal and recommended approval. The Utility Boards concerns are addressed in the conditions of approval. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 8.3 of the Weld County Subdivision Ordinance including specifically: a. The Resubdivision will not adversely influence the adopted rules, regulations, and ordinances currently enforced upon and affecting this subdivision. Sandy Knolls Subdivision is zoned agricultural and this proposal is consistent with the existing zone district. b. The Resubdivision will not adversely influence surrounding property owners, and conforms with the Weld County Comprehensive Plan.
