Fiddlers Green Circle Englewood, CO 80111 Subject: VI-9700038,Violation of Development Standards for USR-860 To whom it may concern: It has come to the attention of the Department of Planning Services that you may not be in compliance with the Development Standards for USR-860, approved by the Board of County Commissioners on November 30, 1988. The noncompliance is with Development Standards#1, 5, • 6, 7, 9 and 10. A copy of these items from the approved resolution are enclosed. The Use by Special Review area must be brought into compliance with the Development Standards within five days of this letter. Noncompliance will result in our office scheduling a Probable Cause Hearing before the Board of County Commissioners. If the Board determines there is sufficient probable cause to warrant further action, a Show Cause Hearing will be scheduled to consider revocation of the Use by Special Review Permit. Please call a Current Planner within five working days of the date of this letter to review the Planning Departments concerns. Fiddlers Green Circle Englewood, CO 80111 LEGAL DESCRIPTION: Part of the SW4 of Section 13, Township 3N, Range 68W, Beg We & N30' of S4 cor sec N459.9' S68DW 263' S88DW 103.21' S357.78' E347' to beg exc UPRR res, Weld County, Colorado CASE NUMBER: USR-860, VI-9700038 DATE: March 4, 1997 The property was inspected due to a complaint that Harbor American Health Care Facility was being rented out as apartments and was not in compliance with the Development Standards of Special Use Permit USR-860. I also observed several derelict vehicles, lots of debris and household trash and a possible RV storage area located on the property. Site Specific Development Plan and Special Review Permit#860 is for a Nursing Care Facility and had specific development standards for the operation of the facility. The current uses on the property are not in compliance with Development Standards#1, 5, 6, 7, 9, and 10 as follows: 1. The Site Specific Development Plan and the Special Review Permit is for a nursing care facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The site is not being used as a nursing care facility. The property is now being used as an apartment complex, a noncommercial junkyard and a RV storage site.. The current use of the property would require the submittal and approval of a new USR application. 5. All construction on the'property shall be in accordance with the requirements of the Weld County Building Code Ordinance. The conversion of a nursing care facility to apartments would require a Change of Occupancy Permit in accordance with the Weld County Building Code Ordinance. Any construction, other than repair or replace work, would require a building permit. 6. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. The property is not in compliance with the Design Standards of section 24.5 of the Weld County Zoning Ordinance. 7. The property owner or operator shall be responsible for complying with the Operational Standards of Section 24.6 of the Weld County Zoning Ordinance. The property is not in compliance with the Operational Standards of Section 24.6 of the Weld 1 County Zoning Ordinance. 9. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. It has been observed by the Department of Planning Service's staff that the nursing care facility has been converted to apartments, there is a noncommercial junkyard on the property and a RV storage area without the submittal of a new Special Review Permit to address these significant changes in the use. 10. The property owner or the operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. The property owner and/or operator is not complying with all of the Development Standards for USR-860 at this time. Standards#1, 5, 6, 7, 9 and 10 are not in compliance.
